What are Real Estate Encroachments?

What is encroachment in real estate? Real estate encroachments are the intrusion on a person's property and rights to that property.

Objects, structures, and access are considered encroachments that can limit one's access to their own land.
If a neighbor puts up a fence that strays 2" onto your client's property, the neighbor is in violation of your client's property rights.
Property owners must be cautious of encroaching neighbors who inadvertently take advantage of land rights.
In the state of California, if a person occupies a property against the owner's interest for 5-years, they can claim that land as their own.
This is called adverse possession.
It's one way that encumbrances can affect your property, and why you should know how much land your client owns.

    YOU are a vibrant mentor that is an engaging speaker. You could teach a person anything (for me? Even physics). Encroachment is not only invasive on real square footage, but on the psyche of the neighbor who is victim to such intentional malfeasance!

    Thank you for the excellent presentation! My issue is my neighbor planting tree on property line, his trees are growing all over my yard, my roof, damaged drainage, blocked rainwater from flowing to street, water buildup near my house and backyard.. a whole lot of problems. Does planting trees count as encroachment? Damages to my property is more than 5000, I have verbally talked to him about these issues, he agrees to remove it but has not done since last year

    Thank you for the helpful information. I have a question about easements (did watch that video). Say a seller is selling 4.4 acres of land for 12,000 dollars. Half of that land has electrical towers and fencing moving across it. If I am to buy the land but only have the ability to develop on the 2.2 usable acres, does that electric company pay the owner on a lease, does the city get that money; how does that work and am I able to see that on the preliminary title report?     Hi, Sarah! Great question. Most laws are similar but there is a chance that New Jersey could have different laws. The best way to use these videos is for supplemental learning. It shouldn't take the place of your main education source because it is meant to build off what you're already learning. Hope that helps!

    My mom & dad live in Saginaw Tx, has a land dispute with a empty lot to the south & a neighbor to the north. After maintaining and mowing the empty lot for over 24 years with out being payed. They fighting with code enforcement about needing a survey or we have no rights. We paid 550 for a survey, than double checked there work, to find out the neighbor to the north has half their house a shed and a fence on our property we need legal advice on what to do my name is Steven Hungerford look up on KZread My name or Saginaw tx they should be fired for this. We dont know who to go to for help!

    Friend of mine says his new neighbor wants to build a wall between their properties and pay half. They both agree. I'm concerned even though they both verbally agree it's okay that wall is on both properties. Half wall on his half wall on theirs.

    question I have bought my house in 1998 and the back yard had a fence up and the realtor told me it was my yard and the Previous house owner said it was our backyard. we have not changed the fence at all just put up Privacy fabric and we just got a 30 day notice saying we need to move all are stuff out of are back yard and take down fence and put a new fence up because that's not are back yard . crazy 24 years living there and know someone telling us are back yard is not ares . there are 4 houses in the same boat as us . I really need help can you please help me ?

    I have a question about encroachment. I just purchased a house, three months later after moving in, i found out that my neightbor’s fence its crossing over my property. It is an enchroachment that no one knew about, not my neightbor, not the real estate agent not the appraiser and it wasnt on the history of the title. Who do i sue for the encroachment?

    Great question, Dana. Adverse possession and prescriptive easement are very similar but not the same thing. The difference between the two is possession and access. With adverse possession, after a specific amount of time, the one using the property can claim it as their own. Contrastingly, prescriptive easement gives the individual access to the property. They do not own that property but they have access to use it. For example, a piece of property used as a driveway or pathway. I hope that helps and thanks for asking!     I am selling my house the garage and carport is on Caltrans property right away, it is been there for 58 years, Caltrans says that they will not give me the new buyer encroachment permit without tearing it down meaning the garage and carport, there is no need for encroachment permit because it would not help because of the terrain and the fact that I already can get it onto the property for 58 years without it, but new buyers are skeptical of all of this, any answers to this

    You will have to look into common laws that validate the possessor. So, long as they do not abide by those laws they will not possess the land. Whoever has a land at risk of being adversely possessed, then they should seek legal assistance to protect the land.

    @@USRealtyTraining Thank you for the reply. I will do that. Adverse possession is very unjust when others are still paying the taxes on the property. If taxes aren't being paid the law makes more sense other than that it is nothing less than land seizure.

The audio is coming out at the correct volume and was tested across multiple browsers and devices. Could you describe your issue a bit further?
