The cops were clueless and hence why they walked off so quickly to return to the battlefield they were dressed for😀.
Fly the drone, but keep it outside their boundary. From 400ft should still get a good view.
So if it is a security zone why haven’t they applied to have the air space above it declared a no fly zone.
Why the back off. I don't understand. If it is legal, do it.
Getting arrested isnt all wonderful. If cops, lawyer, judges and civilians didn’t lie all the time it may be different. I trust PJ and his decisions!

My local police force are all armed 24/7, nothing unusual about seeing armed police in the UK.
No predicament whatsoever. If it was illegal, the cops would have said so instead of walking briskly away from something a little bit ticklish. In future, plod, fall off the fence then everyone would know where they stand.
Blimey Pete, fancy asking a child copper with no social skills a legal question! I've just had a look, I can't see any restriction on you flying a drone there despite its designation, but I'm not 100% sure. Very interesting as always, thank you.

@Ed Straker Hi again, oh no no, please, I don't think any such thing. I said I wasn't 100% certain he can fly it there, and I absolutely agree that it's not worth risking some clueless child cop taking the drone, plus a possible arrest (in this heat too!!) and then all the hassle of being without it for God knows how long. You're right, PJ did the right thing in the circumstances.
PJ done it right. He didn't know for sure if he'd be locked up, so he backed off. I'm sure he will now go and investigate more deeply, the legality of flying in that area. Tomorrow's another day. Big up PJ

Not so simple, these are not regular police officers, they are Ministry of Defense officers. Laws around places which guard MOD sites aren't the same, also, there is a visible detection scanner at the front entrance which can detect drones up to a distance of 4km. The site is guarding some highly sensitive pieces of technology, and as he already technically trespassed, the MOD officers can charge him if they get antagonised enough by the drone.
And they are called the filth because of numerous reasons one being there ignorant attitude. 👮♂️👮♂️🤮🤮

What a stupid comment, confusing Pete's shrewdness with a lack of courage.
This video was very revealing I feel in the way the MOD police were unable. or, unwilling to answer a direct and reasonable question. By just walking off, these police show both ignorance and contempt IMV. In the situation a good decision PJ and the video did have value. Not only are some legal issues complex, they are also open to manipulation by those in authority.

I'd guess they were in the same situation as PJ, knowing whether the proetced site status also applies to overflying with a drone. Police do not know all laws off by hand and it's reasonable for them not to be experts about drones. Without clarity the sensible thing would be to side on caution.

I think you should contact the drone police and get them to confirm one way or the other. I think as it's uncontrolled airspace if you are not on their property then there's nothing they or the police can do.

Or fly the drone outside the site perimeter and get an aerial view but not one directly over the site, as you could do for a prison for example
I had to work as a contractor at the old Rolls Royce plant at bootle Liverpool when they were building the engines for the air bus. The factory was separated in to two, catholics in one side and Protestants in the other. I have never worked in such a sinister environment. The whole lot should have been slapped and told to get on with each other or get the sack. I blame the company for letting it get to that stage. In the end it all got moved to America and they all got paid off. I’m not surprised from what I observed.
How polite that the police (public servants) decided to fully answer your questions and concerns. Bunch of arrogant muppets!

They're MOD rozzers, Roll Royce has military contracts. Seen both of them in the local tesco when I lived round the corner.
He was wrong with regard to the red line. SOCA states that: the outer perimeter of the protection provided for any premises is the line of the outermost fences, walls or other obstacles provided or relied on for protecting those premises from intruders. The red line was a red herring!
As an activist I believe you are obligated to push the issue , walk as close to that line as possible, arrest or not , a true journalist will take the risk . Just the knowledge of any repercussions or consequences it work the risk . Don’t mistake, their action will also have repercussions and consequences spending on how the scenario plays out . Sometimes stirring that is a necessity when standing up for our rights and freedoms granted to us , at birth ..✊🏿

You could have flown from the sidewalk near the street. Just taking it straight up and got an overhead view. But you are understandably weary of the risk! I would have not taken the chance of getting arrested myself! Gotta trust ya gut!🌻💛🌻

West Derby Road (up to the red line) is Maintainable by public expense by Derby Council and is a Public Road. His rules on you flying over site it bull and he has no right to stop you. Bernstein of Leigh v Skyviews & General Ltd [1977] would indicate that you can not trespass in to their property when using the airspace above as long as you don't descend in to areas they use for the ordinary use and enjoyment of the land (so as long as their normal traffic would not collide with the drone you should be fine). Section 76, CAA 1982 - Aircraft, including drones, enjoy a statutory defence against trespass and nuisance claims.
PJ, I'm disappointed that you didn't fly the drone over on this one, it certainly comes across as a weak choice. I think it'd have been an interesting vid if you had, (cause this wasn't really). The security guard was actually professional and surprisingly smart enough not to say anything that'd make him look dumb on camera. Fair play that man. The f!lth where typically useless as always.

Great video, as always! The restrictions at a Designated Site (or a Nuclear Site) for the purposes of SOCPA 2005 is all about entering being automatic trespass: you must not cross the outermost boundaries of the Designated Site, and you don't stop trespassing until you have exited the site perimeter -- i.e. you are not given a grace period of time to leave. There is nothing in the Act concerning photographing the site (I've done searches through the complete Act for "photo" and "camera" -- the only references are to the rights to take photographs of suspects at a place other than a police station, and the word "camera" doesn't occur in the text of the legislation). So the CAA have the last word about the airspace, and if RR want to make their case and apply for restriction that's up to them, but failing that, there's no control. Does anyone know different? I guess 2005 is before drone paranoia took hold.

Part of Atmua is national security with a fixed penalty notice. A socpa site would definitely be in its remit.

Although it's not the last word on the issue, even the Information Commissioner's Office admits that: _“National security” is not specifically defined and can be interpreted in a flexible way to adapt to changing threats._ So does this imply that appropriate authorities can determine that, for example, flying a drone over Rolls Royce constitutes a threat to national security, and, without any notice to the public to warn them, the drone pilot may be subject to the penalties provided for in ATMUA 2021? It wouldn't surprise me, especially with so much legislation now being "enabling legislation" so that the implementation can be easily varied through Statutory Instruments not pre-scrutinised by Parliament, and sometimes, depending on the zeal of the Minister, not even requiring that, it seems. All part of the knee-jerk response society we seem to live in.

personally, I would have done the same as PJ....then found out if I could fly over their site legally, if so I would do a RR audit part two and fly the drone over the site...with the knowledge that I'm educating others and satisfying my subscribers' comments and curiosity!

Disgraceful police behaviour, just walking off when asked a legitimate question. If they don’t know the answer (and being stationed there they should!), then get on to commas and ask. Policing is about crime prevention and community engagement as much as reactive policing.
Trespass is NEVER a criminal offense in the UK.

Hi, common law trespass (by which I mean 'traditional' trespass) isn't, you're absolutely right, but Parliament can, and does, make trespass in certain places a crime. For example, Buckingham Palace, it's been a crime to trespass there or in its grounds since 2007 (there was a prosecution for this in the news a few days ago). The same law appears to apply to Rolls Royce.

He didn't fail at all. Serious Organised Crime and Police Act 2005 (the one they were trying to reference but called it SOCAP, when they meant SOCPA) makes it a criminal offence to trespass on a small number of 'designated' sites, this being one of them. Wouldn't affect drone flying though.

I would have flown the drone outside the red boundary line and they couldn’t possibly done anything as you have not flown over their site. Need to get the legal definition on this one and if it’s in your favour than I would go back and fly the drone over the site. Those two plods weren’t really interested unless you broke the law and then they would have offered you free bed & break
You’d don’t need to be arrested to prove you’re good at what you do. Check out further first & look after PJ. We need you for the future not just today. If any viewers think you should risk arrest then they can become auditors & do so.

Hitting one of the countries energy production sites in a time when we’ve seen how important energy is to a countries security is, kinda low ballin’. I think you made the right choice. People forget that drone flying is covered by more than just the specific drone rules (just like the highway code tells me I can drive at 60mph on a "derestricted" country road, but if I insist on doing that on some where the local conditions do not allow I can still be nicked for dangerous driving & it is no use telling Plod "ah but the highway code said I could")

Bye laws cannot be slapped up willy nilly if Primary legislation is already in place to control an issue. Highway code 'speeding' info is only a 'code' and is not a criminal offence to speed over the limit.

@@ef7480 the primary legislation does exist..it is the overarching standard CAA stuff that says all airvehicles (including all categories of drones) shall be operated safely. Whilst nothing goes wrong then plod will probably do no more than some ritual stomping, grumbling & trying to look mean (but basically do nothing.... As we have seen so far) however sometime in the near future someone's drone is going to have a problem over a site, bouncing a lithium battery from 100', starting a fire... Not good on comah sites, not good on nuclear sites. Look at all the drone crash fire videos. Check out the Smethwick fire video (caused by a Chinese lantern that has even fewer flight restrictions than drones)... My guess is that the first prosecution will not be under the drone regs but under h&s regs for the consequences of something that happened. This could be up to manslaughter.... It is not illegal to tightrope walk above crocodiles, but it is not unforeseeable that someone is going to get their arse bitten in the near future..... What do you think they would have done if they identified who set off the Smethwick Chinese lantern?.... Plod seem to be waiting patiently for a clear cut precedent case to come along & they will then crucify someone for it & use it as a justification for slapping on much tighter rules.

Hi P J, that question you ask at the start is one which might well turn one way if your drone was made by them but quite another if it came from some shed in China!. The chap in the Audi, did he ask if it was alright to stare at you?. The sign which says trespass on the site is a criminal offence is nonsense!, there may be other criminal offences related to unauthorised entry but trespass is a civil matter! never criminal, entry accompanied by actual damage to property, aggravated trespass is criminal in the damage part. The security man was better than most but he still is only telling you what he has been told to tell you!, it cannot be true!. I think it is quite funny that while they will arrest you if you take pictures or film them they can film you on their CCTV as much as they like!. The policeman does at least give your question some consideration and at least does not lie to you!, it would have been nice if he had come back to say he could not answer!. Cheers, Richard.

Discretion is the better part of valor.....The security guard and the cop both said it in a similar way, "We're asking you not too", "We prefer you didn't" if they knew it was illegal, I think they would have said something like "it's illegal and we will arrest you for it". I don't think they know either way. If I heard correctly, you said they had "radioactive" material in there so maybe it's a good idea not to film it, but if google earth is showing the place then you really couldn't reveal anything new right? Keep those vids coming Pete.
