You have been very helpful throughout the process of starting an online clothing store. My confusion still is say I am going to start out selling shirts, sweatshirts, crop tops, cell phone cases, mugs, etc But eventually want to sell yoga mats and other items , how would I file? 1 standard ? 2 plus applications? Does having many classes make the standard application more favorable? Personally I'd like to fill out one application now and lockdown 3 to 4 classes of goods, and if approved then submit another containing more classes of goods..help! Lol 😆

HI Aiden! I Love your tutorials. Question~ how much later on in the process are the rest of the filing fees due, when filing the TEAS standard application? Is the standard version technically less of a financial risk, since the fees aren't all due up front (even though it's more expensive per category than TEAS+)? Thank You!

Very informative. Thank you. Quick ? - do you have to be registered as a business legal organization (i.e. Incorporated, LLC, etc.) to file a trademark or patent with USPTO? Also, I enjoy green tea since it has more health benefits than standard tea. 🤣😂

Nope! No requirement to be organized as a business entity. I prefer coffee over all of the teas, myself. 😆

One trademark per application; you'd need to file another one.

Question? For the additional Statements should we add that our business will be associated with an LLC? If one is using their DBA under an LLC

No. You put that in the section about the trademark owner.

Question: Is it true that foreign nationals outside US can only apply through Teas Standard and not Teas Plus? I do know that foreign nationals need to hire an attorney to complete application.

Hey! so question(s) if some of that extra information you are asked to put in the TEAS plus application you feel is not applicable like the Foreign name translation and you don't fill it out while doing the plus application would your TEAS plus application be rejected or would you have to pay more money in fee's? Also I plan on selling my custom clothes through my online store as well as having them made through a custom clothes shop where I can physically ship them out myself so I chose international class 35 (Retail Clothing stores; Retail On-line retail consignment stores) is that to broad or considered more than one class??? it says its all under one but just don't want to be blindsided by anything

Hello! Great video, just one question. If I trademark my business for one service in a single class but later on I decide I want to branch out to other things that would fall into different classes, do I need to trademark for the new services too or can I just stick with the single class I applied with? I thought that you had to setup a holding company as a multi member LLC I was just going through the process to start my holding company and it asks how many members 1-6 I tried putting two because I'm planning on starting a holding company and an operating company, but it asks the name and address of the second member if the members supposed to be the operating companies why do you supposed to start the holding company first?

Does this mean musical artists who sell digital copies and perform have to file twice? Once as a goods for digital music copies and another separate filing for "services" for live performances?

is it possible to trademark a product name on the mere intent to ultimately have a popular company buy the trademark from you? This is not an "intent to use", but an intent to sell. Suppose you came up with a catchy name and have a high likelihood a company will want to use that product name.

Hi 180, can you do a video on if a lot of trademarks come up with the words "NO CLAIM IS MADE TO THE EXCLUSIVE RIGHT TO USE "_______" APART FROM THE MARK AS SHOWN, does that likely mean that word cannot be trademarked?

@@allupinyobiz Yes that topic would be REALLY a good one because I thought the atty was "watering down" our trademark app until I understood the issue. I think you could clear up a lot of confusion on that topic. And btw, major LOLZ on "All up in 'yo business" - my gawd that's a great title!

Hey what if you created a clothing brand with a logo you want to use but dont have it trademarked and someone steals and trade marked it down the line let's say couple months when they seen it would I have to stop putting the logo that identifies my brand but I have an LLC with the name , proof of purchase of the logo design what would happen in that case not asking for advice just the solving to that problem.

You don't have any rights until you've actually started using it with your business (generally speaking). A logo is not a trademark if it's not being used as a trademark. Best thing to do is file on a 1(b) intent to use basis.
