It does not matter how smoothly and fluently the arguments were posed. It breaks down on the simple and stark fact that the victim was a minor, therefore not in a position to extend consent. The advocate's argument that the parents were not witnesses is weak and unconvincing, as it has nothing to do with the act or with the consent to that act by the victim. Good pleading wasted on a bad case. The continued and extended argument that the relatives and the parents were aware of the situation, and therefore in some way complicit, is preposterous. If that argument is to be heeded, there is no need for laws at all; merely social judgement can decide the matter.

I agree that the victim being a minor makes any consent on her part invalid and that the defendant's punishment was fitting. But why is the family, which supported the relation of a minor, not implicated? Can you explain that? PS: I am not being argumentative. I want to know the judiciary's stance on that.

Secondly, it is not scientifically impossible for a 13 year old minor boy to commit rape. We have sufficient precedents to show that such cases have presented themselves in front of our courts.

In most civilised countries, rape laws are gender-neutral,and women have been convicted of statutory rape; mostly female teachers abuse their male students But in India, only girls can be victims satutory rape . I'm talking about satutory rape (when two people have consensual sex, but it still counts as rape because one of the victims is a child). In a civilised country, if a 17-year-old girl has sex with an 11-year-old boy, the boy would be considered a victim of statutory rape. But in a cruel country like this, just because the girl is under 18, she would be considered a victim, and a boy would be considered a perpetrator.

Arguments in the Hon'ble High Court are never fancy. Every argument has a grounding based on law. Circumstances matter when an offence takes place and nothing happens in a vacuum. It is these surrounding circumstances that need to be brought about to the attention of the Hon'ble court.

The argument is that it was not a rape, they had an affair (which is true), and had sex (also true), and it was considered rape post facto when the boy refused to marry her. Her argument is that it was considered rape only because of a presumption of a false promise of marriage, and she says the promise was not false, but he later changed his mind. In any other civilized country, this would not be considered rape.

Huge respect for judges. The last comment is commendable - "misplaced sympathy". No matter how intriguing arguments from the defense counselor were there, but as per law, everything goes away.

It's rather cruelty to put him in jail for 4 years, just because he had coitus with a girl his own age, while both were minors and many years later she felt it was somehow rape! Why make such bogus laws? Just make a simple straight forward law, Indian constitution Article number 1 "Don't have sex".

Do you know that in present times teenagers especially boys are more drawn towards sex? Nd I won't talk about anyone else but the people I know myself. For teenage boys, relationship is just a way to make sexual relationships. Whereas girl of the same age are more matured by that age nd they don't think much about getting sexual favours. Yes, some individuals may do it but on an overall basis, wmoen form relationships to marry. Whereas guys are more ambitious nd they do form relationships to marry but at the same time, the have this excellent manipulation technique to manipulate girls into having sex with them. I think you as well mist be knowing it irrespective of what your reply would be. Cze it's not possible for guys to not know about other guys. The good men never make promises if they have even the slightest doubt that they won't be able to fulfill it. They're always honest about what they want nd that's why few couples have lovely relationship and married life while others suffer. It all depends on the guy whether to make a promise nd fulfil it or to break it later. I could've defended the guy. Infact I had so much to say in favour of the guy if we talk about arguing. But deep down I know the truth nd every single guy whether good or bad, knows that most of us are unfortunately bad. We must always keep our good side up. That would be better for us and the society as well. Girls cheat too, they as well do terrible things. I'm not denying it. But the number is still very less as compared to guys. How many cases you've heard about women raping or manipulating men into sex? Probaly 10,12? Nd how many cases you've heard of men doing the same? There are lakhs of cases still pending in the court. We see it right from young age where young boys are beaten like animals at schools and home and everyone considers ot totally fine . Wow what an argument.. The advocate knows how to behave in the court and how to respect the judge....

This strict letters of law is bull shit specially in case of women defence. Just think of the logic the guy is in custody that 1. he had been relationship with girl with the assurance of marrying. Now this means that girl also gave the consent that she would be marrying that's why she went ahead with physical relationship. Now she is married to someone else having kids can boy go and say breach of trust. 2. The other argument is girl was minor and didn't had the age limit of giving consent for physical relationship but willingness was there. Who is incharge of the girl to check whether she is willing going in good or bad relationship specially she is minor. Should the guardian be also prosecuted and charged why only the boy have all burden. The girl is going in relationship willing to have physical relationship but the only guilty party is the boy. One side the women can have adultery and not a crime even if being in marriage. This law we have made. On other side we are saying that if girl is in relationship and it sour she can go ahead and file complaint that relationship was with a assurance of marrying and now it's a breach of trust since the relationship has gone ba. Completely crap age old laws which should be amended.

First Both were of same age. Secondly guardian of the girl knew about their relationship. I This establishes the fact that whatever happened many times was done with consent. If still this is considered as rape. Than govt and judiciary should make it clear that sex before 18 is rape irrespective whether it was done with consent or not. Awareness campaign in schools colleges must be done. Because most people know rape as sex without consent. Most importantly how can someone be sent to jail for 7 yrs or more just on the basis of victim statement. This will lead to extortion and men committing suicide.

@@aartishah7988 Generally a major person is that who attains 18 years of age but as per Muslim personal laws & Exception 2 of Sec.375 of IPC physical relationship with wife who not below 15 years age is not rape. So, If Age of Girl is Above 15 years or 15 years & Her Marriage is valid as per law then physical relationship with her not amounts to rape.

so before relationship , he shud have not only taken consent but verified the birth certificate of the girl? what if she produced a fake certificate or shes not having that? If a community girl can marry at 15 ,how other community girls are biologically different? what laws we have?

From my experience I can say it is always a boy who forces or compels or persuades girl to get involved in physical relationship therefore, there is a law which punishes boy if a fir is a minor…… now, please don’t tell me girls also compels boys to get involved in physical relationships because from my experience with more than 2 dozen girls I have never come up such scenario

The first question was. Are you related? Which speaks how serious the honorable court looks into such rape cases. The defense were benefit of doubt in victims age, parents knew the relatiinship bec he was neighbour, convicted is young, victim is happily married with children saying other wise she is spoiled now. If her statement is allowed there will be great illegality against women in society. Many criminals will hide under this verdict And go scot free. The honorable Judge differentiated between law of land and culture. Before british came our culture was exploited by brahmins by following varna and manu which did not allow a lower caste to seek justice on equality and women considered as sex satisfying object. Girl is lucky that she is married and happy. But usually no one accepts the victims of rapes. Ek bar daag lag na bahot bura hai, ladkiyon ki jindagi barbad ho jati hai. 15 yrs rigorous imprisonment is proper and no bail should be given, there has to be more strict laws in case of rapes.

Our laws are written just to get misused so that all make money, while rich people will get easily get away from any situation,

Just a statement of the girl puts the boy behind bar is not fair, if the girl was minor then how the statement of minor can be considered? Biased laws are not good. Strict punishment should be avoided unless there are medical evidences.

महिला वकील अपने क्लाइंट के लिए बेल मांग रही है जो की जेल में चार साल से बंद है उस पर नाबालिक लड़की से शादी का झाशा देकर रेप का आरोप है। यौन संबंध सहमति से बने ये वकील केह रही है और अभी नाबालिक लड़की की शादी और बच्चे हो चुके हैं, और ये कोई धोका देने बाली बात नहीं है लड़का उससे शादी करने भी तैयार है। बात अटकती हैं कि लड़की नाबालिक थी सेक्स चाहे सहमति से हुआ हो और चाहे लड़के ने धोका नहीं दिया पर पोक्सो एक्ट के मुताबिक उसने रेप किया है क्योंकि लड़की की उम्र अठारह से कम है।

Where is the law to call judges as My Lord. There is no Lordship in India now after independence.

What is problem in giving bail? What happened to innocent unless proven guilty? Bail is the right of every innocent if person does not poses any further danger or influence.

Yeh law hi galat hai aaj almost every school boy studying in 11th or 12th has a girlfriend.....but natural hai unke beech mein bhi kuch Hota hoga.....phir toh sab ko jail mein daalo.....this law needs to be changed.

I think the people of India (including Indian court/judiciary system) misunderstand what consensual sex means in the rest of the world. If you read details of the proceedings of any country, you will find that it is talking about will and consent. Will is a mere want or desire to do an act. It usually reflects a yearning or longing to enter into a sexual act. On the other hand, consent relates to the active showcasing of willingness, a manifestation of the actual will to do an act. A person can not have the will to do a particular act but still may consent to it and vice-versa. Even if a person has consented to engage in sexual activity but he/she may not have a will for it, the person entering into a sexual act with him would be liable for a crime. More precisely A girl can give consent because she believes in that false promise of marriage it does not mean that she is willing to do it. Now the question is what is the false promise of marriage? The answer is - If you promise to marry the girl and refuse to marry after sex just because you promised it to get sex. It is different than you promise to marry and differences got created over the time. And that is the reason why a sexual activity with a false promise of marriage is considered rape. Like in 376 her words are gospel like in this case and in 125 crpc she can lie left right and center in affidavit and if opposte party gives proof and she gets caught then just left with a warning on contrary a man is slapped with fine and perjury.

How can people appreciate so shitty arguments from a senior advocate who doesn't even care to read the law and is trying to misguide the court. She's arguing on the point of false promise to marry even when she knows very well that the girl was a minor and the law on the point is that a minor cannot give consent. It is very clear that money can buy anything including conscience.

how could it be assumed that,THE GIRL IS HAPPILY MARRIED.SHE WILL remain AFFECTED FOR WHOLE HEr LIFE due to that life ruining incident.

Even men is not married and may be remains unmarried for the whole life due to that life ruining jail. If girl is considered immature. So boy is also not too mature. Even boy is ready to marry her. POSCO should be redefined for such cases. 2013 amendment is worst.

It was not rape. They had consensual relationship. It was termed as rape because girl was under 18 as per the laws of the land. Sometimes being a lakeer ka fakeer hinders the process of justice.
