I certify the aforesaid Video footage generated from the above DVR that :
The recording contained in the above DVR were generated into it in the ordinary course of activity/usage of the DVR which was into my possession/control.
During the period .....to.......the above mentioned DVR was operating properly and there have been no such operational problems so as to affect the accuracy of the electronic record.
During this period, the DVR was in my possession ans safe custody and its software have built in security mechanisms i.e. Password Protected Access Control etc.
The electronic record generated from the above DVR has been derived from the information fed into it and is a true extract of the data in the aforesaid mobile.
The above said mobile is in working conditions, till today i.e. ........when the output was taken from the aforesaid DVR. the data transferred on CD/DVD/PEN DRIVE have been done by technical expert in my presence.
I am computer literate and having ................qualification in IT.

Hello madam... Lets say a CCTV footage only from the day of alleged assault is recorded and presented and otherwise thr was no recoring from the CCTV on any other day (so not matching with 65B (2) (b) ) Is this admissible??
Sir, Maine RTI, Se information maangi thi CPIO ne mujhe response mail bheji under section 8 (I) J he can't share third party information because he is its personal information. I revert him please share response letter by second party for deny to give this information.. So he can share a e - mail to me receive from second party. And print that mail on white paper( hard copy) and share it through courier. Now I demand 65 ( b) certificate from CPIO but he not responded what can I do?
Can you please attach the format of the 'certificate'? Is print out of watsapp conversation admissible under section 65(b)??

There is no prescribed format for Sec. 65B(4). We have to adhere the spirit of law as prescribed under this provision. WhatsApp conversation is admissible in Court of Law, but the mobile phone handset has to be seized and send to SFSL/CFSL for Forensic examination.
Hi Ma'am Just had this question If party A had filed a case versus party B.And, Party B has filed a case versus party C. Party B in his cases versus party C has finished his cross examination in chief and oral examination but party C has not. Can party A use the depositions in the case of B vs C in Court case of A Vs B as evidence.l.e his oral deposition and AIE in of B in Case B Vs C by submitting certified copies of the same from the respective court of B Vs C? No, but at the time of recording of evidence one has to put a certificate of 65B with their electronic evidence. If they are not filling on that time court MAY create an adverse inference against him.

@@GOLEGAL FIR is still not filled but a statement is taken from us by plice and its been 1month they are saying "waiting for 65b for cctv footage from hospital

The person who gives electronic evidence has to file the certificate of 65B. In your case if the electronic evidence is filled by Hospital, the person / department who make the copy of that electronic evidence has to file the certificate of 65B. Answer to your questions 1. Yes, 2017 mein case file ho sakta hai. 2. As per my information jitne salo ki chat pr police ko doubt ho utne salo tak. Pr sirf FIR lodge ho jane k bad, during investigation kr sakti hai. 3. Agr victim ne electronic evidence pesh kie hai or 65b ka certificate nai dia to ye Evidence admissible Nahi hai or jaisa apne kaha k agr admissible kr lia to yes ab app cross examine kr sakte hai

@@GOLEGAL 2017 me 66A IT act me case kaise darj ho sakta hai jab es section k liye 2014 me shirya बघेल k case me es section ko SC k dwara struck down Kiya Ka chuka hai... 2. Kya yadi koi case 2014 me darj hua hai lekin police ne tab call detail nhi Di court ko, to kya 2020 me trail k baqt de Sakti hai telecom company se lekar. 3.65B Ka certificate na diya ho aur electronic evidence admit kr liye gye ho lekin vo sb manipulate kiye hue ho, kya tab bhi un pr cross ho sakta hai.

Hi madem good morning , please clarify my doubt. I have attached the Mobile Call recording to Gmail 2 years back, it has time and date also in gmail along with attachment . Same day I gave money to someone based on promissory note, Mobile is demaged and I throwed it, Gmail attached call recording can I submit as evidence to the court? If yes, please tel me does it need any certificate, Please reply

Party through his lawyer has to file this before court when they are going to produce electronic evidence before court.

It is admissible but if the court finds any tampering then it is not reliable.

Sir, यदि कंप्यूटर से किसी साक्ष्य का पेपर प्रिंट आउट लिया गया है और पुलिस के द्वारा उसको कोर्ट में चालान के साथ पेश भी किया जा चुका है परंतु पुलिस ने 65 बी साक्ष्य अधिनियम का प्रमाण पत्र नहीं लगाया है तो इस स्थिति में कोर्ट एविडेंस मान्य करेगी या नहीं please reply 🙏

Yes, it is valid only if the person who wants to produce it follows provision of section 65B
