    Brian can you make a video of how disqualification of trump works using amendment 14, section 3? I understand that states can do that, but how? And can people demanding a judge in a state that he must be disqualified? I know amendment 14, section 3 is already used to disqualify a januari 6 rioter.

It's a very nice cop out to just say "it's a sign of how broken our justice system is", because that way you don't have to have any real arguments, and you might still sound like you know what you're talking about. But you don't, you just say that the system is broken whenever it doesn't do exactly the thing you want it to do.

    He and his entire entourage should have been taken into custody the very second they found compartmented classified documents in his possession. They all should have been chained to the floors in individual cells with not but two buckets for furniture - One for water and the other for waste. Due process would have consisted of interrogations to determine who did what, when, and what they saw... AFTER they hadn't had anything to eat for 3 days. trump himself would have never saw the light of day again.

    How could trump possibly carry out the duties of a President .For a start he could never get a security clearance again.     Im a life-long Democrat 58 years old. I served my country in the US AIR FORCE and always obeyed the law. We now have a ( DRAFT DODGING ) former president being allowed to avoid pre trial detention, afraid of repercussions for doing so. This is the same as not enforcing the law , they didn't have trouble holding Gotti before his trial .

    OMG!!! This interview has given me hope for this country. For so long, I have felt as if I was in some crazy, bizarre dream of horror and that possibly I was the crazy one not to see how wrong the Republicans have been in their attempts to overthrow democracy and the well-being of this country. Seeing two normal adults discuss this way in such an intelligent conversation is refreshing. It, in turn, gives me hope that all is not lost and that crazy is just that crazy and will not become routine. For a second, I was worried.

    Why is pre-trial confinement a "massive step"? When a defendant violates the terms of their release, they go to jail. Period. The only "massive" issue here is that our justice system continues to pander to Donald Trump instead of enforcing our laws fairly and equally.

    That is a good question. Politicians and the judiciary seem to think that "pre-trial confinement" of Trump is almost beyond comprehension. I disagree because he is doing extreme damage to the judicial process right not because he is not confined. Part of his release agreements were to behave or face confinement, he is ignoring the agreements completely. He must face consequences. Right now he is again getting away with running roughshod over the judiciary.

    Many Constitutional scholars, lawyers, and judges are saying that the Constitution automatically disqualifies Trump from running for office in the 14th Amendment Section 3. People like Laurence Tribe, Judge Luttig, and the Federalist Society have put out information explaining why this is true.

    Trump needs to be dropped from the ballot as a presidential candidate at the state level. If states drop him (and even if some don't that's fine... we don't need 100% agreement with this) there would be no way he can win the 2024 election.

    Judges in all the cases need to uphold their own orders to ensure the integrity of the judicial process. Allowing Trump to continue to intimidate and tamper with witnesses, PUBLICLY, is just as bad as allowing him to commit crimes with impunity. Any other criminal defendant would be immediately detained until trial for blatantly violating the terms of their pre trial release conditions. Giving special treatment to Trump in spite of his actions is a stain on the credibility of our court system in general. He has to be held accountable.

    Well said! He’s making a mockery of not only our judicial system but all our government/state institutions. He’s snubbing the laws, acting as if he’s above them. But his threats to politicians, judges, prosecutors and American citizens, those who he would be sworn to protect as president, and did so when he was president, should be cause to detain him pending trial. It would set a precedent that our country is indeed a nation of laws and nobody is above them. Nobody!

    Historically being convicted of treason was one of the worst things you could be convicted of and usually had the most serious consequences. In medieval times it often got a sentence of being drawn and quartered instead of just getting the head lopped off. trumpy better think seriously about what is coming for him if he is convicted.     The last Republican to get my vote was George HW Bush. It was during his administration that I began to realize what Reagan had done to us, and I understood that The Grand Ol’ Party was being replaced by something that I just could not support.     Wow. This guy is a potential superstar of American politics. Tremendous clarity of thought, outstanding demeanor, and temperament, great grasp of political realities past and present, exceptional speaking skills, likeability off the charts, entirely averse to hyperbole and a deep understanding and respect for the institutions that guard our freedoms--at a time where such institutions are under unprecedented attack.
