Prisoner kills cellmate because of his sexual orientation

Two days after his Madden's transfer, Burks was dead. On July 20th, approximately two hours before Burks' death, Madden had asked prison counselor Karen Prunick for a transfer to another cell.

    His responsibility was to let the CO’s know he has a problem, and it’s their responsibility to determine how the situation should be resolved. They chose not to act so every employee he told should be charged with criminal negligence at the very least.

    No. If you’ve ever worked in a prison then you would know that just moving cells isn’t as easy as that. If you do it for one person twenty more want to do it next. This man killed another man, that is his fault. Don’t act like prisoners are so entitled to what they want because they are not.     I was curious as to what Burks had been convicted of, found this: "Burks had been sentenced to prison in December 2016 for fleeing and eluding police and receiving stolen property, and was classified as level 4 security, according to the lawsuit." Allegedly other inmates and prison staff not only knew of Burks being gay, but also that Madden was homophobic, and both inmates requested to be separated. Dang...

    Actually no! Once an inmate makes a request or complaint like that they are usually immediately separated. They respondingbofficer whom revived the request/complaint is duty bound by law to ask the inmate. Do you feel as though you are a danger to yourself and or others? If the officer did not do this then the prison is at fault. However that would be looked over and rendered moot since the inmate will be judged sane and therefore able to stand trial. That brother is gonna die in prison.

    @@unclecreed2986 Doing anything to make it less comfortable (add more punishment) is unconstitutional in the USA, making the guards literally the more serious criminal. The punishment is removal from society. Some guard deciding to turn the heat down in winter to make people sick is illegal (sadly, they are almost never punished for shit like this. Only the very worst guards are brought down, by prisoners on occasion. And the prisoner who does so is making a huge sacrifice. He is usually tortured for doing so).

    The ultimate responsibility of this murder falls upon the killer. Stop blaming the prison. He said that he didn't like the guy and "wasn't into that," he didn't say that he was going to harm the guy so therefor it wasn't a dangerous threat. If he had threatened him then they have the responsibility to move him ASAP. Non-threatening moves can take a couple of hours to complete. You have to submit the moves for approval, check PREA scores and then notify the control center of the move. Then control center must double check everything. Moves have to be made at a non-restrictive time. Blame the idiot and stop making excuses for him. The "It's always someone else's fault," is a cop out.

    @@chegadesuade that’s not how jail or prison works they knew what they were doing. Races don’t even shower at the same times, gays don’t shower with straight people. Prison is not a progressive place it’s a place they lock people up in 4 by 7 foot cells. Guards know how things work, they were bored and wanted to see someone die. I’ve seen guards laugh when people commit suicide or watch as a mentally ill person who shouldn’t be in prison is making a fool of themselves and shitting on themselves. Prison is a sick place and it only functions barely with such rudimentary laws such as these no matter how crude it is it’s the guys fault for murder but guards are to blame for created a scenario that I guarantee they knew the outcome

    I’ve been in Prison in 2 separate states LA and TX. When you are roomed with a homosexual and they request to be moved. They are suppose to take that matter very seriously. Proper protocol is he should’ve never been allowed to go back in that cell once requesting to be moved. That Prison is at fault

They have their patrol time, they are monitoring etc, but you can't individually control hundreds of people without loosing them for a moment.     Thats nice that people want to blame a guard. Fact of the matter is that it is not policy in pretty much all prisons worldwide to grant single cells or transfers to another cell if cellmates dont like eachother. Few countries actually make an effort, but are often constricted by number of cells and amount of inmates. Bottom line is it costs money and few people give a shit. So those 50 that upvoted (many many more in all the comments) should consider what it is they want. If they want things like this not to happen, open your wallet. It certainly isnt going to lead to a prison guard being prosecuted or even reprimanded. Its policy and only if they have a strong indication it will lead to great harm will they do something in some western countries. In non western countries... not even worth mentioning.

    I hope robots will eventually replace prison officers. that way they can't be harmed and the prisoners can live without fear of dying. they need to do their time, they don't need to be tortured. robots won't be able to treat the prisoners inhumanely, they will have superior programming to not allow that.

    People need to remember you live within 2 feet of or celly usually 23 hours a day the institution should never house a gay person with a straight person I don't care if it's homophobic or not politically correct some people don't want to be around that crap and it should be their right not to have to be.     Murdering someone because they're gay is outlandish, but I also blame the prison for creating this horrible situation. They know damn well that this man would be in danger if you put him in a cell with a heterosexual man that does not want rumours of being gay, which can be potentially dangerous in an environment such as that. They know this, which is why there are often areas of the prison designated for gay men, because they are in potential danger of rape, etc...

But he did asked to be moved soooo we cant really say its his fault, he warned them 🤷🏼‍♂️ i dont have anything against gays but if i was inna cell and i didnt fw whatever the dude was on then I wouldn’t wanna be in there either.     The victim could’ve been simply effeminate and not gay at all; posing no sexual threat to him at all. And even if he were gay, who says he was going to make advances on the murderer? I hope the murderer heals if he’s in the right state of mind. But, who knows, he may suffer with all kinds of mental problems aside from possibly suffering with sexual orientation himself. Again, who knows! Just hope he eventually gets the help he needs.

The death penalty is a barbaric practice datinf all the way from the medieval days, Also it would keeo the defendant from justice by putting him out of his misery and not having to live with the fact that he killed a man. The problem with the US is that we waste taxes on inmates every year because its all avout punishment when the system should be based on "rehabilitation". Germany and other countries in the EU have a justice system based on "rehabilitation" instead of punishment and they have a better success at it when we do. All because republicans want us to waste taxes and so the prison system and even the private prisons can make their millions. We gotta stop thinking out of feelings and start thinking with our brains.

    Ppl dont want to be in a cell with someone else continuously.... If you believe ppl should not be forced to be locked up with someone 24/7 bc it will lead to problems, you should advokate for single cells. How long does it take for a loving married couple to be in eachothers hair you think, if they are locked up in a small room 24/7 ? I rest my case.

    They have to take responsibility for this too, that young man may still be alive if they had just moved the other man. I know prison isn’t comfortable but they still have an obligation to protect the prisoners, and they failed.

This includes race, sexual orientation, gang affiliation, etc. This is to preemptively reduce instances such as the case in the video. The system failed. You are wrong here.

    That's total negligence. Dude asked to be moved,he don't want to live with gay dude. I hope there are details with everything Did he speak up enough prior,did he give cops reasonable time to move into a different cell. Did he let his stance known and the severity of his feeling. A jail isn't a place for favoritism,BUT they usually have different cells for the gay population. So sad .
