A lawsuit has been filed against McCease LLC - the entity formed by Paul McBeth and Chicago White Sox pitcher Dylan Cease to purchase the Gran Canyon property where the Throw Down the Mountain tournament is held.     This dude Trevor is rightly gonna be hated by his local disc golf community. Which makes his decision even dumber to me considering he owns or is affiliated with a local shop. If my local shop owner caused my best course to potentially be closed over a selfish frivolous suit i would never spend another cent there. Hope the local community tells him how they feel about this.

    Pay/settle with Trevor for the 2 months of "life disabling-mental anguish-unable to perform regularly", Trevor was clearly at full capacity when winning a tournament and should either accept the litigation proposal and move on (or just quit?! even though he can play/win/file lawsuits/return to normal life.)

    Yup, this video explains it fairly well. There is a lot of case law that shows when you enter events like this you know the risk and it’s up to you to protect yourself. At least in ball golf these lawsuits usually get tossed out pretty quickly once the people enter the courtroom.

    Im from this area in FL and yes this kind of stuff just ruins DG for everyone. That's like joining the military, getting injuried on deployment then suing the Army, like what??? That's why no one takes Trevor serious, and these kind of actions will plague his brand for a long time coming.

    Throw Down the Mountain has the strictest waiver policy of any PDGA event I've attended. Due to the steep slopes and blind shots, everyone who enters the property, not just players, is stopped at a checkpoint, signs a waiver, and is given a wristband for the day or week.

    Hey guys, if you own a disc golf shop, probably shouldn’t maliciously sue one of the most loved players from our era. Especially when your case is a complete sham. If I had this guy and another store nearby, I would go to anywhere else to buy discs

    This guy/shop has a long history of questionable behavior. They are no strangers to shady situations. Most locals have avoided this shop for awhile. Hope his business suffers for this. Can't claim to be invested in disc golf and then sue when you get hit with a disc during a tournament. Bad look for sure.

    Yeah, so to maybe avoid this in the future, why not make a sort of pact that none of us ever use his store again under any circumstances. I mean, it would cause me mental harm if I had to give this douche money after him doing this. If he decides to retract the lawsuit, then maybe we go back to spending money there. Collective action is the only thing that will make him truly understand that actions have consequences. I've been hit by discs occasionally, usually some Am player who hasn't a clue but it has never entered my head to sue the course owners. McBeth has gotten his big payday because he's a great player and deserves the windfall 100%. This store owner guy... seems like he thinks he deserves a cut of Paul's money.

    @@sfincione2000Please do not go back to spending money there, even if he retracts the lawsuit. He has already shown his true character here, and in MANY other instances that people have mentioned. That’s not the type of person or business who deserves the community’s money or support. There are other local options much more deserving, such as PureLine in Pinellas, Saltwater Crew in Largo, or SunKing in New Port Richey.

    Looks like the he store is already deleting comments from their Facebook page. My guess is they are trying to hide the hate from the people that don’t know what one of the owners is doing. So proud of your money grab you have to hide.

    Rule #1 when suing people: choose someone with money. If this course was owned by someone who was financially on their last leg, this lawsuit wouldn't be happening. Grift, plain and simple.

    I lived in the Tampa Area for 7 years and visited his shop a few times for discs. One thing I know that he DOES do that I can confirm is that he will pay people to fish discs out of the local courses (find the story about the tampa disc golfer that got bit in the face by a gator in Clearwater and was back in the water a week later), and then charges the players to get the discs back from him. I know first hand that many of the people who get the discs from the water for him are druggies and just looking for the next way to get money and he provides that to them. As far as the largest disc golf shop, that is just straight up incorrect. I have visited several other shops and even the director of the TDTM tournament has more inventory than he does.

    That's straight up theft. Even if the players "abandon" the property (the disc) on the course, that's private property and by default abandoned items on private property belong to the property owner. If a local course could prove this was happening without their approval, they'd have an open and shut case against him and anyone involved in the criminal conspiracy to commit serial theft.

    ​@@Ballosopheraptormost of the courses they get are public park spaces. I live 15 minutes from there. There's certainly mixed feelings; however it's a unique situation. Going into water with gators here is not something your average player will ever risk. There was a death last year in Largo for someone retrieving discs, killed by a gator. All that to say, there is some extra value in retrieving discs here.

I would pay reasonable fee to get mine back (and even more gladly if it was some young frisbee golf player), but if someone tries to sell it back it might just fall over extortion / messing with lost property / theft. As I said, depending what the laws are.

    @@tankmlee any pad or basket could potentially be hit by someone with a big arm and bad throw on any course. This course in particular is really secluded on most pads but a few have potential. At the end of the day as on any course this is a possibility.

    i know a guy that was on the card with him when this happened. no one on card saw or heard what happened and then when he went to tee off said he was dizzy and he was gonna dnf. Then he tried to get his phone out and film cardmates talking about it and they refused because no one witnessed the incident.

    I’m trying to figure out when and where he could’ve gotten hit. Hole 11 is the big downhill signature hole with the course logo. Hole 12’s tee box is nowhere near that hole. When playing hole 12 you could end up on hole 11’s fairway at some point but that seems like a misplay by the player. Hole 13 could be reached with an insanely errant throw from hole 11 I suppose. I honestly can’t picture where he would’ve gotten hit based on this info.

    @@jakebourassa The pros play a completely different hole #12 than the Ams. There's a long walk from 11 basket to 12 tee on Am layout, the 12 tee nowhere near 11 basket. I suppose someone could have thrown a drive from 11, which has a tee elevate 50+ feet above fairway, and hit him as he was walking to 12 tee. That would just be a guess.

    I play that tournament every year, everybody that goes into that tournament knows the layout. There are risks that come with making the personal decision to play on that property. We all accept them when filling out our registration and the waiver. If he didn't want to take the risk he should never have played. Also there are plenty of capable, thoughtful staff and the tournament is run exceptionally well. It is a tournament in which flying discs are going in every direction. We all know that and know to be alert and cautious. These types of things happen and it is nobody's fault, this guy is obviously a shady fellow. Can we all please make sure that this guy's business fails and he is exposed for his corruption.

    I would say that if someone is injured through negligence by the course owner or even staff that is one thing, but to be injured through the standard course of play activity is a risk assumed by each competitor. A landmark or installation not being installed properly that falls and hurts someone would be on the course to insure safety but being hit by the disc of another competitor during the course of play is an assumed risk. It's why "fore" is yelled when an errant shots occurs.

    If a teepad is close to a basket and people tell the TD that there is a huge risk before the tournament but being told not to worry about it then I could see a case being made. I was watching the Des Moines challenge earlier and there was a case of blind spike hyzer shots coming in to hole 14 and landing in spots where 15 tees off from (Luckily nothing happened). I fail the see the negligence in this case though

    That is pretty much how the courts have traditionally viewed these kind of cases. Heck in a city near me that has lots of tourists and a popular ball golf course. Someone’s car was hit by a ball and they tried to sue the course because they didn’t have anything to prevent it. The judge ruled that since the people in the car knew the course was there and I think they even played at the course, they knew the risk. Case was tossed.

    They always have a "right" to sue, but the case doesn't seem to have merit. I am sure he is hoping that Mccease will settle out of court. But if I have a lawyer that I can pay... I would counter sue for defamation and take this to trial.... There is not much of a case here.

    Defamation suit can prove losses due to event movement from course. Any profit to other clubs could be measured as a result. Not to mention projected revenue from entry fees for practice if that is a thing...

    I’m sure between McBeth and Cease they have good enough lawyers to not worry about settling. Wouldn’t be to surprised if they did go after Trevor for a frivolous suit and damage to their reputation.

    I'm not sure what his injury was, but several of his claims seem a bit outlandish. I think Doc Holiday said it best... "There is no normal life, Wyatt... there's just life. Now get on with it."

    When the judge on this case sees all of these injury, mental anguish and loss of earnings claims by this Trevor guy and then learns he played 2 tournaments two months later and winning one of them, he'll laugh this case right out of the court house.

    Local route will no longer be my local store. Disappointing because they have a such a large selection from almost every manufacturer. But if their values aren’t as good as the selection it just isn’t worth it. Smh. I hope McCease buys Local route to show them who’s boss here.

The owner of the company Trevor is notorious for ripping people off in the disc golf community. He stole 58,000 worth of discs from Clash Discs and refused to pay his bill for 5,800 products sent to the store location. This business owner and Mason Bailey sold these discs at wholesale and retail and kept the money for theirselves. Local Route also directly ripped me off of a sponsorship deal still owes me over $2,500. Trevor the owner also stole discs from Kastaplast and refused to pay his bill with this company as well for over $30,000. These are known facts not accusations. The owner of this business is truly a thief and I wouldn’t support anything he’s involved in ever again. The truth needs to be known to the disc golf world. Trevor Toenjes is a thief and a liar, He’s currently getting sued by multiple companies right now for stealing products without paying his dept then using that stolen money to reinvest in other products."

    As a Clearwater local, and previous customer this situation sucks. Sadly never got to play the throw down the mountain and now the future of the course is in jeopardy. Also, my returns typically show up at his shop so that blows. It's a hit I'll have to take rather than supporting them. Hope Paul and Cease rebound strong and battle forward with their plans to maintain the course and property. Good luck all.

    I’ve dealt with these types of lawsuits working on the outdoor industry. Waivers and assumption of risk take a backseat to insurance needs. Then the courts have to determine if there was any form of negligence of the part of those being sued. Usually there isn’t anything and the court rules in favor of the defendant. Sometimes they find something…and that’s where it gets scary for course owners/managers and tournament directors. I think there are lots of courses that are poorly designed (I’m not saying Gran Canyon is one. I’ve never been there). And the poor design makes it way to easy for errant shots to cause damage (to person or property). And at a government/management level it’s better to just take the course and the risk out then to deal with the potential lawsuits. If you have those courses on your local areas where it’s highly likely an errant shot could hit someone or something…start looking at a redesign.

    This person was as familiar with this course as anyone and chose to return this year to play the event again knowing the risks. If he felt the course wasn’t being maintained, etc as he stated in his lawsuit, he didn’t have to remain on the property and continue to participate.

    That’s why the PDGA and most other organizations have insurance. But if it’s a money grab you can’t go the insurance route they will only pay for medical and actual expenses. If you are just a jack-wagon looking for money then lawsuit is the way to go. But I highly doubt McCease LLC has lawyers that will want to settle since there is so much caselaw in their favor.

    Thank you for the information. I hope the "injured" gentleman will rethink his lawsuit, and drop it, since it seems a bit frivolous and petty. Getting hurt is no fun, but, it is obvious there is no permanent "damage," since he played and won not long after his injury. I think people are seeing the big money out there in disc golf now, and this may drive some people to try and profit from that. I am sure it will all work out in the end, though. Keep up the good work.

    His lawyer is the guy throwing in all the standard language to make it sound as though his client was so grievously damaged that he had to have a brain transplant and woke up not knowing who he was. They're both looking for the deep pockets payout. Can't believe anyone is talking to either of them, no less patronising that disc store.

    Im playing in this tournament in a few weeks and was super disappointed to hear that it’s be moved to the Quarry instead of the Throw Down course. Never played there before and was really looking forward to it. Dude making the lawsuit is a certified jabroni.

    Good, clear explanation of the basis for the pleading. The question is always the motivation. Could be that simple motive of personal entitlement-“Ow, I got hurt! Pay me” Given some of the factual difficulties in proving damages that you described, that motive seems pretty shaky. Who benefits from shutting the course down?

    Thanks for the update, enjoyed it, as usual. Can't understand why tournament cancelled for 2023 ? Lawsuits occur commercially all the time and businesses do not shut down during their pendency. Sometimes they change some operational procedures. Insurance issue ? McBeth shuts it down himself ? Another commenter on another channel suggested this possibility as a way for McCease to draw attention to the situation and create public awareness about what was going on. Makes some sense as well. Developer "involved" with Trevor ?

    Couple things. You have to sign a waiver just to be on the property. They jand iut wrist bands to show proof of signature. Also, Trevor runs a disc golf in the ball park last i knew at the Phillies training center. Wonder how the Phillies feel about Trevors litigation.

    Waivers can sometimes not matter at all. I ran an amusement restaurant for over a decade. Signing a waiver at these places, trampoline park, play area etc is basically just for show. If someone is negligent (not saying they were in this case) it doesn't matter if a waiver was signed. Insurance usually takes care of these things and that usually means settling and paying, which will make the premium skyrocket. I've paid millions extra in insurance because a lady went down a twisty slide with her shoes on and broke her ankle.

    One would think it common sense that when you enter a disc golf tournament, there will be participants of different skill levels throwing discs during the tournament. Even well-thrown discs are often (t)re-directed to an unintended flight path. There's probably more to the story, but I can't see the plaintiff being able to meet the burden of proof in this case.

    i literally played the ma40 event a few weeks before this happened , yes we sign a waiver , we even sign one for practice rounds. the course is beautiful and you definitely assume the risks even playing there let alone the terrain between holes. people are throwing off of cliffs some of which are 75 ft high....yea it is possible someone threw an errant throw and were probably yelling fore the whole time. accidental yes....negligent on the tournament itself ? absolutely NO. im proud of all the loal volunteers that give up their day to come help out to the best of their ability.

    If the player was injured and truly incurred costs, that is sad to hear. But, he should seek repayment from the PDGA insurance policy. There is implicit risk when you play on a disc golf course, or a ball golf course, or when you play any athletic sport. I would love to know about legal precedence in similar ball golf scenarios. It is unjust to view this as negligence, especially for the owners of the recently-acquired property, who did not design the course, in my opinion. Also has the tournament operated successfully without injury previously?

    If tournament directors in the future are going to possibly face lawsuits for things that happen on the course. I can see less and less of us wanting to be tournament directors. It's not worth the risk. Nor can any of us that our tournament directors afford to be hit with a lawsuit for something that was out of our control.

    I have bought many discs at Local Route. It is a nice store. Paul did an appearance there a few months ago in the store. Bizzare. Trevor signed a waiver. He has no case. Suicide for his store. Sad.

    Is McCease even the right party to sue? Why not sue the event organizer/TD and his assistent? Does not kake sense for me. And why has that a affect if the course can be played or not? This is an organization issue and not that the property is a hazard itself? Did he also sue the person how threw the disc that hit him for not warning him?

    Because McCease is where the money is at. They let Mike Barnett do his thing for this past year and design the course like always has and once Dylan and Paul could get together in the off-season they were going to put in their own permanent design. I think a big part of this is Trevor feels like he should be a part of it and if he can't have nice things then no one can.

    Why no mention of how this lawsuit affects the ability to carry out disc golf play or events at Grand Canyon? Just because there is a lawsuit against a property owner, it does not mean activities cannot occur on said property unless there is an injunction. There has been no mention of any court orders or injunctions against disc golf being played on the property.

    I'm guessing that if they "fix" or change anything, they could be seen as admitting guilt. If they go on as usual and "something" else happens, that could be used against them also. I'm not a lawyer, but I stayed at a Holiday Inn Express.....a couple years ago.

    I doubt anything will come of this unless realty developers are backing big money lawyers in order to stop it from becoming a course. Even then it seems like they are reaching to make a case. The only thing I can think of is if the hole being thrown at was way too close to the tee where this dude was, and they (basket and tee) were wide open with no barrier trees. Even then, a substantially errant throw (that it likely would have been) should not make the course owners liable, as pointed out, because there is an inherent risk in being on a disc golf course. This kind of thing (errant shots) happens on ball golf courses all the time, as well as many other sports.
