IIRC the joke about Scanlan suggesting they return to Emon and “fight their case in court” and then blaming Keyleth is that Marisha, Keyleth’s VA/player, suggested at the table that they run. It was an in-character suggestion but fans criticized Marisha for it. Years later they can laugh about it Scanlan with Bigby’s hand to play another Sam Riegel banger

no - it happened pretty much how the show put it, in Race to the Ziggurat SAM: Just to point this out before we go in and kill ourselves. We have evidence now. We could abandon this whole thing. Go back and fight our day in court TALIESIN: I want to see what they're building down there. And I worry that it would be dangerous. MARISHA: Plus, we'd just abandon this entire revolution that we caused? LIAM: People are putting their lives on the line. Plus, Uriel is suspect now. He's been corrupted; he is not trustworthy. There's no point going back to him. TALIESIN: I can't leave again until this is taken care of. SAM: Right, that was a stupid suggestion, Keyleth. Especially since it was Keyleth who forced Vox Machina to run back to save the villagers even though they were pretty much tapped on resources, right before Pike first showed up.
