Understanding the New FTC Ruling Banning Non-Compete Agreements

Ғылым және технология

In April 2024, the Federal Trade Commission announced a final rule that essentially bans all non-compete agreements. In light of this change, lab owners must understand how to navigate non-compete clauses and how their own employment agreements with sales personnel or executives stand to be impacted.
We recently welcomed Les Levinson and Danielle Tangorre of Robinson + Cole to discuss the key considerations of the rule and the potential impact to your laboratory and employees.

Are noncompetes still enforceable if paired within an employment agreement? That’s the situation I’m in, not a senior exec.

In many instances, it appears they won't be enforceable. However, you will want to consult with an attorney to review your specific agreement to be sure.

In many instances, yes. However, it will depend on their employment status as mentioned in the video (ie: whether they are a contractor, etc.)

@@LighthouseLabServices I’m an independent contractor. I work as a real estate agent. I signed a non compete with my team lead but now I want to go off and be a solo agent. The non compete says I can’t stay at the same company but I don’t want to move to another brokerage. Do you think I can say “sorry I’m staying here as a solo agent. The non compete I signed is no longer enforceable and you cannot tell me which company I can and cannot work for”

@@nickkkk495, unfortunately we can't offer direct legal advice here. Your best course of action would be to review your specific clause with an attorney. Best of luck going solo!

Do you vet your presenter’s prior to educating on important topics? This was hard to listen to, um, ah, um…🤦🏼‍♂️

We do vet our presenters but apologize that you found this to be difficult to parse. We prioritize legal knowledge and expertise when presenting a topic such as this, especially considering the uncertainty over how it will be enforced.
