Charge him with murder of a police officer. If you or I are in a group of people (say....driving down the road. Me and three buddies), pull into a convenience store and my three friends go inside, try to rob the place, and shoot the clerk, all of us would be charged with the murder of that clerk. Wouldn't matter that I was sitting in the car and not involved in the robbery or the shooting per se. He went to the Capitol building to as part of a violent insurrection. They broke into a federal building (felony). The crowd beat a cop to death with a fire extinguisher. They're all guilty of murder under the law.
