what do you mean by proforma defendant ?
whenever defendant has a conflict of interest with the co-defendant & that defendant ought to have been a c0- plaintiff, such defendant would be called pro forma defendant. he is made a pro forma defendant as he was unwilling to become a co-plaintiff normally such defendant will be transposed to the position of a co-plaintiff.

Mam, I have filed a case against a doctor who took 80k for correction of asymmetry caused by previous surgery in my lips. Oppostite parties have filed their version in which they mentioned complainant is bad in non joinder of parties. Will my chance of winning be less because I skipped the previous doctor who done surgery and made it asymmetical.I have raised a complaint for deficiency in service provided by the second doctor as he took a huge amount for the correction surgery. First doctor had not any role in the service for 80k as the two surgeries were in different time, place and the payment was also separate.is there any chance of dismissal of my case. Can any amendment be made in the complaint in this stage (next is evidence of complainant ).
