    If the logo is made of letters, like a circle with the LLC name inside it arranged in some way to look like a design and some other company has already registered their logo with almost similar or exact same design look but with different name/letters or using lines and circles, will that be considered as trademark infringement?

    I just found out that there is a business in another country that has almost the exact same name as me (they added “Company” at the end which is the only difference). We are both online retailers and I believe they ship their products to the U.S. Is this something that I should be worried about if they are not located here?

    Hello and thanks for the informative video! Unfortunately I was the dumb guy who never thought to trademark my restaurants name, which is "Shah's Kabob & Gyro", located in Colorado. I started as a food truck six years ago and eventually transitioned into a brick and mortar. Well the other day I was sent a letter from a law firm representing another restaurant with multiple locations on the east coast with the word "Shah's" in their business name. Apparently they had filed for a trade mark on the word "Shah" three days before we launched our food truck for business. Although we had created an llc and bought equipment almost a year before he submitted for a trademark, would that still not count as us being in business? I hope this make sense. My second question is, If I have to change the name, do you think "Shahz" would fly, basically replacing the "s" with a "z". Or do you believe that is too similar and he could go after me for that as well? I hope this all makes sense and I apologize for writing a book. Thank you so much!

    Hi Aiden! Thank you so much for this channel! You are such a huge blessing. My questions: Because one word is trademarked, does that mean that we can't use the word in a longer phrase? WORK ETHIC is trademarked for shirts. Does that mean we can't use the phrase PUT IN THE WORK ETHIC on a shirt? The word UNICORN is trademarked for clothing. Does that mean we are not allowed to use BE A UNICORN IN A FIELD OF HORSES on a shirt? Also, is it true that we can't use the trademarked word in descriptions and hashtags even though it's not on the product we are selling?

    Hey thanks for the video! I have a quick question. I formed an LLC for a business that I am starting, and submitted a DBA application (LLC name does not match the brand name I will use). If I want to apply for a standard character mark, do I just make the owner the LLC name, or do I need to wait for the DBA approval? I hope this question makes sense. Thank you for any help.

    You get immediate DBA approval if you pay for it. Unfortunately in Colorado they had a special going for a dollar you could sign up for a doing business as name so I bought eight of them. The thing is that it’s an automatic $20 a year renewal on each name if you cancel ahead of time it’s a $10 cancellation fee per name just so you know.

    Hello I'm a designer, I had a client who wants to trademarks both the logo icon and the typeface of the logo name which is a free font for commercial use. Can she trademark the typeface of the logo name?

    It is my understanding that it doesn’t matter which type face that you use or which color it’s the actual name that needs to be trademarked. You can use any color or font.

    Can you explain how it would work if you had 180 law co (legal services) vs 180 law (Land And Wagons - non legal services)? Is that still too close to confusingly similar?

    It is my understanding that if my business name is Divine Path LLC and I’m a Terrell card reader, who does energy readings and magic and hypnotherapy, but another business is doing Divine Path LLC but they are a real estate company, those are two different categories and they have a right to have Divine Path and so do I I was a trademark because we’re not in competition with each other but if there was a Divine Path, that did Rikki, That would be too similar because they maybe offer counseling services as well, and I would have a right to season desist them from operating. I would have no legal ground to tell the real estate company to stop using that name because they’re doing real estate and not energy services

    Can you explain what first use is in trademark and service mark? Will state registration help me argue first use as well as publishing my logo on clothing or a design website? How much are search fees using an attorney?

    @@TraciMoon You should register at the state level first. Especially if you don't have money to defend the mark on a national or international basis. The KZread lawyers want you to spend money you DON'T have. I can say that as a former lawyer. You get automatic protection from the federal court system once you start using it in business. The state is cheaper and easier to file. It will also start to create an official record until you are ready to file for federal.

    @@waynecmontgomery my business name Divine Path LLC is not as important as my actual name Traci Moon. I filed my logo under Divine Path LLC. What happens if I dissolve the Divine Path LLC and trademarked Traci Moon instead do I lose my trademark logo or can I transfer it to my new LLC? is it important to Constantly display Divine Path LLC on my website and my social media platforms

    @@TraciMoon You do NOT lose the trademark if you dissolve. You can contact the USPTO and have it reassigned to the new organization. There may be some new fees for this by the USPTO. This is why I recommend starting off at the state level before you move up to the feds. It's expensive and if you can't defend the trademark in court meaning pay a lawyer it's NO good to you. Most people do NOT have attorney fees for court battles. It's much easier to defend that claim in a small claims court or a state superior court than in a federal court. Don't let the lawyers trick you.

Do you think that even though I don’t have my LLC as Traci Moon I should go ahead and register Traci Moon X especially on the state level or does it have to be an LLC or do I register both or will it be confusing Which Mark I do business hours. I was contemplating dissolving the LLC and making it Traci Moon, Traci Moon LLC but I’ve done so much to build this business up and I’m pretty successful as Divine Path LLC so I guess I could register it I just don’t know which one I’m a little confused.
