'Muslim Women Can Seek Maintenance From Husband After Divorce': Supreme Court
The Supreme Court, in a ruling on Wednesday, said that a divorced Muslim woman has the right to petition for maintenance from her husband under Section 125 of the Criminal Procedure Code (CrPC). Justices BV Nagarathna and Augustine George Masih, who issued concurrent judgments, were part of the division bench.
The court further ruled that if a Muslim woman obtains a divorce while her application under Section 125 CrPC is still pending, she can then seek relief under the Muslim Women (Protection of Rights on Marriage) Act 2019.
