WATCH LIVE: Concourt hears Zuma's rescission application

The Constitutional Court will on Monday morning hear former President Jacob Zuma’s application for a rescission of his 15-month jail sentence for contempt. Zuma filed papers to the apex court to rescind the verdict, citing health concerns among other reasons.

    "it is the constitution that is supreme and not the courts " adv Mpofu. I like that I would add it is not the court nor judges. Fmr Nelson MANDELA in his case versus LUYT "Even judges are not above the law" if they have exceeded their powers beyond what the constitution provides, they must re consider the conviction and judgement

    If more than one sitting judge has to correct your case citations and rectify the basis your arguments - it’s time to reassess your strategy, not power forward into your failing point. That said I don’t envy mr Mpofu’s starting position.

    If Mr Zuma's defense manages to win the confidence of the Concourt judges I tell you that will be disastrous for the South African Constitution. We are coming far with Mr Zuma's troubles with the law. No. We have taken too much beating as the law-abiding citizens and taxpayers. enough punishment!!!

    I'm a Seaman. I sailing to RSA since 12 years couple of time per every each year. I saw many countries, governmants and everything what is connected with this. I came from European country(Im in Durban now) where we exactly know what is the racism and how its look like the worse face of rasism. Im so happy and glad since apartheid dead and finished finally! My belowed South Africa, from the begining, wonderful, uniqe People of this beautiful Country! I ask You only for one thing because I cant look any longer what is happening with your Country inside and hiw fast is going down in every each aspect. Pls! I beging You, all of You. Stop to vote for stupid people only because they are black. Do not follow after colour of skin! Leave this way of thinking. It is time to grow up. We have 2021. Its really time to choose somebody who is educated, who is smart, who has got a knowledge, and experience and somebody who is real, who is for nation, for People! And pls, Brothers!     It's high time our judiciary goes beyond the rule of law in the Zena rescission proceedings, but look into exceptional factors, otherwise people's lives are being compromised. The SA law does allow for such.

    I believe that no one is above the law only the nation is above the law. N if it's TRUE that former president Zuma he fought for this country n he played the role drafting the constitution that mean he knew better than those who learned about the constitution. If he did the crime or not the only group that can judge him ar those who played role with him in drafting the constitution or the ruling political leading part. The ordinary driver if he break the law in the road he may get fine . But when the traffic officers break the same law in the road its another story. Even now gatherings r not allowed during level 4 lockdown But that does not mean those who gatherings to protect malls from looting ar comiting crime. No thousands times no . Because the nation is above the law only the individual is not above the law

    What valid arguments? Nothing he said is sustainable in law. Some of the assertions and understanding of the law were shocking. And he can’t even correctly record judgments even when Madjiedt J brings this to his attention. It’s actually embarrassing to the profession !!!

    @@rasch3126 all his arguments were premised on relevant sections of the constitution and rules of the concourt. He cited the relevant caselaws so eloquently so much that the justices are compelled to find in the applicant’s favor to if indeed they are to assert the natural laws of justice invoked by Zuma’s bill of rights. He clearly exposed the judgement of the constitutional court to be in error both in common law and constitutional matters vindicating the unwaivable rights of the “accused” in any criminal matter. Mpofu is reminding the Justices that in fact it’s the Constitution that is supreme not the constitutional court. Concourt is also subject to be scrutinized within the framework or provisions of the Constitutional when they have exceeded the powers conferred to them by our Constitution. Watch and learn as you are being taught

And conflating criminal with civil proceedings is just totally disingenuous! This is contempt of a civil court order and how it’s dealt with! It’s called Civil Procedure 101!

    @@rasch3126 wow if I were you it quickly delete that post before anyone else notices it. Coz you you are making a laughingstock of yourself now. Contempt of court is a crime that’s law 101. Where you are dealing with a civil matter, usually in courts a civil relief is granted, but in this case a sentence was granted. Now listen: this leads us now beyond the confines of civil proceedings coz we are entering the territory of criminal offenses with automatically invoke the rights to fair trials as guaranteed by our constitution for any “accused” person. No accused person must be sentenced without a fair trial (now that flows from the constitution itself). All the justices conceded that both in the majority and minority judgement the point that this case involves both civil and criminal grounds. In the majority judgement Justice kampempe refereed ti this anomalie as an “Almagamate” and in the minority judgement it’s referred to as “Dua purpose” Go back and listen again. Stop embarrassing yourself

    Dali Mpofu is GOAT. He had a this judges by the balls. Sisi Kampempe (Hired gun) and the other judges were exposed for their emotional and biased judgment. Kampempe had no input except being a timekeeper.

    If u refuse to speak, then u fail to challenge aspects of your opponents case/evidence. The court had no choice given the fact that he refused to his version, and Zuma clearly getting pathetic legal advice. If he does the same during corruption trial, he'll be found guilty. It's that simple.

    It must be remembered that the thieves in the high degree of theft are not being procecuted as yet but offered a polite approach to be willing to sell the "land" for argument sake but they forcefully took the land which for peace purposes the same crime is not committed to bring the land back to the rightful owners l thought l should just say that preparing for the point l wish to make which is that an old man and his actions are way different from that of the previous presidents ambiguous actions given Mr Bothas, Deklerk, Mandela you name them up till Zuma.... Crime is crime and is punishable as it may but that being said does he not qualify to section 35 as the case at hand? But in the same manner every lawyer has a duty to defend his client where there is room for that in the court of law despite the fact that there is a salty hate in an old man's case
