    The best part about these depositions is that the vast majority of action takes place between people who are off-camera, so you get to see the subject of the deposition sitting there looking all awkward in the meantime.

    This is from May of 1992. The deposition was taken in St Louis. The deponent is "Jack Garrett" who was at one time a research chemist at Monsanto's Texas City facility in the 1950's. Monsanto (represented by Ed Carstarphen on the left), was being sued by some residents of Houston (represented by Joe "Hairpiece" Jamail on the right with the wagging finger) who alleged that Monsanto had harmed them by exposing them to dangerous chemicals. This lawsuit may have been one regarding the Brio Superfund site. "Tucker" was an attorney representing Ayrshire. There is an Ayrshire a real estate development company in Houston, so I can only assume it's the same company, though I'm not sure of their role in this case. It's probably got something to do with property values allegedly impacted by Monsanto.

    It does seem so, which is why it's curious that the attorney on the right kept demanding that the attorney on the left has to represent the deponent or he cannot raise objections. Unless Texas law is different, it's elementary that employer's attorney can represent an employee during deposition regarding his employment at the company.

    Phuc Le - I think the confusion is because the deponent was not an employee of Monsanto at the time of the lawsuit. I believe he was an expert witness which is why in one of the first questions he’s asked if he told the lawyer next to him “the other companies he’s consulted for” which the deponent denies he did. As an expert witness, the lawyer for Monsanto cannot represent him in the deposition. The witness can have his own lawyer present but the Monsanto lawyer cannot represent an expert witness unless it’s disclosed. That’s what gets Tucker involved because he asks if the lawyer also represents the witness, and if so, he wants it on the record. If not, the lawyer has no right to represent the witness and make objections. That’s when it all starts falling apart.

    Joe Jamail is a legend among Texas trial lawyers. Just one story making the rounds: He represented a medical school in the Houston area on a flood/mold case on a contingency basis of course. When the case settled against the insurance company he gave his multi-million dollar fee back to the medical school--said he didn't need it. Amazing.

    I met Joe a couple of times during my career The one thing that always stood out to me and anyone else who knew him was he had more money than you could shake a stick at YET he had the worst Hair Appliance I have ever seen. I mean his wig was hideous Gray at the bottom and black on top. Just the worst rug ever

    It is generally an ill-advised move, to comment about the plaintiff's counsel having "verbal diarrhea", incipient or otherwise. Strikes me that we have a room full of men with brittle egos, thinking with their testicles instead of with their cerebral hemispheres. This is how rooms full of men end up shooting each other, in a state where talk and ammo is cheap.
