    There’s an update on this story: Luke posted on Instagram that he wasn’t aware of the lawsuit and he is dropping everything and not only giving her the money back but helping her by selling tumblers for her. He is being VERY generous given the fact that she indeed broke the law but that’s one reason his fans love him.

But what irks me about this is that they never go after the people who breach copyright infringements when selling edibles such as cakes. They're the one making a killing from Disney, etc. products without licenses.

    Amazon allowed the listing because it is clearly stated in their terms that it is the responsibility of the seller to ensure that all laws are followed regarding intellectual properties. Amazon doesn't have the time to check every single item on their site to ensure that sellers have procured the proper licensing.

If she made tumblers with her name on it, how many would she sell? She knows what she did and figured she wouldn’t get caught there’s so much bootlegged branded stuff everywhere. She was wrong.     Not totally true. Most those people on Etsy and Amazon doing that live in China and some other countries. It’s NOT against the law to steal copyrighted things in China. Thats why if you invent something don’t let Walmart carry the product. They will ship it to China and have them copy it and start buying it from them. It’s actually well documented

    She should have known that she was in the wrong. However, notice of the email notice service isn't the best way to serve someone. Especially when it looks like anyone can take anyone to court federally and be in default with a default judgment against them because of not realizing that there was just a notification email rather than an in-person service.

    There are tons of things people dont research deep enough when wanting to sell for Amazon. I went through their rules and regulations with a fine tooth comb and decided there's far too many rules to work for them. 90% of people NEVER read rules, guidelines, regulations, etc.etc. That's why many people in this online world end up in a whole lotta trouble with their small businesses. As my parents told me and theirs told them..."Reading is knowledge". Without it, you remain ignorant of too many things in our world.

    Exactly! That's why "In Person Service" was required by the Courts in the first place. In most jurisdictions, the defendant's failure to advise the Court that he/she intends to defend within a certain number of days before the trial, releases the Plaintiff from having to appear and the judge just enters a default judgment against the defendant on the day of the trial. It's a crappy mess in most states -- mainly because the original Courts that set things up "the old way" are gone and the little black-robed punks and punk lawyers that took over have NO CONCEPT of why the Rules of Civil Procedure were made in the first place. So, when they find a Rule "troublesome," they get the Rules Committee of the State's Supreme Court to change the Rule. And why do the Supreme Court Justices do it? Because they, too are little black=robed punks with law degrees who neither understand, nor want to understand why the Rules were written that way by a bunch of LEARNED Lawyers (who were still taught Latin in Law School). I added the Latin part because it was fun to watch today's punk-assed lawyers trying a case in front of an "Old Timer" judge against an "Old Timer" lawyer. They'd know the meanings behind all those Latin terms in the law. Newbie Punk-boy had to keep looking them up throughout the argument.

    The people in the photo won't be sued, it's the company that took the photos and made a profit from them. A company should have purchased the themed stock from the appropriate company which includes written permission to use. Do things the right way.

    And this only applies to paid shoots. If you’re not paid for the gig, and can prove you weren’t paid, then you’re fine. That goes for any trademarked/copyrighted character out there. One of the first things that was covered when I was in school for photography.

I am a graphic designer and the photographer, designer, etc owns all of their works and maintains copyright, the contract between the client and the photographer is what lays out what the client can and cannot do with the copyrighted images.     Xavier Roberts sends cease and desist letters when any crafters try to make and sell soft sculpture Cabbage Patch Dolls in the likeness of "his" creations (which ironically he stole the idea for Cabbage Patch Dolls from a woman at a local fair and then marketed it as his own). But that's the thing, he sends letters as a warning first, not automatically blindsiding the crafter with a judge and a ruling in his favor.

She painted Disney characters on her wall. She must have posted a picture or something because they found out and put her out of business.

    Far too many "artists" violate likeness and copyright laws then whine and cry when they get caught. Fact is they're avoiding the costs involved in getting rights of use in hopes that they don't get caught. I've had my material stolen and it angered me how another "artist" could be so lazy and disrespectful. Artists know there are laws. It's likely she knew the risk. Are the photos of Luke Combs her own, or did she steal those too? How many other items has she sold and not been called out for similar violations?

    You would think they would have someone serve her with documents outlining the lawsuit rather than some email that went into her spam folder. I check my spam folder about once a month. A $250k lawsuit and they couldn’t pay a person to hand her the hard copy documents in person proving she received it? Seems pretty shltty on their part to me.

Even if it's not a legal requirement, serving important documents in person is just a good move. And if you're interested, it turns out that some random lawyer jumped on this and immediately took it to step 5 while completely skipping steps 1 to 4. Luke himself insisted that the suit get dropped, she got her money back and he's helping her sell her merchandise. Shifty, overzealous, rule crazy lawyers are still a plague on the legal system. Next week I'll tell you about the time Richard Bachmann's lawyers sued Stephen king for copyright infringement not even realizing that they are the same person. Stephen king is Richard bachman.

    She could use any assortment of free-license and hand-created images for her tumblers without specifically using his personal image, hard work creating his 'brand', and efforts to make his living from that, for her own marketing gain. Anybody would question the ethics of this if they were the person someone else is making bank on, with you not seeing any compensation. That being said, this lawsuit was incredibly disproportionate considering the offense. Good on him for rectifying the situation. I hope other self-employed folks take heed and respect legal rights and moral boundaries after learning this.

    Disney issues cease and desist notices and automatic takedowns of storefronts. They don’t just unilaterally sue minuscule third party vendors for exorbitant sums of money just for selling copyrighted merch. What Luke Combs’ legal team/record company did was needlessly cruel, greedy and terrible PR that may end up costing them far more than $250K down the line.

    Based on the merchandise they showed in the intro she better revamp her entire store or she is going to have a lot more lawsuits in her future. It looked like it was all based on copywrite material. Some people just don't understand copywrite law...some people do and just don't care and would rather ask for forgiveness than permission (+ outrageous licensing fees). $250k in fines without a warning to stop selling the product is ridiculous. And the fact that the law doesn't require her to be served in person is just arsenene.

    I'm dumbfounded by your lack of sympathy by saying "crocodile tears". Yes, one should ABSOLUTELY be aware of copyright laws and the consequences of not following them.     Incase you didn't know Luke Combs responded to the story with an Instagram video where he explained he found out about it after the news broke. "I spent the last two hours trying to make this right, trying to figure out what's going on because I was completely, and utterly unaware of this," he said in front of a screen capture of news anchors discussing the lawsuit. Combs said there is a company response for going after "only, supposedly" corporations making counterfeit items for millions of dollars. "And apparently this woman, Nicole, has somehow gotten wrapped into that," he said. "And that makes me absolutely sick to my stomach." What is Luke Combs doing about the lawsuit against the Florida woman? Combs said that after speaking to Harness, he apologized to her and pledged to double the money locked in her Amazon account, which would be $11,000. He also said he would be releasing his own tumbler for sale Wednesday, with all proceeds going to pay for Harness' medical bills. "This is not something that I would ever do, this not the kind of person I am," Combs said. "I'm not greedy in any way, shape or form. Money is the last thing on my mind. I promise you guys that." Combs also said he would be flying Harness and her family out to one of his shows this year for a hug and an apology in person.

    Common sense says, maybe i shouldn’t attempt to profit from COMBS face with out ASKING HIM! Also common sense says ask HIM to drop the suit, not a cold hearted money grabbing attorney and certainly not the judge. Find a way to get directly to Combs. Behnken can do that and Behnken should do that.

    They don't sell albums pshhh glad I am into underground metal and rock bands that you may never heard of but plently have enough people per to say for them to be able to travel from Japan all the way to various parts of South America and guess what these bands all sell CD's & record albums as well so I am y their are musicians out here still selling such merchandise

    I saw a video about a woman having her whole esty store shut down for the same kind of crap. She just kept trying things thinking they would fall outside of a copyright and after several times of getting a copyright hit for trying to put parts of song lyrics on hoodies they shut her down. She kept saying the same crap about not understanding how all those things were getting strikes. Since these people can't seem to realize why it is illegal to sell the stuff good luck with them having a clue about how to legally sell the stuff. Maybe these companies that have the copyright to these artist should run a campaign of informing people on how they can legally sell the stuff. Even this news story could have included how to legally sell the stuff.

    Why do people pretend to cry in an attempt to receive sympathy over something they did wrong? For 1, she didn't have even one tear in her eye or even on her face For 2, she said she didn't have enough money to pay her bills, that's why she was selling the tumblers, yet she had over $5,000 in her amazon account alone!?! If she has money like that just sitting in an account, she isn't hurting to pay bills! Seems to me she is just trying to get herself out of being held responsible for her actions by pulling the "pity me" card. I wish i had $5000 just sitting in an account somewhere! I could sure use it at this point to pay MY bills! 😔

    One commenter said she didn’t even shed one tear therefore she’s not remorse. WHAT THE IS WRONG WITH YOU PEOPLE? How one grieves or sheds a tear is NO indication how they feel. The same if you see a couple walking hand in hand and are lovey dovey and behind closed doors it’s an abusive relationship. Not just in this case, but I see people are rushed to judge but never see their actions. Thank God HE is the final judge because leave it to people we are in trouble!

    She did break the law by selling unlicensed merch featuring his intellectual property. At the same time, the idea that someone can be served by email, not even know it, and be found guilty before they discover anything is wrong, is an outrageous abuse of the legal process. It's abhorrent that any legal authority can consider this even remotely appropriate process of law. This is kangaroo court level insanity and it needs to stop immediately. Also, clearly Combs didn't know about it, because the potential PR damage of a case like this would never be worth the hassle. Whoever filed the suit on his behalf should be fired for being an abject moron and not understanding the most basic notions of public relations. His legal representatives in this case could have cost him millions in bad PR. Thankfully the man is a decent guy and no doubt regrets this. I hope he has fired that legal representative and replaced them with someone who has an IQ above 70.

    Under copyright laws, it is illegal to sell any type of material that is under copyright without contracted agreement with the copyright holder and or their agent.
