A missed opportunity by the defense @48:56. The witness seem to have fumbled the ball by actually confessing that the acussed was tortured. He said I was never involved in any of those assaults rather to say the accused was never assaulted. A follow-up question from the defense was missed. Defense should have asked the witness, then who was involved in those assaults. Oh what a miss.

It's mind boggling when most people like you are fooled by Ntanzi and even defend him. Ntanzi is a phatological lier. Accused initially lied about not knowing each other. Ntanzi during bail application he lied said he was at work on the day. Later on he said he was in KZN and his capitec bank statement will serve as a proof, lies again.

@@nomfundoshezi3511 if we are watching the same case as I'm watching, the state is bringing forth some evidence but all is denied by the accused and his defense team. And we are supposed to believe him while there is no piece of evidence he's putting forward but just denying.

It's surprising that people who are supposed to know the framework of operation in their respective work environment. They seem not to understand the legislations and rules that are put in place and they constantly fail to implement and apply them when performing their duties. The scope of work is not properly applied and that is a disgrace!! These people seem to be paid for doing absolutely the opposite or they are paid for doing absolutely nothing.

This literally shows that something is wrong here,i mean why have all the cops who have testified here their answers are all yes regarding to the confession statements and all the answers said to be provided by the accused seem to favour them, I want Gininda on the witness stand because he has to explain as to why Ntanzi was being moved to different police stations and why so many confession statements to different policemen who were all called by Gininda

Ntanzi didn't want a lawyer when he was making the first confession and then later went with a lawyer to the Magistrate 🤔

That's why it alleges, he had two confession statements. Allegelly maybe after realizing that the first confession there was no interpretation and legal representation, they alledgy arrange for another confession where there was magistrate, intepretor and legal representatives for self cover up. That why Zungu was able to relate everything in his, alledge I believe he may be having all the confession statements of the accused so that he can build up his case.

That's true, they never read the statement to the suspect especially if he is illiterate. Also it's a rare case that the suspect could insist on the reading of the statement.

Here is the part I don't understand about voluntary confessions: why is there a need to be accompanied by a big contingent of heavily armed police if you have voluntarily offered to confess to a crime? I mean if it comes from you, it is simple, you stand up and go to the nearest police station and inform them that you want to make a confession. But if there is coercion, you are arrested, handcuffed, assaulted for a week until you admit to a crime, kept for another few days so that your scars or any visible marks disappear and then you are threatened with death if you ever say anything about your assault, then you are taken to friends to sign an already made confession.

The whole system is disgusting including the judge,Baloyi and all the witnesses. The judge is old enough to be someone's granpa, i hope one day one of his gran kids get involve in the similar mess. Disgusting, those 5 men will be sentenced for nothing..

I dont think all SAPS officers are bad, others were given instructions by Gininda, dey knew nothing dey just did their job

I believe the accused are guilty, but a suspect was held in custody for eight days whilst having the right to be brought before a court within 48 hours of his arrest if that 48 hours passes you have a right to be released, the 48 hours elapsed and you tell me he was willingly in custody, in hand cuffs willingly?, if that is not duress, there is no such thing as duress

The witness should ve just told lawyer that he was not the investigating officer. He was just taking confession, some of the questions were irrelevant for purpose of his confession.
