Don’t ya just love it when the tow guy shows up and the driver of the car/truck/trailer right off starts telling him just how everything should be done. Ever watch “everything auto”? Jeff gets this fairly often even when there’s some precarious situations in the Smokey mountains. Nobody knows better than him how to handle things but the customer sometimes has to give him advice. Then they cause issues with the previous owner of the car that got towed bcs they were wondering why their car got towed and the other car didn't. That's why they came over and started complaining. I hope there's a follow up on this one. Wow, it was REALLY hard to miss the conceited attitude coming from that cop. He made up his mind that he was right, before you even finished your side. IMO, if he would have handled that with a better attitude, right or wrong, it wouldn't have left such a bad impression. I think SOME cops need to work on their "car-side" manner, in these times we're living in. As per usual, YOU were completely professional! 💯!

In the cop's defense though, this is one of the times Johnny's communication slipped up. He repeated himself, then demanded a sergeant, which happens to be the entitlement routine cops hear 2-3 times a week every week. As a result "We back our colleagues and don't change our mind if they go entitled" becomes an embedded routine. It would've been easier to simply start the tow, wait for the guy to attack and then you've got something no sane cop will stay absent from.

Cop is confused, and the other cop likely taught him inaccurate police duties and interpretation of the law. Police responsibility here is to maintain public order by allowing the proper authority to tow the car. The property manager is the authority and has the right to enforce the association rules. Private residence living in a community agree to abide by the HOA rules and regulations. Furthermore, the police lecture about ‘civil matter’ should have been conveyed to the car owner as recourse to redress the matter with the courts.

You're right. The manager can decide what to tow. What the officer is saying is that it is a civil issue. They cannot get involved. If you try to tow it and a fight breaks out then they can get involved. The officers are not telling her what she can and can't tow. I am a police officer and we have no authority to make either party do anything. All that officer is saying is you can do your job and they can try and stop you. That's everyone's right. But law enforcement cannot get involved unless there is a crime. We cannot enforce or take action on civil matters. It violates people's rights. Law enforcement does not enforce private property "rules". Only statutes and laws. Hope that helps. Love your channel. Watch it almost every day.

The manager is saying otherwise. It's not a criminal matter, it's a civil matter, meaning there's no criminal law to enforce. The cop was right. They cannot force the owner of the vehicle to relinquish it since they are allowed to be there by the resident.

@@johnhaller5851 The problem here seems to be that if the police is unwilling to assist in getting this car impounded, then what is the property owner to do. I mean, the police is a government entity, and there is another government entity that says that it is illegal for them to have uninsured, broken down, not taxed cars on property. So in essense, 5 minutes after this video ended, the city could inspect the premises and write them up for not enforcing code. The easiest way to deal with this now, is to wait a few hours and have a snatch truck drive up, snatch the car and drive off. If set up and prepared properly, it should not take more than 30 seconds to get the front wheels of the ground and the car rolling. If the snatch truck has the wheels of the ground, and the guy is obstructing the tow truck driver, then the police is forced to intervene.

@@JohnDoe-bd5sz I think the police were treating this like an eviction. Evictions don't happen without a court order. I don't know Georgia towing law, but the cops will be in less trouble if they don't enforce a towing law than if they injure the owner of the car while keeping him away from a towing operation. A no trespassing order by the manager might have been more effective, but it still gets confusing over who controls a leased property, and probably not something the cops want to sort out, as that driveway is likely part of the lease, unlike an apartment complex, where the parking lot is not leased exclusively to anyone. Even the code compliance problem may need to be handled by an eviction rather than the police. Once the trailer park controls the property via eviction, they can enforce no-trespassing orders. If the trailer park decided to get a snatch truck, and a court determined this was a partial eviction by self-help, the trailer park management would have been in trouble. In my mind, the best way for the trailer park management to handle this would be to have notified the person leasing the lot that they were in violation of the lease, and that they have 30 days to correct, or eviction would be started. I'm sure they could get a delay on enforcement from code compliance if they showed they were working on the problem.
