    Gina Miller represents everything I voted against. I want to leave the E.U. If the government won’t obey the will of the people, then why should the people obey the rules of government. The contract is being broken. Think about that.

    Is that the star of India. Good God, this kind of ignorance is what i'm getting tired of since Brexit, by having that you are harking back to the time when the British empire killed 60 million people in famines, you are honouring a government that taxed people into oblivion just because they had brown skin. You are honouring an empire that abused its power to spread racism and hatred across the world. "BUT WAIT WE GAVE THEM RAILWAYS! AND CRIKET!" That line of argument is absurd, we had railways so we could more efficiently drain resources from India like a vampire. Would you really like to go back to the time when the empire existed, well maybe you would so you could get carried around by the Indian people and not have to use your legs. Its also not a question of obeying the people, they will be obeyed, but it isn't the will of the people and current polls indicate that if there were another referendum today then it would be a landslide for remain. If you aren't so scared of democracy then call for another referendum, or accept that we need to remain in the single market, with only a 2% for leave, there are surely at least 2% of leavers who wanted us to pursue a Norway deal, and keep the single market. Not only that but just by indicating we'll leave the single market the pound has slipped to its lowest level since the 1970s! What we need is a soft brexit which respects the overall view of the people and not a hard, racist, anti-immigration brexit which ignores the majority of the people. Its also ironic that the very people arguing for Parliamentary sovereignty are all of a sudden so scared by it. You are all a bunch of uneducated children. Get away from mummy's computer.

    A 52% vote in a referendum doesn't give the government power to do anything it wants. We need another referendum to decide whether we should leave the EU but stay in the single market, or leave the EU AND the single market. Parliament also needs to probe over the costs of the various options.

    Mmmm, yes, let's have another referendum for freedom of movement too. OH, AND ANOTHER ONE FOR THE EUROPEAN SOCIAL FUND. We can't have a referendum for everything. I place my faith in the elected MPs and the Prime Minister to deliver us the best deal...if any deal at all. Personally, I'm not too keen on staying in the single market.

    Ad-visory. Ad-vis-ory. Aaaad-viii-sory. Is it sinking in yet? The fact that Cameron quit rather than go down to the bunker and give his service revolver a blow-job by signing Article 50 before resigning should tell you that this was nothing more than a huge political gamble taken by someone that had nothing to lose, irrespective of the outcome. It doesn't matter if it was one way round or another. Or if I accepted it or not. It is down to legal process. Nice try with the ad-hom btw. Democracy only works when the populace are capable of rational, critical thinking with well informed and thoroughly researched facts and concepts. Clearly this is not the case. Enjoy your Brexit.

    Parliament still has to repeal the 1972 European Communities Act that was the whole point of the courts ruling. Its a constitutional issue now. If the royal prerogative is used to repeal statute its means we effectively live in a dictatorship. Its staggering how few people actually understand how our country works.

    Her case has seen the judiciary grant more power to MP's - people actually voted for by British people, who will now get a say in the Brexit terms that affect everyone. The alternative was letting Theresa May do whatever the hell she liked... an unelected Prime Minister heading a government without a confident majority, whose previous leader swanned off as soon as he messed the country up. She's brought about the first bit of common sense seen in the UK since June. By coincidence, the value of the pound went up (fractionally) for one of the first times since then too. It's almost as if the whole world is saying she might be onto something.

    +Josh Let's just hope that all this legal mumbo jumbo isn't just a sophisticated back-door way of 're-running' the referendum, this time by giving it to MP's to decide. Anyway, you are right of course that a parliamentary process has to apply - May can't just have absolute power, our system doesn't work like that and I don't think anyone including May was suggesting otherwise. It's just this referendum 2.0 by-another-name that bothers me. That would make such a joke of British democracy it's just not funny.

What do you think Farrage is? what do you think Boris is? what do you think billionaire Rupert Murdoch is? what do you think Lord Rothmere and the Barclay twins are? It is admirable and refreshing that people are starting to realise that we are bring consistently fucked by the elite class who control our entire political system for their own benefit, but unfortunately you have an incorrect conception of who these elites are and what they want. they want trade deals, trade deals like the TTP and CETA that break down borders so that they can take advantage of cheap labour and lax regulation outside of the EU, they want a new arbitration system where large corporations can sue the Govt for damaging their profits with laws we voted for, they want to take more of your tax money and give it to themselves in tax breaks - they are not trying to keep us in the EU. it's great that people are waking up, but if you get your information from the daily mail and the sun then you're just as blind to reality as you've ever been.

    I live with News chanells on in the back ground..........by a margin the vast majority of the media and political elite and the rich voted to remain. For businessmen the reason is obviously that they dont like uncertainty and also that if they are doing well now why would they want change. The vote to leave was a vote for change and the Rich generally dont want change. The Media is all based in london and thats represented by the bias way in which they project leave voters as being thick and xenophobic. Unfortunately now that project has back fired because its been broadcast to countries like Poland and Slovakia who will have a direct say in the EU deal we can agree

    I am quite aware that she is of Indian descent and she grew up in a British colony, now is married to an Englishman. When the British Army invaded various colonies and exploited their wealth, you guys did not anticipate that some of the natives could colonize England back.     According to my search of the document itself, the referendum act doesn't contain the word "Advisory." I believe (I've heard it said) this was in the briefing notes.

    Referenda are not binding in UK Constitutional Law because an Act of Parliament trumps everything (prior to the acceptance that EU legislation could be regarded as domestic laws). Parliament can't bind future Parliaments (by that I mean a future Parliament's right to repeal or overturn the Act creating the Referendum cannot be legislated for) so the Act didn't need to state that the Referendum was Advisory, as it just is Advisory. The politicians said they would abide by the decision, but that is a Policy, and so say Theresa May had really been against Brexit, Cameron saying he would have been bound by the decision would have had no consequence on May legally. Of course, politically she might have been hounded out of office if she'd dismissed the result, but that would have been political.

    The UK constitution - is mostly unwritten, in other words, absent. The bit about the rights of Parliament is in the Bill of Rights and yet the government can also do stuff on its own with the Royal Prerogative (with the PM), and as the elected government. The Queen is Sovereign and no act of parliament becomes law until it has Royal Assent. The sovereignty that Parliament has is actually called the "Queen in Parliament." Given all this I suspect that this judgement may not be as clear cut as some are making out. In the USA, they have a written, i.e. existing constitution, and it starts "We, the people." I think they've got it right.

    Jonathan Warner The UK does not have an unwritten so absent constitution. It has an uncodified Constitution. The Queen does not hold the balance of power. The Judicial Paradigm says "Parliament is Sovereign". So until you get the Judges to say that Parliament isn't Sovereign they will continue to hold that Parliament needs to be involved in the process. The USA Constitution is very old fashioned. There are a myriad of better examples you could have given that rest sovereign with the people. But again, that means actually nothing because legislation always needs a process to go through, we don't decide everything on the basis of a straw poll. Royal Prerogative is getting a weird airing at the moment, and I don't know why. The powers of the PM are clear. This particular PM lacks an electoral mandate for any of the substantive issues she is aiming to negotiate with the EU on because her party fought the General Election on the UK remaining in the EU. So it stands to reason that the best thing she can do is plug that deficit with getting MPs to engage with people and ask them "free movement? Good or bad?" "Single market? In Norwegian style or not?" These are not things she can just magic up out of her own head and then impose it on others

    The world needs to move past Adolf Hitler and the Nazi's. what Hitler, the German Chancellor AND DICTATOR (unelected and unaccountable, like the EU politicians) and his party The National SOCIALIST'S (like the EU politicians) did to the Jews, the disabled, homosexuals, gypsies, and others was horrific but the constant comparing of people to them stifles intelligent debate on important matters and needs to stop. The EU is a disaster and is leading the masses into poverty, oppression, war, and, I and many others believe, genocide. No-one is permitted to oppose it without being accused of fascism. Many British MP's, in all three main parties, do hate Britain, do hate the British people, and do want these things to cease to exist. They should admit as such openly. Let them form an I Hate Britain Pro-EU Party and stand for election openly on that platform instead of hiding in other parties, seeking to deceive. We need a Pro-EU Party and a Pro-Britain Party then, whilst they still have the right, the public can vote for for politicians who are actually honest about what they stand for.

It seemed that the UK won when non-Catholics in Northern Ireland voted to stay as part of the UK. Sometimes to win is to lose. Brexit could have been done cleanly if Northern Ireland were not part of the UK at this moment. And now the UK is facing the possibility of losses of both Northern Ireland and Scotland because of this messy Brexit. The cause and effect have been too complicated to understand and are usually revealed after a long time of history. France colonized many African countries and now Africans are colonizing France back. Vietnam won the war with the US at a huge cost and now what? VN is losing to China while beckoning for US help. Again, to win is to lose sometimes...Given the complicated history of Brexit, it is not fair to blame Gina Miller. And why don't you blame the barber/hairdresser who partially funded her case too? And blame John Major. He is white, British-born, and an ex Prime Minister who is in the same party as Boris Johnson who is partially Turkish/Muslim.

    Like Nigel Farage I do not believe in Parliamentary Sovereignty. We should have referendums on all issues so that power is in the hands of the people.
