What are Indians celebrating about? The court rejected all the remedies sought by India and said its decision does not apply to conviction and sentence by military court. Pakistan just needs to fix the process errors and review the case according to provisions in Pakistani law before he can be executed.

@PakMan review means that you cannot go ahead with the sentence already given to him.. Now you will have to give India access to him. Allow India to appoint a lawyer for him .. Who will present his case and oppose the case of the army.. Not like military court where none of which was possible

Consular access was given under the rule of Geneva Convention but for your kind information there was no war in those days.? No sane person would have thought that the ICJ will direct the release of Mr.Yadav, as the person jailed for espionage in any sovereign nation on any evidence/or no evidence whatsoever, no court in the world can order his release. I think Pakistan erred in not granting Consular Access to him and India built it's case on that and got the access. Rest, Indians and Pakistanis would be fools to believe that their spy agencies don't do "stuff" in each other countries. Problem with India and Pakistan is their "holier than thou" attitude, fact is none of them is clean.

Dear friend Please do not tell lies to your viewers. You are cherry picking the judgement that clearly goes in favour of India. A man of your stature should not stand there and lie blatantly. How India twists and turns the facts? Indian media and politicians in their ever denial mood are busy celebrating and calling the International Court of Justice’s decision as a huge victory for India. Here are some facts: The International Court of Justice (ICJ) on 17. July 2019 asked Pakistan not to execute Kulbushan Jadhav now and reconsider the sentence awarded to him by a military court. The world court also directed Pakistan to grant consular access to Jadhav, while holding that it had "breached" the Vienna Convention in this regard by denying him this right. What India is not telling the world is that; 1. Kulbhushan Jadhav is not found innocent as India had claimed 2. Pakistan is not asked to acquit, release and return Kulbhushan Jadhav as India has asked. He would remain in Pakistan. 3. Indian claim that Jadhav was innocent and that "he was kidnapped from Iran, where he was residing and carrying on business after retiring from the Indian Navy was dismissed by the court. 4. Pakistan’s charge that Kulbhushan Jadhav’s passport issued by India as a businessman was a false identity and he was a spy, was upheld 5. ICJ has only asked Pakistan to review its order of death sentence, which was already in a process in the country So where is the Indian victory? It seems that India is employing the same tactic as it did when Pakistan shot down an Indian fighter jet on 27 Feb 2109, captured its pilot and returned him safe and sound, India declared it as victory? @@soni10001 All judges have the right to differ. Pakistani judge differed on the issue of spies getting the privileges under Vienna Convention. He did not challenge the whole verdict because there was no need.

When pak capture kulboshan yadav initially isi don't know that he is raw agent but when he accept himself that he is surving naval officer after that isi investigate further. But I want to know the reason that why india is saying that icj decision is their victory? 1.Because he will remain in pak custody according to icj 2.pak will reveiw the death sentence if they want to change than its on Pakistan not india or icj. 3.law of review the death sentence already exists in pak laws . 4.icj Don't change the verdict of millitary court 5.pak will decide when to hang kulboshan yadav. Main victory for India is the counsellor access.

kindly explain: 1- if his name was Kulbhushan Jadav (which the Indian Govt admits), how come he was travelling on a valid indian passport under the cover of a muslim name Husain Mubarik Patel (which the indian govt also agrees). 2- If the passport is fake (which is not true) then how come he managed to enter and exit india 17 times without any of the agencies noticing. 3- If he was a retired officer (which he himself said he is still serving) then why india failed to produced any gazette which marks him as retired? Neither did they produce his pension records of anything like that. 4-If he was kidnapped from Iran, then why india didn't protested Iran as crime was committed on its soil? 5- If he was running his own company in chabahar, then why india failed to produce record of any single transaction of such business? any sale or purchase record or even any tax returns? 6- indian media claiming that grant of consular access is victory for India whereas the full verdict says that according to geneva convention spies also have right to consular access so it has been established that he was indeed a spy. 7- India still has to answer to whom it want the consular access to be granted. Kulbhushan or Husain Mubarik Patel? 8- ICJ has rejected Indian demands to over rule the military court's decision. 9- They have rejected Indian demands of his release. 10- They categorically rejected indian demand of his return. 11- They rejected india's plea for ending his death sentence (the matter is hanging only until his appeal is in the court, which happens all over the world that if the defendant appeals to a higher court, the sentence is put on hold till then). 12- ICJ has said to review the case within Pakistani law and under Pakistani courts which again means that the case shall run in Pakistani judicial system (which proves that ICJ trust's Pakistan's courts). 13- An indian doing business in Chabahar (only 100 km from Pakistani border) would be the last place on earth any indian would like to do business and that too under false identity. Its just like a Pakistani doing business under false name at Loc, or on the border of Nepal, Burma or Bangladesh. 14- 4 out of 5 of Indian demands rejected and still ur shitty media is claiming a victory without even reading the full verdict by highlighting the point of consular access and neglecting the other 4 point in which u lost the case. Honestly its time u guyz should see the bigger picture and stop being fooled again and again by anchors like Arnab Goswami, Amish Devgan, Anaja Om Kashap, Rubika, Sudheer Ch , Rahul Kanwal etc.

Indian Muslims voted overwhelmingly to form Pakistan. Not they are engaged in fulfilling Ghazwa-E-Hind and converting India into another Pakistan.

Chirag Patel 137. With regard to India’s contention that it is entitled to restitutio in integrum and its request to annul the decision of the military court and to restrain Pakistan from giving effect to the sentence or conviction, and its further request to direct Pakistan to take steps to annul the decision of the military court, to release Mr. Jadhav and to facilitate his safe passage to India, the Court reiterates that it is not the conviction and sentence of Mr. Jadhav which are to be regarded as a violation of Article 36 of the Vienna Convention. The Court also recalls that “[i]t is not to be presumed . . . that partial or total annulment of conviction or sentence provides the necessary and sole remedy” in cases of violations of Article 36 of the Vienna Convention (ibid., p. 60, para. 123). Thus, the Court finds that these submissions made by India cannot be upheld.

@@FK-xq1ow ICJ is not an appellate body and thus, it is not in the jurisdiction of ICJ to overturn any judgement. The primary matter of the case was about the 'Consular access'. Everyone in India knew that we were fighting for the right of consular access which was violated as per the Vienna Convention. The ruling of the ICJ cleared that Pakistan indeed breached the norms of Vienna Convention and thus it should not only provide a consular access but also re-examine it's case proceedings.

ICJ was like, we cannot be that blunt with India due to their useless hardwork and expensive investment for a case they even know is based on lies and diplomatic upper hand...lets be a bit courteous and use less straight forward wordings so that they feel less of a pain falling down.. What they just did is that they downed India to life imprisonment instead of giving death...which India is celebrating :D Instead they are requesting Pakistan to please review the death penatly leaving the choice upon us... Colonel Habib was kidnapped from Nepal. If India produces him, they will have a lot of explaining to do as Habibs disappearance has already been bought up with Nepal by Pakistan.

@@kmzeshan which was expected since the ICJ is not an appellate body. In other words, the ICJ cannot overturn any judgement and province Kulbhushan innocent/guilty is under its jurisdiction. India took the case in the court on the basis of if the Vienna Convention on Consular Access has been violated by Pakistan. The court thus ruled in the favour of India under its jurisdiction.

@@kmzeshan read the judgement yourself without watching your media. The court, by a vote of 15-1, has upheld the India's claim that Pakistan violated the Vienna Convention on Consular Access 1963 on several counts.

Commander jadhe has done good job for his country, inciting rebellion and terrorism and causing much death and destruction in the enemy state. He deserves much recognition from India for his services. He should be awarded medals and honours posthumously.

India took the case in the court on the basis of the violation of the Vienna Convention on Consular Access, which has been proven. ICJ is not an appellate body and thus it cannot overturn any decision, which is why it was never expected from the ICJ in India to prove Kulshubhan innocent.

Pakistan cannot afford such a thing at all. Even if ICJ case wasn't there I have a feeling g the death sentence was only a gimmick they would not actually donit because they do not have concrete evidence against khulbhushan to declare him a terrorist or even a spy...

It was a strategy to just double down on their claims that he is a spy. He won't be hanged but he will remain in their custody for the foreseeable future. Barring any breakthroughs through negotiations, Jadav is not returning home anytime soon

India had requested ICJ Court to: 1) Declare the military court's trial violated Vienna Convention, 2) Direct Pakistan to release Jadhav and allow safe passage to India, 3) Direct Pakistan to take steps to annul the decision of the military court, 4) Direct a trial under the ordinary law before civilian courts. 1... Accepted 2... Release & Safe Passage DENIED 3... Annual court decision DENIED 4... He already have two appeals available to him under Pakistani law to High Court & Supreme Court. Please tell me how is this an Indian win?

What a misleading analysis ( utter lies ) Here you go 137. With regard to India’s contention that it is entitled to restitutio in integrum and its request to annul the decision of the military court and to restrain Pakistan from giving effect to the sentence or conviction, and its further request to direct Pakistan to take steps to annul the decision of the military court, to release Mr. Jadhav and to facilitate his safe passage to India, the Court reiterates that it is not the conviction and sentence of Mr. Jadhav which are to be regarded as a violation of Article 36 of the Vienna Convention. The Court also recalls that “[i]t is not to be presumed . . . that partial or total annulment of conviction or sentence provides the necessary and sole remedy” in cases of violations of Article 36 of the Vienna Convention (ibid., p. 60, para. 123). Thus, the Court finds that these submissions made by India cannot be upheld. It means military court judgement stands. Since they don’t encourage capital punishment so they have asked to review the decision of it own choosing. He is only given consular access and will be hanged afterwards if pakistan courts rule that or life imprisonment. He is not coming back !

ICJ is not an appellate body and thus, it cannot overturn any decision. It was not even the jurisdiction of the ICJ to free Kulbhushan. India took the case in the court on the basis of the violation of the Vienna Convention on Consular Access by Pakistan, which has been enforced by the court.

He was charged in military court as Pakistan believed that he is a serving officer in IN. But, ICJ ruled it out now you have to give him a trial in a civil court unlike a opaque trial in military court. Nonetheless, Pakistan can't hang him.

ICJ has given the same right which already there.... btw Military courts were given parliamentary approval for execution of terrorists and spies for 4 years. It is over 3 months ago..... Secondly, ICJ said Jhadav passport in the name of mubarik patel is real one issued by Indian govt and actually he is kalbushan jhadav.... even in ur news channels he is been called by the name of jhadav.... ur media is making ur people fool......

i am writing it down some facts and u can deny it but with reasoning... I have copied it from somewhere ICJ's verdict on Kulbhushan Yadav's case: Release: Denied. Repatriation: Denied. Acquittal: Denied. Annulment of military court decision: Denied. Indian appeal against the decision: Denied.

Love to read all the comments about any story regarding Pak Vs India. I HV to give credit to you journalist how you twist the stories n make people believe them.i guess it's the power of social media..n I must say 1.2 billion Indians are very good at it from news channels to Bollywood sadly reality is different.. Suspension on his death sentence probably gonna benefit in the long run n international forum for both Pak n India but whose gonna benefit more time will tell, till then he's gonna be a guest in different country.
