Trump loses again: Effort to remove judge from NY trial fails as case reaches final stages

A New York appellate court rejected Donald Trump's bid to force the recusal of Judge Juan Merchan from his criminal case even as jury instructions are expected at any moment and closing arguments are just a few days away.     It’s also pretty easy Merchan hasn’t done anything wrong whatsoever other than being a judge, listening to the proceedings and overseeing them, and having to deal out opinion and punishment when Trump continues to cross the line like no other defendant in history. Those other two are bought and paid for by the conservative party yet rule on the Supreme Court bench consistently in favor of their buddies, and have never disclosed any of this. Huge difference.

    ​@@amyv8416the hard part isn't whether he made the payment, but whether it is a legitimate campaign expense and that calling it "legal expenses" is also OK. Politicians are expected to lie. Politicians are expected to try to prevent bad stories from being published. Buying the publishing rights to a story isn't new or illegal. Calling it legal expenses isn't too much of a stretch. The case hinges on Cohen's testimony about Trump's intent and methods. Also whether it is beyond some threshold for campaign interference. For reference, I would like to see Trump found guilty, but that's got a lot to do with me despising him. I don't think he has any chance of winning the election regardless of any of his indictments.

Mr. Katyal is unwavering in showing the American people that Lady Justice is blind to prejudice and that the law is fair and balanced.     The burden is on the prosecution to prove guilt, not on the defense to prove innocence. So saying that the prosecution has no case is actually all that is necessary. That’s just how the legal system works.

    @@chadd990 Actually, if the defendant believed that from the beginning that his attorney would have made a motion to dismiss charges due to the state not meeting burden of proof, simply declaring ”no case against my client” after the state has concluded their case is NO defence. Perhaps fishing for grounds for a mistrial due to incompetence of defence attorneys?

Other times you have to wait for the prosecution to lay out their case in trial, and then make the claim that they have no case. Thats the whole point of a trial.

    you know he is not actually going to be convicted right? The key witness for the prosecution is a man who has made a career out of lying and has a vendetta against Mr Trump. Also, MSNBC conveniently never mentioned the testimony of My Trump's accountant. She actually testified that she put the expense in the system as "legal fees" because she thought that was the best category for it and she was not advised by Trump to do it.

    Yes, every defendant has that benefit. Anyone who can afford it (the appeal itself is cheap, it's the lawyers that are expensive) can appeal certain things during trial. Denial of a motion to recuse is one of those things. And he's not paying for it, not one penny. His Save America PAC pays the legal bills.

    you know he is not actually going to be convicted right? The key witness for the prosecution is a man who has made a career out of lying and has a vendetta against Mr Trump. Also, MSNBC conveniently never mentioned the testimony of My Trump's accountant. She actually testified that she put the expense in the system as "legal fees" because she thought that was the best category for it and she was not advised by Trump to do it.

    @@user-Balthazar669It's unlikely he would get a suspended sentence for this. Remember, Cohen got 3 years for a lesser offence and Trump was clearly the instigator. I reckon it will be at least one year in prison. IF Trump is found guilty, the Judge may well sentence him to prison and then Trump would inevitably file an appeal. However, with regard to the question of whether Trump will be taken into custody following a guilty verdict and custodial sentence: The court does have the discretion to keep him in custody pending appeal IF there is a risk he will intimidate witnesses! With Trump's history of not complying with orders and witness intimidation, there is a real possibility that he will have to lodge his appeal from prison.

He has been charged with a financial crime but there is no individual or entity listed that suffered financially from his actions.     The AG is not supposed to intervene with the special counsel. That is the whole purpose of appointing à special counsel or independent counsel, to avoid conflict of interest. Unless you want to give more ammunition to trump and his supporters, it is much wiser for garland not to intervene.

    In England and Wales we allow ‘majority’ verdicts. A jury can return a guilty verdict either 10-2 or 11-1. This law was introduced specifically to counter the recalcitrant and irrational juror who refuses to convict on clear and overwhelming evidence. The only exception to this law are murder trials where there must be a unanimous verdict of all twelve jurors. America would benefit from such a reform.

    @@mr.satanserv6067 jurors in England are called back into court after two hours and ten minutes to be then given the ‘majority direction’ by the judge. In cases which have taken weeks a jury will often be left for a day or so before such a direction, but in short cases it is after two hours and ten minutes and the judge then tells the jury “I can now accept a verdict of at least ten of you, either to acquit or convict.” When a jury returns they are asked if the decision is unanimous or by a majority. The jury foreman then answers that question. If the jury acquits the majority is not revealed, it is an acquittal. If the jury convicts the jury are then asked how many convict and how many are either undecided or acquit. The defendant then hears whether it is 10-2 or 11-1. The system works extremely well and largely removes the problem of the rogue juror.

    It's a bit like the side headings in a contract. They are for reference but do not form part of the contract. So you can reference the case however you like and that doesn't change the charges listed in the indictment.
