What is education law?
Education law is the area of law governing schools, school boards, school districts, school staff, and student’s rights. While public schools are regulated by the federal Department of Education, it is up to individual states to maintain compliance. So generally speaking, you will want to find an education lawyer licensed to practice in the same state as the institution you are proceeding against, even if elements of your claim are adjudicated in federal court due to a Constitutional or Civil Rights issue.
What does an education law attorney do?
An education lawyer works with clients who have been harmed in an educational setting - from preschool to postgraduate school, both public and private. An education lawyer handles a wide variety of issues, from Civil Rights cases, to Title IX offenses, to special education issues and personal injury lawsuits. If, God forbid, you or your child has been the victim of a criminal act at school, such as assault or sexual abuse, a prosecuting attorney will be responsible for handling criminal charges, while an education attorney handles the civil suit to obtain monetary damages for the victimized party.
How much does an education law attorney cost?
For the most part, education lawyers do not work on contingency (where the lawyer only gets paid once you win your case). There are exceptions to this rule if you have a very good case and you are suing for extensive damages. And sometimes, your fees may be waived or vastly reduced if your attorney works for a non-profit legal aid entity. But generally speaking, if you hire an education attorney, you should expect to pay legal fees out-of-pocket for the duration of your lawsuit. Bear in mind, however, that if you succeed in your claim, the judge may sometimes order the losing party to pay your attorney’s fees - thereby making you financially “whole” for the legal expenses you’ve already paid.
Education lawyers usually charge an hourly rate, and that rate will vary based on the complexity of your case, where you live, and the experience level of your counsel. However, your initial consultation is usually free, and at that time, your prospective attorney will give you a detailed estimate of their fees and how payment will be structured.     I’m studying to be a teacher but if I ever decide a different career path I do see myself being a education lawyer/ advocate. I would specialize in special education both in the public/charter/private grade school arena and in the college / university level.

    You have the right to FREE and appropriate public education… but you gotta pay for an attorney to get the free education you are entitled to….

    The principal unlawfully removed my kid from school and the home and hospital program after my son, a 5-year-old autistic boy, was physically abused by his teacher, tried to claim he was nonverbal when he is extremely articulate, and made a discriminatory statement that was inaccurate. He was assigned to a general education class with a non-special education instructor who lacked the necessary training. His IEP was not being followed, and he was not receiving occupational or speech treatment as recommended. The staff was careless because my 8-year-old son had to take him to class in the morning because they were never there to pick him up for arrival. Before I arrived, during dismissal, the school personnel had given my 5-year-old autistic son to my 8-year-old, putting both of my kids in danger. In violation of rules, the school declined to notify the state's attorney and local law enforcement about the teacher's assault on my kid. Two quarters of my son's schooling have been missed. None of our complaints have been answered by the school system. Despite the fact that we sent a certificate from our son's doctor stating that the school has negatively impacted his mental and physical health, they are still trying to force us to reenroll our kid in the classroom where he was assaulted. Despite the school's opposition, the doctor advised that he be transferred. Do you know of any Maryland education attorneys? How probable is it that my son's lawsuit will succeed? How long does it often take for situations like this to be resolved?

    Thank you for informative video 🙏🏻 I’m learning about the school psychology field. I heard some information about working with difficult behaviors. But I don’t know how accurate it is. Since you know special education laws , I taught to ask here 🙏🏻 I appreciate if you can guide me . I was talking to a school psychologist and that’s what she told me : a child is acting dangerously in a class , he/she is throwing chair or running with a scissors ( considering the teacher has removed all children from the class for their safety ) as a school psychologist , they send you in the class by yourself to calm down the student . But if the child starts to chase you with the scissors, you can not leave the area . Because if he /she happens to injure himself , you will get sued and you will have to pay for medical expenses. I got confused about this scenario because you either need to choose to get sued for child negligence or paying lots of money for his medical needs or choose to get injured . I really appreciate your opinion 🙏🏻 that would be great help 🙏🏻
