We're Suing Florida for Anti-Asian Housing Discrimination - ACLU - At Liberty Podcast

This May, Gov. Ron DeSantis signed SB 264, a law that restricts Chinese nationals from acquiring property in the state of Florida under the guise of protecting national security. But the issue is actually pretty clear - Chinese people are not the Chinese government, and conflating the two is just the latest iteration of anti-Asian land laws and anti-Asian discrimination that date as far back as the 1880s. Rather than protecting national security, the law will shatter the dreams of Chinese families, students, and business owners hoping to build a life in the Sunshine State.
So we at the ACLU, along with our partners, are suing Florida over SB 264, arguing in Shen v. Simpson that the law legitimizes and expands housing discrimination against people of Asian descent and therefore violates both the Constitution and the Fair Housing Act.
Joining us today to discuss the case are Bethany Li, legal director of the Asian American Legal Defense & Education Fund and one of our co-counsels in the case, and Echo King, an immigration lawyer and co-founder of the Florida Asian Americans Justice Alliance, a group which rallies the support of Floridians against this kind of discrimination.

    You are right to sue. This law does not do what its authors originally pretended. Florida, either shut down every single business with a non-American owner (a very bad idea) or completely rewrite this law.

    How about suing Florida for all of the first amendment violations. I have standing for cause of action over and over again!

    I applaud ACLU and this podcast. I spent seven years researching Asian American stereotypes during my doctoral dissertation. So, to be very detailed Asian American actually Chinese discrimination in the United States dates back even further than the 1880s. People v Hall CA Supreme Court in the 1850s established that Chinese people could not testify against Whites. With respect, Dr. Jim Moyer

    @@larrychannell7056 You can add the Second Amendment to the list. I am currently facing a felony because I was FORCED to defend myself and a colleague from a crazed, armed security guard, while filming a FEMA office in Daytona, Florida. The security guard fought his supervisor who was trying to hold him back. I had no other option but to protect myself. The state won't drop the malicious charge 8 months later.

    @@jamesmoyer8154 Doctor, I have nothing but respect for the Asian people and the ACLU. Thank you for all of your hard work to secure the RIGHTS of an unrecognized minority. When discrimination rears its ugly head we need to advocate as the press.

    As a real American I'm separated from my family by 3 states, 1,000 miles, hard to get to see them and it hurts so bad I feel like a refugee and want the ACLU to get my family closer together too. Shame on ACLU for NEVER doing anything to help real Americans.
