As a guitarist I love the way he's keeping his pinky and ring finger on the 3rd fret of the 1st and 2nd string. Never seen it played like that but it adds a unique sound into the guitar.

It makes it incorrect though. It means missing out the hammer on to the cadd9 and playing the wrong d chord. Doesn't sound right.
