Should You Apply For VA Disability Benefits? Here's What You Need to Know

If you have been injured in a car accident, or any other type of accident that has caused a traumatic brain injury, you may be wondering if you are eligible for VA disability benefits. The answer is yes, but the process can be complex and frustrating.
The first step is to get a diagnosis from a medical professional. This can be difficult, because many times the symptoms of a TBI are not immediately apparent. Once you have a diagnosis, the next step is to gather all of your medical records and evidence to support your claim.
When you apply for VA disability benefits, you will need to show that your injuries are service-connected. This means that your injuries were caused by your time in service, or they were aggravated by your time in service.
If you can show that your TBI was caused by your time in service, or aggravated by your time in service, you will likely be approved for VA disability benefits. However, if your TBI is not service-connected, you may still be eligible for VA benefits if you can prove that there is a nexus link between your current disability and your active duty service.

    Having to deal with the VA should count for at least 50% of a tbi for all Veterans :) along with 50% ptsd and that should be 100%. You go in for a splinter and it turns into an event. I love your videos, every time its triggers me and then I read comments and get more mad

    CC talked about working with someone that can separate your symptoms. Make sure you do this. I have PTSD(70%) and TBI(40%) they lumped them together under the PTSD rating. They will say "they can determine which happened first, so we will just combine the rating" I missed the Hundo Club by 2 F-ing points by them doing this. Keep it up CC

    Yup they do this every chance they get and the conflate actual pyramiding with similar symptoms. Make sure your doctor separates and attributes your symptoms properly BEFORE you file your claim!

    You are close to the Hundo club ... Get them secondaries they are a big help... List all of your disabilities in the problems list and I'm willing to bet some of them are connected to your primary disability.... If not you need to get your Doctor to put them in your diagnosis problems list and get a nexus to connect them. You are on the right path watching Combat Craigs channel.     This is stuff you have to learn before you file. I never thought I would get out of the military. So I never thought about the VA stuff. Of course we are never taught any of this because no one knows this stuff.. let alone how to even ETS.

    Is there a rating table for TBIs? I am in this process right now and there doesn't seem to be any clear rating details outside of the special monthly compensation that I can find.

    I just had an appt for hearing. It was kind of scary because I have known a few veterans with tbi and they went off the deep end. Anyways they told me that I probally have tbi from when I hit my head when I was in. Which is causing all my migraines and why my hearing checks out fine on the board. Having a tbi can cause hearing loss and tinnitus along with a bunch of other problems. The issue is getting the test. The VA here doesn't have the machine, closest place is 2 hrs away and they are booked out over a year. Its weird because I have been going to the VA for 15 years. And not once has anyone ever said- maybe you need to get checked for a tbi..Now I see why it has never been brought up

    Yup. They like to pretend it does not exist. Then they get angry at you for not being able to remember things like appointments and instructions etc. Hard to believe that even the Voc Rehab guys will just string you out even though their own admin says you have a TBI or brain injury of some kind. They will still push you to programming even though you can't remember anything or retain it very long. Dispite their own metric saying you don't qualify for that. Same goes for what the VA expects you to do. But then you need to get a VSO to do it all for you. And the VA can never seem to spend the time to help you with paperwork they need you to fill out. Dispite having Social workers and staff that are suppose to help you with that. They often just hang up on you or tell you to go somewhere else. Makes you wonder why they do this? But we all know deep down why.

    So I had a c&p exam for major depressive disorder at the end of the of the interview the examiner ask if I have ever filed for TBI answer no the reply was if I was you I'd go to the doctor right away - will this effect my original claim for mdd ?

    I had a head injury while in service well over 20 years ago. Didn’t report to medical. Fast forward years later..out of the service and reported to a civilian hospital with symptoms of what I thought were a stroke. The MRI revealed abnormal brain structure. This all made sense. All these years and I’ve wondered what the hell is wrong with me. I filed the claim and the C & P examiner actually diagnosed me with TBI. The claim got denied, but the diagnosis is there. Proving service connection is going to be a battle.

    Navy said I didn't have it, but the VA overturned the results. The MRI showed a hole in my head. Only reason I got an MRI was I had an outside provider provided a proscription so I could get it. The neurologist at Balboa was furious he was bypassed and downplayed the results.

    Its crazy how the very NAVY that we are suppose to serve would do this to us? I have seen way to many BAD Docs in positions that they should not be. With a family full of doctors? Its not hard to hear these stories. Its not like we ASKED to get injured! Heck I never even asked for the guy in the truck to hit me. LOL. But it is what it is. Wish it was not so hard to get the same kind of care a politician would get.

    I was diagnosed for a TBI with insomnia and depression four years after I got out however, the event (TBI) happened while I was in and the doctor even put in his notes that this happened during training for operation enduring freedom. Does that count as a in-service connection?? Help please

    I have 40% tbi and 30% residual migraines. Currently have anxiety and depression appeal active right now. Now I’m curious. I bet they’re gonna make the mental health stuff pyramid into the tbi rating… only the future can tell.

    TBI 40%..on appeal to 70% VBA as usual under rated my claim...always be proactive with your caim....now working with VA Polytrauma unit...best place for TBI treatment

    My trouble is that despite knowing that I had concussions in the field there are no medical records given a corpsman never seems to carry anything for notes or the like. So I have never had any evidence to back it up. I hope everyone else has theirs documented and has a supporting medical staff to get their claims done.

    VBA hasn't yet rated my TBI. But has rated all the conditions caused from the tbi separately (Seizures, migraines, PLMD, PTSD, etc ). I put in a new claim for a sleep disorder and put due to tbi.....VBA absorbed it into my mental health rating and said current perecentage continued..... lol I just want it put down on paper in black and white "TBI". I don't care if it says 0% at this point. What do I appeal? Shouldn't be absorbed into mental health. It should be rated under a tbi residual diagnositic crtieria? Psych C & P exam guy apparently said the issues were a reflection of ptsd and mdd more than nightmares disorder or non-24hr sleep wake disorder. BUT...I still have the non-24hr Sleep-Wake Disorder. If I don't treat it I have major issues. I just think it is BS to just absorb it. I have to wait to get my C-file to see what the C & P exam Dr even said. The TBI stuff is very confusing...especially since I am coming from behind.

    I am 100% service connected for TBI and PTSD. I have visible facial and head injuries from the blast in Afghanistan. I had a stroke and now I’m having seizures. The VA granted me, SMC L with Aid and attendance. I submitted a higher level review for SMC T. I was denied. What do you suggest I do please.

    Just got my TBI Exam results back and I'm pissed and frustrated. Significant findings to merit 40%, however since they "are unable" to specify if PTSD is the root cause, they will just add the service connection and continue 70% PTSD. I'm at 80% already and this of course moved nothing. Also got denied on Meniere's and deferment on TDIU. Pretty frustrated. I have an Attorney, Greene&Marusak (referral from Pontin) that has helped me this go around.

    I have a TBI C&P next month you mind sharing what the exam consist of and what to do and not to do? I had a injury while active duty and already have a diagnosis but I don't want to screw myself doing the exam.

    @@reginaldchatmon2312 there are different exams from my understanding. Mine was a written exercise. I actually thought I aced it, at the end she showed me how I in fact failed it. It was unsettling but the scale of failure wasn't shared. I went in wanting to truly get assessed. I know some guys want to embellish their symptoms. I'm 100% TDIU now, backpay was 13 months. Good luck!!!

    @@reginaldchatmon2312 mine was through LHI here in Charleston. It was at a business park, tiny office and with a doctor that didn't want to be there (as usual). It only lasted 30 minutes.

    Combined TBI/PTSD rating of 100% (plus others) P&T; would filling out an application (VBA-21-2680) for SMC open an entire C&P exam placing every rating under review again, or would it just be to determine qualification of SMC?

    Until you have 20 years of p&t with no improvement you are open to new C&P exams if you file new claim. After 20 years, you are safe.

    I fainted in the military a little over 20 years ago and woke up in hospital because we were forced to stand at attention in winter bdu's during a heatwave waiting for a change of command that took forever. Dozens of us fell out at same time it was so bad.

    Thank you for all your help. I am rated at 100 for posttraumatic stress disorder (PTSD) and major depressive disorder, with residuals of traumatic brain injury, I don't suppose there is a chance to file for SMC T?

    I haven't tried but I was diagnosed with a TBi after I got my 70% PTSD rating, I'm sure I can claim my TBI (All documented now). But I don't want to mess with my 100%PT
