This police officer Brig Bongani Nicholas Gininda is very competent and his demeanor in the witness box is calm and straight foward he gives clear answers without hesitation and his evidence is generally corroborated by documentary evidence and probabilities which are overwhelming.....i put my head on the block the Court will embrace his testimony...Legal gurus you can criticise me as harsh as u can...but its my opinion.... Although at times he gives loong sentences as his answers they are not irrelevant, infact they clarify issues...31/1/2024

The law is making it difficult for the accused to report assault , if as in the case of no. 1 , the very person you are accusing of assault is the one who eventually determines the merits of that accusation. Where does one then get relief? My heart bleeds for the poor , at least the rich can afford lawyers who can do that for them. I can imagine the desperation of people like Ntanzi and Muzi who cried out for help and were supposed to go back to very abuser for solace. How was Muzi expected to lay a charge against the very person who will eventually determine the truthfulness of your accusation. You may celebrate Gininda for "applying the law," but what most of us do not realize is the desperation of the accused in that situation. I feel something should be done to change this. I feel once an assault has been reported against any officer an independent body should take over immediately to investigate the allegations. It is in our power as a people to lobby for this. PLEASE LET'S THINK ABOUT THIS. There is no impartiality. The law favours the abuser.

In the education system where we deal with vulnerable citizen, once a learner tells an educator that they are being abused, that educator is compelled by law to report the case. It doesn't matter whether the educator believes the child or not, her/ his duty is to report to authorities. I feel all officers of the law ( magistrates, judges ,police officers) should be compelled by law to do the same thing . A lot of people might not think the accused are vulnerable but they are. Especially at the hands of corrupt police officers who do not want to do proper investigation but just want to close cases.

It is always assumed that serving officers are not eloquent enough. But hands down, Brigadier Gininda has changed the thinking. Par excellent. Well experienced and up to the task. Like everybody, he is not infallible but he has indeed assisted the court.

So far i was impressed with gininda nd the other retired policeman who worked with exhibits by that time .u can easily relay what the say or paint on de picture that include seargeant mogola the lady.the fact of de matter we want to hear from them what they know nd did then leave it to the judge.as for the defence they are full of unpreparedness sometimes.
