Ratha has judgement in envelope already. He is always talking about appeal. He can't talk about appeal if he didn't have judgement already. He is not even ashamed to show that he is standing with the state, He is only happy when is Baloyi and state witness in the box, helping Baloyi with case laws of apartheid and helping him to finish sentences. When is defense and defense witnesses, he doesn't say a heee or a haaaa, you will forget that he is there.He let's Abo sibande say whatever they wanna say to Abo Ntanzi. Why else??? To contaminate and eliminate some of the crucial, original evidence of the crime and the scene. And by the way...THAT'S a CRIMINAL OFFENCE!!! Finally we have a legal practitioner who talks abt how the preciding officer and NPA have messed up the case. It seems like their intention is to make the case so murky that we end up not knowing the truth & lies. Pretoria high court once sealed statements without a hearing or trial and now a retired judge was called for a very important case of a national team captain. Who gave the docket to cold cases while it was still investigated by the 4 guys appointed by the commissioner. Very interesting events while the family of the deceased is still trying to find closure. Sad situation.

I gave up long time ago, Judge no man!!. When Advocate Mnisi was denied to cross examin on new evidence that was previously blocked, wrong. In fact i gave up the day Ntanzi accused number two travelled more thay 35 hours without rest, given about 2 hours to rest, and taken vroeg again to confess. IO denied until AVL was presented. Story changed to "break down from evening to whole night until next day". Yebanna!!! I also gave up when the accused told magistrate thay je never took a bath and his family does not know his whereabouts as he was taken from her room at night. Instead the magistrate broke the law and recorded Ntanzi unlawfully, and went ahead to take the so called confession. Judge rejected the record and accepted written statement.

Even when this judge came with the judgement that Zungu didn't write and signed any statement. He even confessed that he wrote the judgement on a sunday when on a Monday Zungu was supposed to come with the report whether he found the statement or not

Thank you for being honest. Nthabi is knowing the docket we dont even know and when it comes to this case i beg to differ, she is way more wrong. Firstly this was a cold case meaning it had not been completely investigated and eas given to Gininda who is investigating cases that were not successful. Now the accused are implicating Kelly in this present case. The question i believe was, will she be brought to books as implicated by the accuse in confessions. Either than talking abt something that is not therr yet. Does she believe that the wrong people are accusedof the crime they dont even knoow. If so, she is ignorant.The judge is doing his job very wwell. Infact he is very patient wwith the defence. Eg the audio of Judge that was taking confession from Ntanzi, yes it was done illegaly but for the interest of justice on what happened on that particular day, the judge looked at what the law says. And yes the investigating team after the murder did not do well but does that mean we need to ignore all the evidence before the court now, and inquire abt the docket that was not even challenged in court, am not sure

@zwelimkhize3071 when did accuse number 5 called Mandisa? Muzi never called KELLY. NTANZI confessed before RAPHADU on 19 June without lawyer. When did NTANZI called MJIYAKO? The state hasn't presented the appointment letter and proof of payment by NTANZI to MJIYAKO. According to MUZI's confession, him, Marco, and Makhimba shot SENZO on 25 October 2014. Marco called KELLY. Why is Makhimba not part of the accused list?

I beg to differ with Nthabiseng . Her explanation is misleading and her understanding of criminal law and criminal proceeding is questionable. The criminal procedure is as follows. The arrest of a person is solely dependent on the evidence against such person. The investigation starts with the reporting of the case to the police, an IO is appointed to investigate, information gathered by the IO is then given to the NPA which then will decide if there is sufficient evidence to can prosecute and if so a trial will start. In this case the evidence that links Kelly is from the confessions of accused 1 and 2, which has to be tested in court if indeed she was or she is involved. I doubt if there is sufficient evidence to can charge Kelly. If it was she should have been charged from the onset. With regard the jurisdiction of the HCs, although they all have the same jurisdiction, the Pretoria HC is Provincial while JHB HC is local HC. U can lodged an appeal against decision of the local HC to Pretoria HC ( provincial) but not the opposite. Appeals against the decision of the Provincial HC are lodged directly to SCA or the CC. Should there be evidence which links Kelly directly to the case , she will be charged and join the other accused .

You analysis are extremelly wrong mfo.Dubzana is extremelly right mfo.Tshegofatso Pule's boyfriend was arrested through the confession of his friend through his friend that he is the one who hired him to kill her. There were no brow envelopes in that case and the prosecutor and the judge were doing their jobs professionally in thar case.Unlike in this case where the judge is 3 in 1.He is a judge , a prosecutor and a state witness.There are many other cases where one spouse or a partner send people to kill the other hs or her spouse or partner, and after an investigation the killers are found and confess being send by the other spouse or partner.The sender will be immediatelly arrested and be part of the accussed in court.But in this case of Meyiwa, there are so many cover ups.
