Philip Murgor vs Justice Majanja - Heated exchange at JSC interview
Kenya Chief Justice interviews by Judicial Service Commission today at Supreme Court Grounds saw Philip Murgor answer tough questions from Hon Justice David Majanja.
Lawyer Murgor seemed to be displeased with the questions he was asked by Justice Majanja.
JSC Secretary Anne Amadi had said that the process will take two weeks.
Prof Olive Mugenda is chairing the interviews.
DCJ Philomena Mwilu is also present.
CJ Maraga succession is expected to draw a lot of reactions.

Too bad, however good we ask the questions and however how well or bad the presidential candidates answer their performance in the interviews never really determine as they are elective positions and the electorate is full of fools in the majority, all driven by the political current waves and how well the candidate can drive crowds with lies. You cannot depend on the electorate to give us a good president. We can only hope that the one they give us ends up good. And then tupambane na yeye hapa kwa hapa during his leadership.

Justice Majanja doesn't want to be understood ,he wants to prove a point : He wants an outcome where by his questions have not been satisfactorily answered by Mr Mugor .That's what he wants ,not for us to draw unique qualities that are useful for a CJ position .If an interviewer understands meaning then he should ask questions in a clear and coherent manner .Mr Majanja only serves to harass candidates for no value in terms getting the right qualities for the CJ candidature .Very disappointing ... This is the foolish part of education when it cannot be used to help the listeners ....His questions are outrightly misplaced

He was just not liked at all by some of the Commissioners.
Hon Majanja started foretelling events in 2024 at the end.
You are not sure of what you wanted to say !
Why didn't Justice Majaja apply for this seat. To me majaja is the most qualified for this one.

very true.
The principle that the court drew from the constitution from Francis Muruatetu case I think, and I would have answered as safeguarding the right to life.. In the doctrine of avoidance, the question being it's importance or how the courts have used it to safeguard the constitution, I would have answered as maintaining the law. Meaning, the court does not review things that are written down in law. The burden of proof in Election petitions obviously is above 'balance of probability' but below reasonable doubt'

Philip Murgor is highly deficient. I am quite surpised at how little he seems to know. I expected much better from him. I am not a lawyer but some of these issues seem like common sense. Like the question of delinquent bank mortgage or the government demolishing the squatters' housing on public land. The couple (Peter and Mary, & children) or the squatters do not have the right to the house/land as they do not own the property. They occupying the house/land infringes on the rights of the bank/government to property. One's rights end the moment they infringe upon the rights of another party. Thus, the bank/government have the right to, and should, evict the married couple/squatters. The squatters are on the land illegally. The married couple have breached the mortgage contract.

That's true, and well explained. The law is very clear. One doesn't need a law degree to know that.
