You know I alway wondered the improbable. What if the jury says "not guilty" even when it's obvious the person IS guilty. Or they consider that the defendant is in their right regardless if they killed?
@theonetruefives9411
8 ай бұрын
That can actually happen, and has happened, and since the jury is the one to make the decision there isn't a way to punish the jury. There are ways that can cause the trial to be redone, for example a mistrial, but the jury is entirely capable of finding somebody guilty even if they aren't, or vice versa.
@petarhrvoic5135

Look up OJ Simpson's trial.
@nachohangover5104

Legally nothing dictates how the jury can vote. They can vote innocent or guilty for any reason. Just as a jury can and has voted guilty regardless of the evidence suggesting otherwise, juries can vote innocent even if the evidence leaves no room for doubt. This is called jury nullification. Unless there's a technicality to get the whole trial thrown out and/or redone the jury's vote is upheld. Note that if you are ever on a jury or called to be in a potential jury pool *never even remotely imply the existence of or talk about jury nullification.* You can go to jail for that.
@Meodread
7 ай бұрын
It's not a particularly uncommon occurrence. The jury will be asked to substantiate a verdict if it seems particularly egregious but yeah if the Jury says not guilty unanimously that's pretty much the end unless some additional jury tampering crime can be uncovered.
@MoffeeA453
6 ай бұрын
Judges can always set aside the verdict (and declare Not Guilty) however they are usually very cautious to do so because the Jury is one of the sacraments of our legal system. You would be subverting the will of the people in doing so. You will hardly ever see a Judge set aside a verdict and enter a GUILTY decision because there are constitutional protections that must be adhered to.

Honest good faith mistakes. I wonder if that defense has been used before in reality when officers do things they shouldn't and people end up killed... No need to answer. That was rhetorical.
@StriKe_jk

I'll answer anyway, yes, for example when they parked a police car on train tracks, forced a suspect inside and let her gettin driven over by a train, despite her shouting for help while it was approaching which they ignored. Together with her pleading not to be put on train tracks beforehand.

@Anderre_Belmont

Murdering a peace officer is one of nine capital felonies in America. Depending on the state and judge he could be sentenced to death for that. At the very least, life with no possibility of release. There are a few factors as well that could change the outcome, but none apply here.

Everyone believes that police offers have to be mistake free spoiler alert they aren't if you want to not get heckled/arrested by police no matter how unfair you find it, if you haven't done anything criminal then comply with no argument they'll leave you alone but if you're doing something criminal don't be surprised that an arrest is coming. Just don't commit crimes simple as that.
