Yeah, I REALLY don't get why people are making jokes in these comments. Any one of us could end up NEEDING the tips he's giving out in this video, like the poor Good Samaritan who thought she gave a forgotten credit card to the right owner, but she accidentally gave the credit card to a thief who went on a huge shopping spree, not to the actual credit card owner and the Good Samaritan ended up interrogated and spent like three days in jail and lost her job and the credit card thief got off scot free! 😱🤬😡😫😩 Luckily the judge called out the Police Officers for arresting a Good Samaritan when the credit card thief got away scot free! Good Samaritan was free to go.

I saw a video of a Lottery Clerk who had failed a sting operation and had told an Undercover Lottery Agent that her $1,000 ticket was a loser. The Undercover Lottery Agent was like,"Okay, sucks I didn't win," and left. The Lottery Clerk then took the "losing," lottery ticket and was shown on video checking it at another store. She then claimed it as her own. Weeks later, the Investigators interrogated her, acting as if she ACTUALLY won. She REALLY incriminated herself when she thought she actually won. She soon realized she was being interrogated and not being congratulated and handed a winning check. By the time the alarm bells FINALLY went off in her head, she had already incriminated herself. She was arrested, sentenced to months in jail and some months on Probation. Had she said something like,"I'm not speaking without a Lawyer," she might have gotten away scot free.

@geocachingwombles I don't think that's the case in every state. I've been arrested at least 5 times and I can tell you that for the first 24 hours it's pretty worthless to get an attorney involved. They're not gonna be any help aside from advising you of your rights which you should already know. I've asked for my phone call for my attorney a few times when I've gotten to the jail with no success. One time they even said "if you can get your lawyer to come here at 2 in the morning by all means but I want the lawyers name.".

They simply go there and sit for a few weeks then see a trial and the public defender thats court appointed shows up 5 minutes before ur trial to get a understanding about what its about and quickly decide to be as useless as they can possibly be. Most people can't afford a lawyer for a criminal case. 5 tops out of like every 100 people id reckon. Which would make sense because most crimes are acts out of poverty like stealing because someone is hungry or desperate.

5th doesn't mean you aren't arrested. It makes it clear you're choosing to use your right to remain silent/not to self-incriminate which is protected. If you just stayed silent without invoking the 5th that could be used against you in a criminal trial. Invoking the 5th cannot be held against you (except in some civil cases but the video is about getting arrested).

What?! I thought those were like mandatory, if the officer suspects you of being under the influence..? I gotta find what that's all about, didn't know you could refuse to take it.

@@chuggeez_8851 Yeah, you can refuse. The officer has already made his mind of whether to take you in or not. The field sobriety test just gives them more evidence to use against you... Not to mention they are hard and people fail them stone cold sober all the time. The best thing to do is just to ensure that you have a blood (if you are sure you are sober) or breathalyzer test (if you need to argue uncertainty of exam sensitivity in court) at the police station, getting a lawyer, and fighting a false DUI/suing for damages.

​@@chuggeez_8851 yup... like Night Shock Playz said...... . if they want to see if im drunk or not.... then do a blood test . . im not refusing.... im just refusing a "walk like this and look like this" test..... you can take my blood anytime you want . . . also.... at least in montana they must wait 30 mins after pulling you over if you have an open container . also, if you burp/hiccup.... they must wit another 15 mins (iirc) before doing a breathalyzer test (as that burp is going to be straight booe from your gut..... not whats actually in your blood stream.... which is what the law says.... its not GAC.... its BAC)

Remember though once you've been lawfully arrested you do have to identify yourself and if you do not have physical identification you do have to speak in order to give your name and date of birth.

I once was detained by campus security at my college. They wanted me to sign an agreement, and I asked to speak to a lawyer. They put me in the office with the chief of police, told me I didn't need a lawyer, and threatened to ship me out of state to a penitentiary if I wouldn't sign the document immediately. I was scared and signed: I regret that I didn't stand my ground and didn't know my legal rights better.
