    Interestingly this is not a Constitutional right in Australia, just in State and Federal Criminal Laws which can be amended by Parliament

    No one.. on this earth.. has the right to force you to speak to them. Period. You were born on this relm without a choice. And that does not give anyone, especially police, the right to hinder you in your private life. If you are causing harm, then by all means they can try stop you. Lol You could murder someone and still not have to talk to the police. But They have no moral right to stop you in your tracks and forcibly ask you questions and then threaten you with fines if you CHOOSE not to answer. I don't know why people dont get this? They're meant to work for us

    Constitution or not, you can never be compelled to talk to anyone. Hence when being read your rights, one of them is always some variation on "you have the right to remain silent". It's an inaliable, unequivocal RIGHT that everyone has from birth.

    That sounds smart, but isn't helpful. Police ask a ton of questions regardless if they have all the information or have no information at all. They want to lock you in to an established story so they can use evidence to contradict you in court. This happens regardless of what amount of information they already have. Best thing to do is say nothing and imply nothing, get a lawyer.

    Of course we don't. We have the RIGHT to remain silent. Everybody does. Nobody can compel you to talk to them, or answer questions, or otherwise make you incriminate yourself.

    Only if they have reasonable belief an offence has been committed. If not, they can still ask but can't do anything if told No. Being at home doesn't magically absolve you of all that.

    Only if they reasonably believe that he has committed, is committing or has witnessed a crime being committed. If a cop just walks up to you and asks for your name and address the correct answer is to tell them to fuck off.

    No one should ever answer questions from the police. Every word can be used against you but none can ever help you. The law is utterly unconcerned with what really happened. Only that police and the courts can hang whatever crime on SOMEONE.

    @@Snoop3x Then we are not living in a civilized society. Any place, where as much as one fifth of its incarcerated population have committed no crime, cannot be considered civilized. You may think you are doing your civic duty by describing events as you witnessed them in a neighborhood incident but what you are really doing is giving the police information they can use against you. Again the law is utterly unconcerned with who actually did the crime just so long as they can hang it on someone. If there is enough circumstantial evidence against you and a neighbor with an axe to grind says he saw you do it, you're gone and innocence be damned.

    @@tdonovan6101 Go have a look at Project Innocence. Look at how many people that committed no crime went to prison without having committed a crime. Look at the skimpy evidence that convicted them. Then see if you can convince yourself it's not true.

They rarely solve a case outside of the parameters set forth by their handlers, and most of them, not all but most, would happily throw you in a furnace for a paycheque and then claim to have just followed orders later. We do not live in a civilized society. We live in enforced and often tense complacency.

    I have as many issues with the police as the next person but I don't think spending a minute to investigate something is bullying. They seemed pretty reasonable and left when they realized they weren't getting anywhere right then.

    I particularly loved the way when she put an allegation to him he responded with a question, then as soon as she asked another question he responded again with “I don’t answer questions”😂😂. Just brilliant!

    As soon as your answer a cops question, you have unknowingly entered a verbal contract with them to which they have authority over you. Because they are asking the questions, they are acting as-king. Just say "do i have the right to remain silent" They must answer yes This is their rules. Not common law

    the only question AFAIK you are required to answer is your name and address, if you don't they are legally able to arrest you to verify your identity, which is not ideal. Once arrested remain silent or answer 'with respect officer I do not need to answer' eventually they will let you go. They cannot hold you without charge. Even if it goes before a judge they will read out that you didn't answer any questions, but it is the police's job to make the case, not yours to incriminate yourself. Remember nothing is 'off the record' with the police. They are always building a case against you.

    @waveman0 from what I've been told, if you do not identify yourself they can arrest you (kidnapping) but they cannot charge you for anything and will eventually have to let you go. But if you do identify yourself, they may not arrest you, but they can now charge you with whatever silly infringement they want too. This worked wonders on a friend of mine during the mask mandates. He did not refuse to identify himself. He just kept asking why he had to.. the cops arrested him (unlawfully) and took him to the station. They couldn't ping him for anything because he did not contract with them in giving his full name

    @@dchil15 The police are not your friends nor will they do you any favours. They are there to do a job and learn manipulation techniques to elicit the required responses. They are also taught specific interrogation techniques and how to word their questions to get specific responses. Lastly, the police will pounce on victims when they are most vulnerable when they know they are off guard and may let slip information that is detrimental to them, say right after an accident when someone is in shock and has no business answering questions. They also rely on the fact many civilians are uncomfortable dealing with authority figures and many play on the fact that they have the upper hand in the encounter. This is why you should never answer questions to the police, it is never in your best interest.

    If that was America, the cops would have reported shots before Ray even got to the door, kicked in his door, shot about 150 rounds off killing Ray, Brit, and at least one of his neighbors. All the officers would have been suspended with pay and then found not guilty on all charges.

    They wouldn't actually. On the contrary, this scene is extremely unrealistic. Australian police still have full c0v!d powers as our politicians keep extending them for no good reason. These include being allowed to enter any property if they suspect there is a crime being committed and being able to request ID for no reason (this was to ensure you were within your 5km limit from home, they are still allowed to do this).

    ​@@eatu4tea yeah Na, that's not true. Queensland ended their state of emergency powers in 2022 and Nsw in late 2023. Victoria in 2022. You posted this response in 2024. But yeah nsw did drag their heels on that a bit.
