Does Domain ownership serve as "Date of First Use" for filing a trademark , which someone has filed just 4 months ago. I have a domain name and I used the name to do some amount of business for last 3 years . Now Yesterday I found that someone has filed a trademark application for the same name in the same class 4 months back. Now I don't have invoices and all published for this name but I have a paypal business account with the same business name and a small website built 1.5 yrs ago. Now can i file a trademark in the same name with Date of First use with my domain ownership .Does that work ?

Trademark must be : Device Heading Brand Label Ticket Signature Word Letter Name Numberal Packaging Combination of colours Or combination of any of above
