Dave discusses the Denham Language being shoved into Transportation Bills.
If this 'Denham Language' does find it's way into a Transportation bill regarding truck driver pay, drivers will never be paid fairly.... it will mean no hourly pay for waiting time, or extra work and never for resets.
Truck Companies in the Southern U.S. states are being dragged to court over unpaid wages for truckers, and loosing the battle, to the tune of hundreds of millions of dollars.

    If a trucking company wants to tell you that you can't leave your truck at a truck stop and have to stay with it when you're on your reset or done driving for the day then they should have to pay you for every hour you stay with the truck period. If not then it's not your problem. You shouldn't have to be an unpaid security gaurd working 24 hours a day. lol

    ive been a CDL driver for almost 13 years now. its unbelievable what the trucking industry gets away with..my #1 golden rule..if your not getting paid by the hour..your getting screwed somewhere. ..Love your channel. keep up the good fight..

    william cantrell you are rite about trucking companies under paying drivers. But I also put the blame on douche bag youtube drivers who love to brag about about earning potentials in otr trucking (which are only advertisements legally, not an offer for compensation).

    One thing for me is that I paid my driver per mile/Detention time/Layover/percentage on gross per load, this all helps for the 34 hour restart rule. At times my driver made on an average of .75/mile per load. I found that my driver made more than me, but this is what keeps good drivers. LOL. :)

    The problem is people (and companies) expect stuff/freight moved for almost nothing. Now I've had my CDLs for many years. I occasionally do side work. I own a small carrier(we run 6 trucks 5 on the road all times and 1 spare truck). We specialize in Agriculture related freight.anything from farm equipment to grain. So this lady called asked if I had any drivers available. I said "yes" She wanted them to haul anhydrous (which automatically requires haz-mat) they provide the semi and trailer FOR 10 BUCKS AN HOUR. I said "you are kidding right?" she said "dead serious." I hung up. Now the second problem is (if you stop at the local TA/petro or any truck stop) 1/2 the drivers are foreign. and I have nothing against foreign people but 1. speak English and 2. they'll run the loads at stupid cheap because compared to money back home 10 bucks an hour they think they are making good money.

    CASE link is wright so much bs even with couple trucks in company all can't stand together to get paid for waiting just kissing dispatcher ass to get better load it will never change, lack of education and such makes those drivers unwilling to make any change, sadly but its true

    my father is a captain for Delta, he only gets paid for time in the jet wheels up, not sitting on the field, or on layovers. So yeah, pilots also get screwed

    Here in Europe transportation made with vehicles over 3,5 Tones is highly regulated. First it is illegal to pay the drivers by the miles (km) they are making, the max continous driving period is 4,5 hours after that u need a minimum of 45 minutes rest to be able to continue with another 4,5 hours drive. Maximum of driving hours in a day are 9 hours wich can be extended to 10 hours a day for a maximum of 2 times in a week. Every other activity a driver makes in a day is registered separately (pre trip check, loading, unloading, fueling, the time that u are at the disposal of the owner just waiting for a load). In a 24 hours circle u must have a daily rest of 11 hours for a minimum of 2 days in a week, the rest u can reduce to 9 hours... the weekly reset is 45 hours normal and minimum 24 hours every week and many other things. Also here u have a minimum hourly payed salary to wich there are add-ons like a daily allowance if u make a trip longer than 50km outside your residence, or if u sleep in the cabin (tax free), every extra hours u make over the 8 hour work day is payed more...same for night shifts. All of these are highly enforced and braking these regulations can lead to massive fines and even jail time for the owners or even the drivers. This creates a healthy competition on the market together with strong unions and forces companies to increase their profits by expanding the business (buy more and newer trucks, hire more drivers to be able to move more freight) instead of stealing from drivers, forcing them to work insane ammounts of hours increasing the risk of accidents and so on.

    Oh we are. But we're up against a rock and a bull whip. You say or make a stand about it, they will call the cops and have them assist you empty you sleeper and another driver will come and drive your truck away without even leaving you a bus ticket.

    Trucking is the only industry where the labor force can’t unionize... but the company owners can. The ATA is a union for corporations. How is this even legal?

    Nurses in US have unpaid meal break built in despite inadequate staffing on a good day. Bad day is 55 patients for a forced 20 hr shift. Is legal!

    I agree with you 100% Dave. The first time I heard about the Denham language bill , I quick fast and in a hurry was on the phone with my congressman. I urge all drivers , current and past, to get in touch with their congressman. Take care driver and be safe.

    I got so damn tired of donating my time for free!!! I hear ya Dave. Now I get paid by the hour. That reset should be paid for damn sure. Either that, or get me back to the house. Truckers today are treated like second hand citizens to start with. Not a job in the world, outside of Trucking, is regulated down to 15 minute increments.

    Correction to you sir: Airline pilots get paid for flight time - BUT their salary more than makes up for the unpaid portion. That's airline pilots, with seniority, in the captain's seat. That doesn't count all those guys making low wages, or flying regional routes....those guys feel like truckers. Truck drivers by career are very similar to pilots! By similarity, flight attendants don't get paid that well early in their careers either. They get paid from when that airplane door closes. All that time spent greeting you and helping you load your luggage is UNPAID for them. So you're definitely not alone in your trucking industry!

    It's not just in trucking that you have this blatant corporate greed. A lot of middle class workers are struggling out there right now. The cost of living just keeps getting higher while decent paying jobs are almost nonexistent. I've worked in the telecom industry for 17 years and make less then 3 dollars more an hour now then what was top pay when I started back in 2000. That's about a 10% increase in 17 years while inflation equates to about 38% in the same time period. While management makes mid six figures to over 11 million for the CEO! These guy's are making money hand over fist on the broken back's of their middle and lower class workers. Don't get me wrong, I am not saying I deserve what these guy's make at all. It's just the distance between us is growing ever far apart. Sorry for the rant! I agree with you, what's fair is fair. They should pay truckers all of the time while out on the road working for them. Period

    Yes, I read somewhere recently that 6% of the workforce makes 90% of the money and what you're saying mirrors that. It's hugely disproportionate these days and wages haven't come close to keeping up with the cost of living. That's why I encourage drivers not to accept free waiting time or low mileage rates. No CEO is worth 11 million a year and it's time the money started trickling down, even if drivers have to force their hand and quit driving. Dave

    Jesus Martir indeed! i hear some folks claiming that only cheaters oppose eld. cheating who? the government that regulates your ability to make more money? truvkers are refusing to stsnd together against issues thst decrease driver pay. this would never happen before deregulation under reagan because back then, drivers were consideted profesdion drivers who sthck together. today...drivers sre nof considered professional drivers by the phblic. why? it's because of attitudes of the new age driver who won't stand up for their rights, and accept cheap frieght.

    When you add up all the time of uncompensated service, it absolutely *kills* your average hourly wage. What do I mean? First, we need to convert miles into time. So, take any given work-day, and figure out what you earned. Divide that by total on-duty time. Or, take any pay period, and do the same thing. Let's call that your "advertised payrate". Now - go back to your logs and add up all uncompensated time in which you performed service, as noted in Dave's comments. Take your total uncompensated time and add it to your total paid time. Divide your pay by total time. This is your "effective payrate". Unless you get paid for all time and expenses, your effective pay rate will always be much lower. Here's a scenario: You look in your pay stubs and logs, and pick out a week where you had to do a reset away from home. Example A, "advertised pay": 5 days, $200/day, and 10 comp hrs per day (5 × 200) ÷ (5 × 10) = $20/hr. Example B 5 12-hour days, $200/day, plus a reset. (5×200) ÷ (5 × 12 + 34) = $10.64/hr The current minimum wage in the US is $7.25/hr. An experienced over the road driver makes only $3/hr more than a kid starting out at McDonald's. This is why nearly any OTR job is a rip-off. It also illustrates the detrimental effect cheap freight rates have on carriers and O/O's alike.

    You're absolutely right about that. I've been there, done that with the whole "figuring my wage with ACTUAL hours worked" and it was disheartening at best. But you'll always have those morons that say "Oh yea buddy!? Is that McDonald's worker making 1000 a week!?" No, he's not. But he's also not working 70+ hours a week, only able to shower every other day if lucky, eating shitty food, sleeping in a filthy truck stop, being forced to run when tired etc becasue if he doesn't he'll get shit loads etc, and actually has a life. On paper, at the end of the week, that driver will make more, but at what cost? For all he has to invest time and labor wise, not to mention the utter lack of a social & family life, is it really WORTH it? When you factor everything in, I think the driver tends to be on the losing side, and I'm a driver myself. Cliche "rollin on the open road, cd rambo, with a woman in every city" bullshit act aside that most gloat about, I don't see being a truck driver as some sort of honorable profession anymore. It's lost all of what it WAS at one point in time. The industry itself is completely slanted against the driver these days. Now we have ELD's, automatic trucks etc, before too long there will be zero skill involved, ANYONE could do it ! Yippee!!!! It's a joke now.

    You are right. After I realized what was going on I decided to start bucking the system. I started in 1999 and it took me 2 yrs to realize how bad I was getting the shaft and then in 2010 here came the csa and the 34 restart. I simply will Not work on a recap and will Not do a restart on the road.Now I work for a small company with paper logs and older trucks with a great boss that cares. I'm home everyday and every weekend, run dedicated for a customer pulling flatbed curtain. Driver's, get some experience and Keep Your Records Clean, these companies need You, you don't need Them and until we get this mindset this game won't change. Without the driver they can't get the loads hauled so make it clear to them before signing on that you will refuse any load that makes you restart on the road and you expect to get paid after setting more that 2 hrs to get loaded and unloaded.

    Here's another: trailer inspections at loves or ta - you're on duty, yet the company refuses to pay you the two hours you spent getting the trailer inspected.

    US TAX FORM 2106 gives you the tax break for being away from home everyday...it will account for hotel and food on a flat rate...I got $10,000 plus off the top of my taxes at 63.00/day...and I didn't claim but 164 days of the 254 I actually worked

    I like your videos! The only reason why I wanted to work long distance, was to get pay a maximum of 11 hours of driving per day, and at least 2500 miles per week in five days. I would end up with $1000, gross at $0.40/mile. But the truth is, if I am lucky, I worked 70 hours at $14/h. I would really like also, to be eligible for the overtime rate!

    Great video. Seeing "$10 per hour paid for your 34 hour resets" on a company's website would look good to me. Yes, you are still working during the 34 reset, because if that equipment gets damaged, you will be held responsible.

    Construction workers do unpaid hours. I do a 60 hour week but only get paid 40. That's construction management in the U.K

    If you look at IRS and the laws in which they apply, you will find that as an "employee" and being directed by the employer, AND being away from home while following this direction, you are right sir, you SHOULD be compensated! I just left the industry because it's all rigged from top to bottom

    I've done many resets on the Road FREE. Many Truckers do. I will fill out a note in the Company Comment box. The owner reads all of them I'm told. Maybe it will be brought up in a meeting.

If every trucker across the country go on strike I think things would change in a heartbeat the white collar business men who works in the front office of the ATA think they are smarter then the truckers but they are really out smarting themselves and loosing money behind it with the million dollar lawsuits.     Its getting worse across the board, not just trucking. I know of places that don't pay for travel time and have overtime gates e.g. if you work 50 hours you only get paid for 45 ("industry standard").

    When I apply the 3-R's sanity test, your argument passes all three - easily ! Yes it is Reasonable, Rational and Realistic to expect to paid for each and every hour you are on duty which includes resets/restarts ! Thank you!

    The ata doesn't work for drivers, they work for companies, like the lobbyist in Washington, they are never working for you. If somebody steals that load on your 34hour reset, how many trucking company's are going to let you keep your job as you were off duty. Unless you are home or some place you really want to be, you are on duty. Anytime you are responsible for that truck, you should be getting paid...

    I have been in the industry since 1991. Before the 70 hour rule I can not remember ever running out of hours on my extended tours OTR up to 8 weeks at a time. Yes we do not get paid for most of what we do like bumping docks, fueling and PTIs. Lately I have found myself on occasion sitting getting unloaded or drop n hook off duty. Even when I am supposed to be on a 10 hour break I am still working sometimes. Companies expect it especially when they say you can park on the customers property. Yes I am now using ELs and I prefer the old HOS rules.

    Can you imagine your family member taking a bus with a driver that has worked 70 to 80 plus hours a week behind the wheel in Chicago every day, straight pay over 40

    👍👍👍👍 i agree, otr needs to pay the time you clock in on the qualcomm. i hate that crap no pay to pretrip, post trip, fuel etc. i worked for 1 company that paid by the hour for otr and it was great.

    I saw something on pilots getting screwed over too. Often, they are only considered "working" is when they are flying. It's not just pilots but the entire air crew. Pilots are truckers in the sky. Nobody should get screwed over.

    Absolutely terrific video. You are so right. We are the only professionals that give away our time for nothing. I run the Mid West, Lease on with one of the companies you mentioned. I make pretty darn good $$ but I get so disgusted with the hours upon hours that I spend, whether it be loading/ unloading, getting a trailer washout or any of the many things we as drivers are required to do to get the job done right. I take pride in my work and equipment and deliver my freight ON TIME. If we could get compensated for every minute we are under the gun, doing the many tasks that are required, I guarantee that the carriers, shippers & recievers would make sure that we were turning our tires more, instead of wasting ungodly hours backed into a dock or parked in a bullpen. There wouldn't be a need to sweat our 70hr clock because we would be spending our time much more efficiently. More money, more home time & less time feeling like an incarcerated animal sitting & waiting in our tiny living quarters. I know im long winded here, but this is a subject that really touches a nerve with me. For example, just this last Saturday, I spent over 12 hours getting unloaded. 2 weeks ago, I was dispatched late on a load, and because I showed up late, no fault of my own, I sat backed into a dock for 23hrs to get loaded. I was only compensated $75 for my time because I showed up late, although, I was dispatched for a 8am appointment at 9:08am and was over an hour away from the shipper... Absolutely Ridiculous.     A way to fix this, once the clock starts, a driver should get paid their rate per mile. on top of that, pre & post trips, trailer washouts, fueling and time spent loading/unloading & 34hr resets should be seperate from milage, added up and paid an hourly rate. This would create a much safer and efficient environment for us & other motorists & be much more lucrative to drivers. I guarantee we would no longer have to be subjected to these criminal hours spent working, like LONG HOURS spent at a dock. if we are subject to appointment times, the companies we pull for should be as well...PERIOD. Being paid for the time we spend at a dock would no question, eliminate the nonchalant attitude the majority of shippers and recievers have when it comes to our TIME. TIME IS THE MOST VALUABLE THING WE HAVE.. WE CANNOT PRODUCE MORE & CANNOT GET IT BACK.. Once its gone its gone. Something needs to change. If us as drivers, ALL took a week off and said, we are shutting this country down if our demands for FAIR COMPENSATION are not met, imagine how fast things would change, the leverage on our side would be astronomical. Just imagine if we could coordinate that.. Our careers would be forever improved.

    Most all airline floight personnel get paid ONLY for the time the pane leaves the get till it lands at the destination gate... All te flight planning, weather checking, cabin prep, etc is not paid... Doctors don't get paid for patient prep, case study, etc.. and there are occupations with unpaid time.. i.e. farmers... only get paid when they sell the crops... Truckers should get paid for all their time... but they're not the only ones who are not..

Thanks sir ... your rigth everytime my truck sat over 34 hours every major company i worked for started calling my phone and telling me they're coming to tow my truck and its a policy that there trucks cant sit for 48 hrs. Even when I ran a month Straight or they couldn't route me home and I had to sit OTR after they approve my hometime

    It takes balls to speak out on a public media platform as large as You Tube, but the truth of the matter, is that the points Dave make, are exactly what the majority of us are thinking, feeling, and tired of putting up with. I remember overhearing a conversation between a veteran trucker, and a foreign driver who hadn't been in the US very long. The veteran trucker was explaining to the guy, how the government and trucking industry would never allow him to make substantial above average money, by paying him for all his time. They need to keep us on the treadmill, not give us a chance to have any options in life. Most of the OTR drivers eventually give up and take local jobs, going back to living paycheck to paycheck, and throw in the towel on the dream they originally had. Jimmy Hoffa disappeared from the face of the earth, because he cost too many people, too much of the money they were stealing.

    Why do they have to take 'local jobs, going paycheck to paycheck' as you say? They just have to get trained and get a good paying trade, how hard is it to be a plumber and charge homeowners $90.00/ hour or more for your time. Or a tile setter, trim carpenter, drywall installer, etc.

    I only drive local and regional because no matter what, you end up working 14 hours a day. It comes down to a known truth to me and that is sleep is very important. OTR is a unnecessary working environment and this industry could have always been a series of relays and hourly pay. Amen to this post. I love this channel.

    what realky ticks me off is arriving at a delivery place according to the set appointment time, yet have to sit their for 6 hours until i get called to a door to back into. can't sleep because they will contact you by cb but won't accept your phone number to wake me up. "dispatch...don't ever send me here again." but thanks for bringing up the despicable ata.

    Hi Dave. I've been an auto repair technician with GM for 28 years. My paycheck is based on the flat rate system, which sucks!Anyone that works at a dealership will, more often than not, get paid, based on flat rate.There have been days that I have worked, and not made a dime!!! This is completely wrong, flat rate should be abolished!I'm seriously looking into getting a CDL, have already talked to a recruiter, and would like your advice.Thank you for any information.     Driver spent about 160 hours out on the road a week and only get paid for about 40 if they get paid for the miles that's below minimum wage

    When I was working for CRST. And our NEW truck was down for eight days (freightliner) it was for mirror motors and broken drivers seat and speed gov. My co driver and I where in Oklahoma City. The company Got us a decent Marriott hotel with a pool we stayed there for eight days. sitting on our asses eating junk food and swimming at the pool they had at hotel. and they paid us $60 every 24 hours. And that was CRST.

    The thing is that my job or any other job dealing with trucks will tell you you don't have to work here and you can go out the door and not come back and we'll fill your spot with more foreigners they're dying to have your job and work sheep and not say a word. And the trucking companies get away with it !!!!!

    You don’t get what you deserve. You get what you NEGOTIATE! Don’t be afraid to reason with someone who is taking advantage of you. Be respectful and see what happens. If they don’t work with you, look for a better situation.

    When I was a flight attendant I was paid for time away from home, weather stops, cleaning the plane, safety inspection, . In the past 4 months as a trucker I have worked more, sat waiting for a loads, because I refused to take trailers with bad break pads, swept trailers, waited for repairs on truck and not get paid for any of it.....what would happen of all CDL TRUCKERS went on a strike for at least 2 weeks ?

    They should pay u when u sit sunday without miles bc they have u a Friday load with 500 miles to deliver Monday. Not a 34 hour reset but when they don't get u enough miles for the weekend.
