Relation between Law and Liberty

Liberty has two different meanings to understand. One is its negative meaning and the other is of its positive meaning. In terms of its negative meaning, we can define liberty as “The faculty of willing and the power of doing what has been willed, without influence from any other source, or from any other interference”. In this sense, we can say that liberty is the absence of any restraint. On the basis of this definition, we can also say that the freedom of one man becomes the unfreedom of all. Ultimately, this will result in conflict, and to avoid these conflicts laws have been made.
In terms of its positive meaning, Herbert Spencer has defined liberty as “Every man is free to do what he wills, provided he infringes not the equal freedom of any other man”. In this sense, liberty is the product of rights and duties.
There are various kinds of liberty. This includes Natural Liberty, Civil Liberty, Individual Liberty, Constitutional Liberty, Economic Liberty, Moral Liberty, Political Liberty, and National Liberty. Besides this, there are three aspects of liberty. First is Liberty of thought, second, Liberty of Speech, and the third is, Liberty of Action.
There is also a great relation between Law and Liberty. In this, we can say that law and liberty are opposed to each other. In the same way, law and liberty are necessary for each other. The explanation of these is given in the video.
There are various safeguards of liberty as well. This includes Law, Independence of Judiciary, Democracy, Fundamental Rights, Local Self-Governing Institutions, Rule of Law, Economic Liberty, and Eternal Vigilance.
