I had a suit where I was asked by my attorney to allow recording of the conversation for him to go back and transcript what we discussed, and my deposition was also recorded. As long as the client knew they were being recorded, there is no issue of taking a recording of a conversation. However, Cohen is breaking client-attorney privilege by keeping and sharing said conversation. He should have his licenses in all areas of law revoked and should be penalized for divulging such, and he is now also liable for possible slander, and additional suit or penalty of breaking the law, where he may serve additional time.
