My question is if you get married and pay magadi but do not sign any document in court or church , and you separate in a few months after magadi in the year 1996 dose that mean you are married?whay happens when you have separated for so many years and have moved on when you die can the husband come and claim that he is the husband and want to claim properties?

Hello Advocate. What sbout a situation where lobola negotiations are conducted and part of the lobola paid and both families agree to arrange a future date to complete lobola and do some cultural 'celebrations'. But before the second meeting the woman ends the relationship and her family refunds the lobola? The woman claims she was forced and never wanted the marriage. Can that be considered a customery marriage?

A civil marriage is not a Christian Marriage

If a lobola was paid by A's family to B's family, however it was not completed then a separation took place due to reasons between A and B then is the customary marriage valid or invalid. I believe that when the family of A have completely paid the lobola to the family of B then that is marriage however if the lobola is not completed then we cannot call that a marriage.
