Around 2005 I was convicted of Domestic violence Misdemeanor battery. In California it was only a 10 year band, but I fell into the Lautenberg amendment and was issued a federal lifetime ban. After watching this channel I called a local gun rights attorney and he told me I should be good in my case, but there’s a couple caveats to the domestic battery misdemeanor. It has to be a girlfriend, to qualify for this change in the federal ban. A charge involving a current or former spouse or mother of child disqualifies from the laughtenburg amendment change . And also no more than one of these charges . I went to buy a gun , we’ll see what happens . I check back and give you guys an update on what happens .

In Texas this gives me my rights back. I did this on my channel I have several people in contacts with lawyers are to confirm but yes anyone who is in a state that gives rights back you can in fact own a fire arm

I agree. An offender who has a conviction from 10 years ago is banned, but someone can go out and catch that same charge tomm and only lose rights for five years. Makes no sense.

So if it isn't retroactive why is it being perceived that it is and why would you have to wait 5 years if this is the first and only time that you've had a DV misdemeanor which is over 20 years ago?

I don't see where it would be perceived as being retroactive, but I could definitely see where a person may think that it is or could be. So basically, People with old DV charges are stuck with the lifetime ban until this amendment is struck down in the Supreme Court, while new DV offenders can offend and only get a 5 year ban. Doesn't make sense to me either, but hey!

If you actually read the bill it says the amendments made in subsection A (closing dating partner loophole) are not retroactive. The part about the 5 year ban is in subsection C and actually changes the existing code. It applies to all charges past and present according to the actual text of the bill. Also only applies to dating relationships no exemption for spouses or child’s parents etc

Nothing because the bill isn’t retroactive. We’ll have to wait until the Supreme Court overturns this amendment as unconstitutional, which it is. However, you do have defense alternatives…

Yea, they'll do that over a domestic. Until this Lautenberg Amendment is turned over in the supreme court, they'll keep doing this to people. In Virginia, you're ok to carry black powder antique firearms. I can send you more info on that if you'd like.

The part about the 5 year ban is in subsection C and actually changes the existing code. According to the text of the bill it applies to both past and present charges for the 5 year exemption I’ve talked to a few lawyers about this myself too. Be aware this exemption only applies to dating relationships. If it happened against a spouse, living partner, or child’s parent you are SOL regardless of past present or future charges this won’t help you.

It’s odd because new offenders will get their 2A rights back after 5 years. Meanwhile, offenders that have been clean for twenty years are treated worse than a felon.

5 years after conviction or completion of supervision according to the ATF. Consult with an attorney in your state to go over the language of the document just to be sure.

The 5 year thing is only for boyfriend/ girlfriend DATING situations It's a step in the right direction, but I kind of find it unfair overall. It should be 5 years for everyone, regardless.
