I had a claims adjuster deny my claim because of a warning label. My claim was based on the packaging of a product. The owner of the company that manufactured the product emailed me to let me know he was going to get with his supplier of the cap of the product to get them to adjust the opening. This was before he sent the claim over to his insurance company and before any investigation and my claim was still denied.

Great explanations! Thank you. Do you have any on product liability when a company omits the entire contents of a product resulting in an allergic reaction? I can't seem to find much online.

In 1981 my sister was killed as a modified four-wheel drive vehicle broad-sided her car the truck that hit my sister had a heavy modified bumper some type of a brush guard and that is what is believed to have made the wreck so serious. I would like to see you explain the liability when someone modifies a factory vehicle to their likings today I see this on the roads regularly and I can't help but Wonder if these four-wheel drive trucks with these massive tires and bumpers are taking the liability on themselves or is it still the manufacturer who is liable for the modifications done to these vehicles if they cause a injury accident?.

hello if you or anyone out there can help me with a question, I am in canada and I am wondering what are my rights or entitlement if a product i was consuming may have damaged my teeth possibly in the past as a result of said product as this has happened a few times now with some food items ,do i have to be injured or prove my injury is a result of the product to have any case against the seller or the mfg of the product? or is it enough that the product has such defects for a case to be made for compensation for negligence, bad experience and for suffering mentally, punitive or otherwise?

If I understand correctly, all 3 defects must occur in order for there to be a product liability claim?

  • @Personalbarprep

No, any one defect is necessary.

  • @Personalbarprep

No, any one of these defects give rise to a products liability issue. In fact, on the exam, if you can identify several types of defects, default to the warning defect, if appropriate, because it is the easiest to establish liability.

here are 2 stories 1) Typical client payout for product liability is 8% 2) not a single lawyer would ever stand up in congress and try to stop any of these products being produced because these injuries produces millions of dollars for this industry every year.
