Here is what I believe is going on here : I think it's actually someone within the Fntastic univers that owns The Day Before name and they only use this as an escapegoat for delaying the game so that they can run this scam for longer.

@@danielraymond9631 The original trailer was made in 2021 Jan while the trademark was applied in 2021 June. If you do have the intention to release the game under that name, why would you not apply for it prior? Also, if you seen the original trailer, the original has better inventory system than the current gameplay trailer, why would upgrading UE4 to UE5 change how inventory looks and works? Even the animations look different.

@@danielraymond9631 It is a scam, not towards the players but towards the investors. It is a attempt to scam upfront investments to actually get started on developing the game. In other words, the announcement trailer is just a demo, there isn't even a game prior that.

This is about the most legit thing I've heard when it comes to this game. Doubt it'll come out this year if at all

Even if the game does release, after seeing all the BS Fntastic is trying to pull I wouldn’t give them a single dime. As far as I’m concerned this game is dead to me, even if its somehow good(which I doubt it would be). I really don’t understand their end game here. At this point I wouldn’t download the game if it was free.

I have said this before, but it is very odd to say that they would have everything resolved by November before they go to court or even consult a legal team. Trademark cases like this can take many months to even years to resolve. Legal cases take a very, very long time to resolve. This on top of Fntastic's attempts to deflect criticism as well as them pushing other games and a meeting app instead of this game which they were supposed to be marketing for puts them in a very bad light. They have used every excuse in the book to delay and game again and again. Even this delay, which they said was because of the trademark dispute was planned beforehand and who the hell doesn't trademark their games before making the game publicly known? This is standard operational procedures and they did not do it. Their excuses don't fly here. I do not expect this "game" to ever release. At best what they have is a tech demo that they tried to make people believe is an actual game.

They could just change their name. They are using this as an excuse to delay their "game" because there is no game. The movie "28 Days Later" was going to be "28 Days" but that was already taken, so they simply changed their name. Some games have been known to change their names after finding out the one they wanted was taken. It shouldn't hold up production so completely (unless again there was no product).

yeah cause "the day before" was such an original catchy name that just rolls of the tongue so well, there definitely aren't any other zombie themed video games with similar sounding titles at all, totally worth the legal battle lmao

Since this game is not real, SCUM is a great game to fill the time with. Worth a look for those wanting a modern survival game that isn't outdated like DayZ.

I studied law although I am not a lawyer I can break some it down. I studied law to help me understand the justice system during my time in law enforcement. The court documents make it common practice to produce many pages for any court case not just this particular one. If you happen to look at some of the pages you will see how they recite laws formed by past legal processes. Basically they are trying to relate how the current case relates to the law that was formed form a previous court case. ***The next part showed a bunch of date’s going into 2024. When large businesses find themselves in legal battles the US justice system automatically schedule what is basically placeholders that allows both parties to fully utilize their legal rights. Just an example…..After the scheduled legal dates later this year occur either party may say I am done and call it quits or they legal system favors either party which then presents possible change in the outcome as it continues into 2024. This is going to be a very complicated process and I wouldn’t expect it to end anytime soon. Tried to make it as easy to understand as possible but this is just a basic business legal right example. The laws are completely different when it comes to rights to licensing.

Those poor victims over at Fantastic would've made the best gosh darn game you ever did see, if it weren't for that ONE guy who stole their dreams and brilliant vision. The name has been so sullied by Fntastic's ineptitude that you would think they'd leap at the chance to rename it to hide their past incompetence.

Gonna have to call Legal Eagle for a coop video. By the way, anyone know how trademarks work for names? If the trademark says "The day before" and they switch the game name to "Day Before" would it count to be free from the trademark? Does having "The" in the name matter for it?

This literally could just all be a fuck up on the Mytona owners. They could have "forgotten" or neglected to inform the community manager about the initial trademark claims/dispute. If the game is actually close to done like they claimed it was they would just change the name and release it in November. I do get the inclination that they're trying to drown out the owner of the name in legal fees to get use of the name. Having even 1 attorney working for you for that amount of time will cost 10s of thousands of dollars even for a crappy attorney.

Also, why would moving UE4 to UE5 change how the inventory look like? The trailer inventory system is better done than the current gameplay inventory system. This look like a scam to get some upfront investment only to deliver poor product.

After the apocalypse spa video, im still not convinced on this game not one bit, many games have dones where they make the game look insanely good with great performance, but in release, it turns how to be not fully render texture and dozens of lags and props not being intractable, even IF the game is real and has everything we wish for, its gonna be awful on launch with millions of player complaining until its fixed.

Mytona is hoping to pull this into court where they also hope that Sun Jae Lee can't afford a defense.

This game is basically the game worlds version of Established Titles. But if it does come out it'll be well after another company uses the basic ideas this game has and makes their own, making this one just a wash effort.

Question. Why in G-d's name is any youtube creator even covering this lie? It is and always has been a dead horse. Either leave it outside to rot or bury it. The more coverage you give these developers, the more exposure they get. And you know as well as I do that in media, ALL news is good news, especially the bad news.

To be honest i don't think anyone should be calling it a game. Now i'd call it a Butt wiggle simulator, considering thats the most wev'e seen, all this delay stuff is an excuse, there is no game just cut together animations to make it look like something thats not there. We all know what their back catalogue of games is and we know they abandon them quickly so i can be safe in saying (this is going to get more delays then abandoned) or just abandoned very soon.
