    @@slug3856 her reasons were lies, she was intentionally using hate speech. She was acquitted on appeal for that particular crime having been convicted mainly because originally she chose to defend herself, the story is exaggerated - she wasn't fined and sentenced to community service, there was no fine and she was tagged for 8 weeks not a year. Do I think regardless of her true motif that what she did on this occasion should be a criminal offence? No. Was she lawfully arrested? Yes. Do I think the story was portrayed in an intentionally misleading fashion? Yes. Do I wonder why, if there are so many arrests, did he choose this particular story to illustrate his point and wonder how lame some of the other cases must be? Yes

    Well, some things being posted may result in other crimes, i.e. call for violence, doxxing, selling drugs etc. Of course every reasonable person should see the thick line between posts leading to breach of law, and posts that are prosecuted on arbitrary ideological standards.

    Yes, even if it got overturned, immense damage was done to her and the public. How many people who heard this story now modify their speech out of fear? Those who prosecuted her should go to jail for this violation of human rights.     The point is the law was used unlawfully as a weapon against an innocent citizen and the ones who did this to her will NEVER suffer any consequences for it.     Well, since he cites one example what makes you think there were actually thousands of arrests? Or do you just take him at his word? Also Russia is a totalitarian state that in practice has no freedom of the press so that should tell you enough about the consequenses of speaking your mind there. Also even if those arrests were real it doesn't mean they were all frivolous.

    Worse. They should be put on the exact same regiment she was, but then also restricted from being able to work at all as well, with all their accounts frozen. For the 5 years you mentioned. This is so that they effectively get put into the same situation as a whole or worse than she was, because when you get a tag put on ya, you basically can't work. Have a curfew? Good luck getting a job that needs you for those other hours you are supposed to be at home. And since they have the money to just sit back and relax instead, take that away so they can't. The 5 years you mentioned I keep included because the societal damages done take time to recoup from.

    Silly comment, she spent a few weeks with the tag prior to her successful appeal - the original sentence was for costs plus 8 weeks tagged curfew. The conviction wasn't sound as was borne out by her successful appeal but one of the contributory factors to the wrong verdict being reached was Ms Russell's insistence on representing herself, she had a lawyer at the appeal. It should be noted that whilst in this particular instance the initial Court got it wrong in the three years following this the not so innocent Ms Russel was convicted a further 18 times for 28 offences, including multiple offences of criminal damage and battery, and multiple breaches of community orders and a Criminal Behaviour Order. She was then arrested and convicted for affray and carrying a bladed weapon when a member of the public stopped his car to assist Russell's girlfriend who Russel was assaulting in the street....she tan saying she was going to get her Dad but returned with a knife which she threatened the man with and when he got back in his car she actually stabbed the car and waved the knife at a 3 year old in the back seat.

    Representing herself sure was silly. However, that case is still silly. And the appeal agreed with that. I can’t see how a judge can come to a guilty verdict even with the worst representation possible. Her crimes afterwards are also irrelevant. Your character might be usefull for deciding the severity of the punishment, they are completely irrelevant to whether you commited a crime in the first place.

    The point is that anyone is arrested for 'mean messages', if not calling for specific violence against an individual or group. (Though, I wonder how that would work with the US war of independence... they certainly called for violence against a group of people.) It's okay, now.     I did look up the Chelsea Russel case, the article stated "She was given an eight-week community order, placed on an eight-week curfew and told to pay costs of £500 and an £85 victim surcharge." so not a year. Still absolutely ludicrous though.

    Of coarse. I was fined for reading the news on my phone while the car was stationary, at a red traffic light. The ticket said "using mobile phone while driving (even if your engine is on, and its parked mode in australia, you are treated the same as if youre on hugh soeed freeway)". That exact same morning, on same road the police was patrollimg, minimum 5 cars massively speeding (nkt just speeding)past me, yet I did not see a single arrest.. or pulled over.

    To add some additional context to Chelsea Russell, she represented herself in court. Always foolish, never represent yourself, get proper expert legal representation. After being convicted she then did get expert legal representation, who were quickly successful in overturning her conviction in a successful appeal that was absolutely damming of her original investigation, trial and prosecution. Also she was placed under 8pm-8am curfew for 8 weeks, not a year.

    To add further context, which you seem to have neglected to mention. Under the 2003 communication decency act, it is illegal to use the internet to transmit or make public any material that is considered "grossly offensive". This term, does not have any definition as provides by the law or the courts. To reiterate, an intentionally vague law will get you arrested, prosecuted and found guilty, on the whims of whatever police officer, prosecutor or judge is there at a given time. But know, "sticks and stones may breaks my bones but words can never hurt me." Except of course, when the right person has been offended and wishes to see you punished.
