Hi Nitin, going by October Visa bulletin the EB visa apart from EB1 and EB5 which are current the rest are still in backlog for green card. People who are in H1b are still have to wait a decade for their date to become current. Should Indians come for PhD in US if they want to settle in US? Please advise.

IMO second lottery is highly probable , not sure about third.

Hello Mr Nitin, please let me know one thing - I am in currently in India. My last approved visa (I797) expired on year 2019. I stayed in the USA for 2 years. Can I utilize my remaining years of H1B limit by H1B transfer or do I need a fresh H1B by new lottery?

You can only transfer H1 when its active. Thats my understanding. If it has expired then you need new lottery.

There is no age restriction . For phds there is a diff process for h1 , you surely get it faster than others

Thank you for the informative video. I have 2 questions: 1. Regarding 'Option 4 - F1 OPT to H4 EAD', if spouse already has i-140 approved, can they apply for H4 COS and H4 EAD applications at the same time together? 2. If H4 EAD gets approved before F1 OPT expiry date there won't be any gap in working, right? Please let me know if my understanding is incorrect.

though COS and EAD applications can be done at same time ,EAD does not kick in until COS is approved.
