    The best way to do this is check for properties that are about to go to auction per say they're at the END of their 2yr grace period THEN purchase the TLC.. if they don't pay, you'll own the property outright instead of your monies being held up for 2-3 yrs... better deal to me than 18-24% interest

    Thank you for watching! While investing in tax liens and tax deeds have many similarities, they also are quite different... A tax lien certificate sale is when you pay the back taxes on a delinquent property and receive a certificate to hold until the taxes are repaid by the owner at which time you will get paid back the taxes plus interest. The interest rates vary by state. At a tax deed auction, you are bidding on the property and will get a deed to the property. When you invest in tax deeds, the investment is typically larger and then you get the property so there will be more effort applied to prep, market and ultimately sell the property. So while there is more to do and a higher investment in tax deeds, the return is also often much larger!     Thanks for your question. The tax lien certificate in Florida could be outstanding for 2 years. there are people that redeem the next day and there are people they wait until the 2 years. I doubt if anyone really knows when a certificate will be paid off. - Ted Thomas

    Both I suppose, this is a great question. Everyone should do their due diligence when seeking properties to invest in, whether its a tax lien certificate or a tax deed property. Ultimately, when purchasing a TLC, you have a slight chance of ending up owning the property, in which case you would have wanted to know if it is sellable or even buildable or worse landlocked.     Each county is different and has different auction rules. Always check the auction rules first when preparing to attend an auction to see what rules are and the bidding process. Some states will have varying interest rates because they have a "bid down" process like Florida and Arizona where the interest rates are bid down during the auction.     Thanks for asking your question. Keep watching the channel, you are missing a few points. Allow me to give you a little clarity. If a property owner fails to pay taxes the legislature authorizes the county treasurer to confiscate/ seize, the property and resell it. The property owner that has failed to pay taxes has defaulted and forfeited their rights of ownership. - Ted Thomas

    Thanks for your question. You will need to take a minute and digest my answer. Lien law works specifically like this… first in time is first in place. If the tax lien is filed on day 1/1/01 and subsequently in the next year of 1/1/02 will come the next tax lien… on 1/1/03 another tax lien. Now let’s go back and look at the rule. First in time is first in place. So the first tax lien has the priority. No lien can be filed on a property that will be prior to the tax lien, all liens will be junior to the tax lien because they are filed at a later time. First in time is first in place.     I looked up rules in New Mexico. I just read the state of New Mexico, including all counties, does not conduct tax deed, tax certificate and tax lien sales. The only property sales conducted by the State are public auctions due to two or more years of delinquent property taxes. Is it possible to just make money on public auctions?

    Great video.. Question.. FL requires a 2-7yr hold on certificates however, there are certificates available from let's say 2017. Can I buy the 2017 certificate and immediately request the deed sold at the next auction?

    Hi Crystal, Thank you for your question, in Florida if you buy a certificate and no one pays the certificate you can then petition the county to have a tax deed auction - anyone can attend the tax deed auction. The highest bidder will receive the property, if no one shows up to buy it then the tax lien holder will get the property.

    Thanks for your question. Tax liens all have time limits, there is no payment on the last day of the time - you will own the property. There is no way to accelerate the process however the property owner can accelerate paying off the debt early. - Ted Thomas

    Thank you for your question. A tax lien certificate is nothing more than a piece of paper which the local government will issue when someone hasn’t paid their tax. Anyone can purchase this certificate. If the property owner does not want to lose their property they will pay the amount of the certificate plus whatever rate is written on the certificate - for example, Florida pays up to 18% and Iowa pays up to 24%. If you purchase a tax certificate and the property owner failed to pay and the certificate said 18% on it - your return on your investment would be the 18%. - Ted Thomas

    Thank you Isabel for your question. In Texas if the process is completed- by that I mean you bought the tax deed at auction and the property owner has 180 days to pay you off, if they don’t pay you off and the sale is completed, the mortgage will be wiped out.

    First, check the auction rules so you know the full process and the redemption period. After you purchase a tax lien certificate - you wait.     In Pinellas county, FL the certificates are auctioned once a year and often bid down to 0.25% according to the tax assessor's website. Why would someone want to tie up their money for only 0.25% ?

    Thank you for your question. There are multiple answers here. The first answer is if the people own the tax certificate and nobody pays they will end up with the property. The second reason is if the people come in and pay early the tax lien certificate holder can make 5% even though they bid down the .25%.- Ted Thomas

    @@Ted-Thomas Hi Ted, thank you for your timely reply. In Pinellas County, FL, the holder of the tax certificate can not foreclose on the property. They can request the property be sent to auction. At the auction, the holder of the certificate has not control or advantage over other bidders.

    If you wind up getting getting house via tax liens or tax deed, is they're closing cost when purchasing? If so, is it done by percentage of the property appraised value, or percentage of the value of the lien/deed?

    Thank you for your question. If you go to the auction the auctioneer will state a price and following that, if you are the winner and the taxes have been paid, of course the county will find some ways to charge some small fees for the paperwork. Regarding closing cost, those usually are terms that are used in regular real estate when they balance out the taxes, insurance, brokerage commission and attorney fees.

    Hi Ted thanks for the video, If I buy a tax lien and the owner fails to pay, it sounds like there are 3 possible scenarios ? 1) The bank can find out and foreclose 2) The county can decide to take control of the property 3) The owner pays taxes and I get my investment back. My 1st question is ... 1) Do I have those 3 scenarios correct 2) Are there any other potentials paths it can take ? 3) How long before the county decides to take control ? I'm guessing this depends on the country ?

    Hi Paul, when an owner fails to pay the property tax, and it is a tax lien certificate state, you will purchase the certificate at auction for a specific interest rate. That certificate will have a redemption period where the owner has 2-3 years (Depending on the state) to come in and pay the taxes or you could foreclosure on the property. During that time there are multiple notices that go out to any lender/ mortgage company to let them know the property is in default due to unpaid property tax. At that time the bank or the homeowner can come in and pay the taxes to the local government, which in turn the local government (treasurer, tax collector, etc) will send you a check for your full amount invested plus intertest. Typically the interest is accrued annually. I hope that helps - Ted Thomas Team

    Hi Natalie... Georgia is a redeemable deed state where the owner sells the deed to the property and the property owner has one year to redeem which means they would need to pay the back taxes plus the 20% penalty. At this point, if the property owner does not pay you can hold off another year or longer and the penalty increases each year or you can petition to gain ownership of the property. If the property owner doesn't pay, you get the property with no mortgage. You would want to check the county website for the specific county in question to find out the rules and the process to follow, it can vary from county to county. Always check the rules! Question for you, I am looking at a property in an upcoming foreclosure auction in NJ, after a little research it looks like the foreclosure is for the tax sale certificate, its been 2 years, and after driving by the property it's definitely vacant. Will the auction price start at the price of the tax sale certificate with whatever the interest rate is or is the owner of the tax sale certificate getting the property at auction and it won't be available for bid during the auction.

    Hi Steve, Hi, #1 thank you for the question. #2 good question, the first thing you need to determine is, is it a tax lien certificate auction or is it a tax defaulted property auction? New Jersey starts with tax lien certificates and then you need to research if New Jersey automatically gives them the property or do they have another auction. In other words, if the taxes were not paid does the statue state that the holder is the automatic winner of the certificate, which would be the case… Or you may be looking at an auction where no one purchased the tax lien certificate and now the government is selling the tax deed or ownership of the property, it could be any of those scenarios and the way to find out is go to the county records and go online at the records or on in person and study the statue. Everyone has to do the same thing because New Jersey is such an over governed state with approximately 30 counties and over 500 municipal taxing districts. The county records show a bank or investment group recording tax sale certificates since 2016. Documents from 2018 show a tax sale certificate foreclosure (notice of lis pendens) and now it’s on a list of sheriff sale foreclosures in the county next month and the bank is named as the plaintiff . Do you think this is something that can be bid on by anyone in attendance at the auction or at the auction the auctioneer will be awarding the property to the plaintiff aka the bank . Estimated judgement according to the county is 68,000$ which would line up with the total tax owed with interest

    Hi , I need some help in understanding NJ tax liens process. I got few properties through tax sale investment in NJ last month. Qn1- How to get the lien recorded. In New Jersey we have to get the lien recorded by the county. Anybody has any experience how to do that. If we have to mail the tax certificate to county, do we mail them original certificate to get the lien recorded ? Qn2- When is the best time to pay the Subs(Subsequent dues) , should I wait till end of year or immediately start paying the subs. Qn3- How do I pay subsequent dues, Does anybody has any sample of affidavit that has to be attached with it. Need your kind help in above mentioned 3 questions. Questions are for NJ tax sale investing.

    Hi Sarang, New Jersey is different than most other states, each municipality conducts its own tax sales - that is 566 auctions! I recommend contacting the specific municipality you are interested in with your questions.     The county already has a lien on the property BEFORE any real estate is built on the property. The county owns the very first lien, any lien after that is a subsequent lien and JR to the county. So if someone came along and built a house they would have a JR. or second lien.

    Hi Bri, Thank you for your question, I have been to many auctions I don’t know what adjusted value means but I can tell you that many times the auctioneer would use what’s called an assessed or taxed value, be very cautious when buying at auctions, do you own appraisals, do you own comparisons with MLS, do comparisons with Zillow, and do comparisons in the neighborhood so you are comfortable with value. The tax collector means well when they put an assessed value but the markets change rapidly. In the 90’s Los Vegas lost property values sometimes 10% a month. In the same 90’s Seattle gained value sometimes 20% a year.

    Hi Samone, Impossible to answer, someone could pay their taxes the next day and you get your money back plus a small percentage. The point is, when you buy a tax lien certificate you want it to stay outstanding as long as possible because it is amortized across 365 days a year. Thank you for your question!     Hi Amy...The lender will still have a mortgage note with the property owner but in most cases it is extinguished from the property by the tax sale. Of course, always check the auction rules for the state and county in which you plan to invest as the laws and rules from state to state and county to county will be different.     Hi Mauro, when you purchase tax lien certificate, you are paying the delinquent taxes on a property. 95% of all tax lien certificates will redeem giving you a high-interest rate in return (different state by state) OR you get the properties. - Ted Thomas Team
