There are so many reversible decisions and irregularities in the case, a conviction won’t stand. The jurors and TDS audience members were visibly moved by Cohen’s duplicity, that the best move is to stop the trial and ask for a directed verdict or allow a jury verdict. If he wins, he wins. If he doesn’t, he’ll win the appeal.

On the day he's acquitted, I would not leave the courthouse with out filling law suits for wrongful prosecution and go after disbarment and financial compensation against state of NY. Lawfare goes both ways.

It sounds like the case is so weak, putting Trump on the stand can only cause problems on the cross-examination with very little upside. The question isn't if Trump is guilty. The question is why such a ridiculous case was ever allowed to get as far as it did.

@@cpamfly6858 1) This case was already dismissed several times before the election year, by Federal prosecutors and by Bragg himself. Why did it suddenly become a crime during an election year? I think you know the answer, if you would be honest. 2) Interesting that you are introducing "adultery, cheating on your mistress, wearing diapers" into the equation. Though these might be issues in an election, it is of zero legal relativity to this case. Yet they featured prominently in Stormy Daniels' testimony, over the objection of the defense. And you yourself mention it as if it's a thing. What does that tell you about the case? 3) And btw: yes, my opinion is based on listening to right-wing commentators (and some from the left) is that he is innocent and the case is frivolous. That being said, it was meant as a layman's legal analysis as to what strategy defense should take. Of course, it is up to the jury. But even then, there is a possibility that, even after the key witness has been completely decimated and discredited, they might decide, like you do, that he is guilty anyway, it will likely get thrown out on appeal. (Not my opinion. It was the opinion of a legal expert - don't remember if it was Bill Barr or Alan Dershowitz, but neither one counts themselves as a friend of Trump.)

The whole point is that 175.10 is about falsifying records "when his intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof." The crime "being concealed" is not mentioned in any court document or testimony. To be guilty of "First Degree" under 175.10 there has to be "an intent to commit another crime". So what was the crime?

It SHOULD be. The Judge shouldn't even send it to the jury, it's a completely dead case since there has been NO proof, ZERO connection of Trump, to the so-called false record. It should be an utter dismissal at this point due to prosecutorial misconduct and utter failure to bring any actual evidence of the alleged crime.

"A reasonable jury..." Big ask. In a normal situation, this WOULD be a directed verdict. In this case, it WILL NOT BE. I'm not willing to accept that the entire jury is "reasonable" but I would be pretty confident in saying at least one would be. I predict...hung jury. Mistrial, and the END of this case. There would be no point in re-trying such a flawed case. Trump absolutely SHOULD NOT testify Bob Costello SHOULD NOT be called as a witness. Trump doesn't need any surprises on cross examination like Bragg got from his "star witness". Finish the cross examination of Cohen, make a motion for a directed verdict and go from there. The judge, even if he denies a directed verdict, MAY allow the defense more latitude on their witnesses.

True, because think of the "rush" for "getting" Trump. Even if they are fair, certainly their friends aren't so there is the social effect, they know their family and friends would ROAST them if they didn't do their duty to jail him and save the country (sarcasm). Every legal expert knows that you don’t have to testify as a defendant UNLESS you are absolutely losing the case. In other words if you are winning the case no need, it’s only used a form of last itch effort of desperation. The evidence has to be so overwhelming like video evidence or something extreme like that but in this case they have zero evidence, there’s no need to do it it would be self sabotage or really bad counsel by his attorney to allow that at this point with this case.
