No, it doesn’t mean that. It just means that the current Supreme Court doesn’t have faith in the U.S. judicial system, which is very SAD. DJT belongs in jail, not in the White House, but so far, too few people who have the duty to uphold the law and support the Constitution have had the courage or will to do so.

There should be federal rules in regards to a federal document's justifiable relevance to a federal election!! Come on people! You did it by making counterfeiting a federal crime. If the SC wants congress to decide on the exclusionary merits of 14/3 as it pertains to Trump's ability to regain office (or any other governmental office) then congress should be able to resolve the issue before millions of voters are knowingly potentially disenfranchised even if hell freezes over and Trump were to actually win! Absolute insanity that needs to be addressed for future insurrectionist candidates! Everyone should be happy??? You have been watching too much of that apathetic loser Bill Maher!

Right. This is what I've said from the beginning. While it might be *_nice_* to have him off the ballot, the text of the constitution doesn't expressly give states that ability. Instead, it will be up to Congress as representatives of the people and the states on Jan 6, 2025 to determine if ballots for an Insurrectionist are to be counted. Ballots are already to be validated on that day. It is just one criteria that has never needed to be considered before.

What an intriguing development in the political and legal landscape! The Supreme Court's decisions often have far-reaching implications, and this ruling is no exception. It underscores the complexity of constitutional law and its impact on democracy. Regardless of where one's opinions may lie, it's a moment to reflect on the importance of engaging with civic processes and understanding the legal frameworks that guide them. Here's to hoping for continued discourse that strengthens the fabric of democracy and encourages informed participation in all aspects of governance.

Section 3, 14th Amendment “No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability."

well, no, it isn't because of the judges he nominated. It's because the states don't have the right under the constitution to do what colorado was trying to do. Beyond that, Trump didn't even do what Colorado was saying he did as their justification for trying to remove him from the ballot. That's why even the liberal "justices" (begrudgingly im sure) had to side with the majority.

I think that we need to separate the foundational question of whether the January 6th events constitute an insurrection from the subsequent considerations regarding individual involvement or support, including former President Trump's actions. Determining the nature of the events independently is crucial for applying legal and constitutional provisions accurately and fairly. Here’s a breakdown: ### Do the Violent Acts on January 6th Constitute Insurrection? - **Definition of Insurrection**: Insurrection typically refers to a violent uprising against governmental authority with the intent to overthrow or disrupt its constitutional or legal order. - **Characteristics of January 6th**: The events involved a violent breach of the U.S. Capitol with the intent to obstruct the certification process of the Electoral College votes, a constitutional procedure essential to the peaceful transition of power. - **Comparison to Legal Standards**: The actions on January 6th, characterized by their aim, scale, and violence, align with the broad definitions of insurrection, as they sought to disrupt the constitutional operation of the government forcibly. Given these considerations, many legal scholars and commentators argue that the January 6th events do meet the criteria for being considered an insurrection, focusing on the intent and actions of the participants rather than the outcomes. ### Trump’s Eligibility and Involvement - **Eligibility Considerations**: If the January 6th events are determined to be an insurrection, the next step is to assess any individual's involvement in those events or their support for the participants, including offering pardons, which could be seen as "aid or comfort." - **Objective Assessment**: Determining involvement or support should ideally be based on factual evidence, such as actions taken, statements made, and any direct connections to the events or participants. This includes evaluating whether any offers of pardons were made to individuals involved in the insurrection. - **Legal and Constitutional Process**: Any conclusions about eligibility, particularly under the 14th Amendment, would likely require a formal legal process or congressional action, given the amendment’s provisions for enforcing disqualification from office. ### Non-partisan Application - **Fact-based Decisions**: By focusing first on the nature of the January 6th events and then on individual actions in relation to those events, the assessment strives to be rooted in objective, non-partisan facts. This approach aims to uphold constitutional and legal standards above political considerations. - **Challenges**: Despite the intent to base decisions on non-partisan facts, the deeply politicized environment can impact the interpretation of facts and the application of legal standards. This underscores the importance of rigorous, transparent, and fair processes in making such determinations. In summary, determining whether the January 6th events constitute an insurrection based on legal definitions sets the foundation for any subsequent considerations regarding individual involvement or support. This methodical approach allows for a structured assessment of eligibility under the 14th Amendment or related legal questions, emphasizing the need for a fact-based, non-partisan framework.

To understand the US Supreme Court's decision one needs to read the US Constitution first. The US is not a Democratic Republic, but a Republic with some elements of Democracy. Originalism means that the only rights and policies that are protected are ones that are explicitly laid out in the constitution, conforming with the “original”intentions of the founders. Although slavery has been abolished, the property that is central to the Constitution-private property, the right to exploit the majority for the benefit of the tiny minority remains. “Those who do not move, do not notice their chains.” ― Rosa Luxemburg Recall Citizens United. Update US Constitution to shift power balance between Majority and Minority.
