Maui Short Term Rental Update
Maui’s burning issue and current debate is over whether or not to roll back the law that allows some 7000+ apartment zone condominiums to do short term rental.
. For years and years, Maui has had a housing crisis. The crisis was heightened by the Lahaina and Kula fires in August 2023. In response to outcries for housing, especially in West Maui, Maui mayor, put forth a bill to repeal the right of condominiums in apartment zones to do short term housing with the aim of converting those short term rentals into long-term rentals or owner occupied condos.
These condos were in fact purpose built for short term rental, and have always had the right to use their property for vacation rentals. That right was codified into law in by ordinance adopted in 2014 and 2016.
Earlier this week county the Maui planning commission heard testimony from 130 of the 200 Eventually, the planning commission deferred any action and will hear additional testimony now scheduled for July 9.
According to estimates 30 and 40% were in favor of the bill to roll back, the STR‘s. 60 to 70% of those testifying opposed to rolling back STR‘s.
But even in the polarized atmosphere of those expressing concern that either the continuation or the rollback of these STR‘s posed an existential threat to them there was one point of agreement.
The agreement is the need for affordable dignified housing on Maui.
In comments on why we are facing a housing crisis, Mayor Bissen cited, “ a myriad of complex issues that have challenged our community for decades.“ He went on to state “this is a consequence we cannot and should not accept. Our system is broken and long overdue for change.“
Hallelujah.
For decades, it has been somewhere between very difficult and impossible for builders to build workforce housing. The US census Bureau noted that housing growth on Maui was “essentially zero” from 2018 to 2022.

    Aloha indeed it is a very thorny issue, in particular I totally understand that those short term rental owners wouldn't want to lose their rights because the county law allowed them to. My situation is a bit different and on a different island, the Big Island. I live on a corner lot of a subdivision and on the road going East there are 3 houses and on the road going North there are 3 houses, all of them single family homes, that were not allowed by county law and HOA rules to be used as short term rentals. All six houses were owned by a couple that live in Oahu. When on vacation folks want to have a good time and some can get extremely noisy. When I brought up the problem with the owners, which by the way threw the loudest parties of all, when they came over, I was told that they did the same thing in their house in Hawaii Kai, in Oahu, which I find hard to believe. To have a dozen or so people hollering woooh, wooh, wooh, whoooooh at the top of their lungs at one thirty in the morning on their open air lanai, it's not pleasant, to say the least. To add insult to injury all six houses were registered with the county as affordable housing, so that they paid only 50% of the property taxes.

    Been to Maui close to 100 times. Was looking to buy during the GFC But HOA is just a turn off.

    We’re in Papakea for the month (July 2024) and I can barely believe what is being done to these property owners. These laws, if passed, will be nothing less than confiscation of their property through forcible devaluation. They bought the property, often from locals, followed the rules and are now having their property rights usurped. Why not go after the locals who sold it to them at a great profit? Insane.

    Sorry for the double post, but I think the Maui Real Estate Industry needs to lead with solutions rather than fighting the change in market conditions. As part of this law, there should be a package of incentives for these small businesses to transition to properties that are properly zoned for Tourism. Maui is in a full blown housing crisis. We don't have enough housing for workers to run our economy. Workers have been entirely priced out of the housing market. The Maui Real Estate Industry needs to do their part. Everyone associated with this cottage industry has done very well. Small Business Owners have been getting positive cash flow, plus the explosive appreciation of their real estate. It is time for us all to work together to transition these people into different investments and take away the pressure that these enterprises impose on housing affordability for the people that live here.

    They were allowed to purchase those with the right to rent short term. It’s their property and last time I checked, it’s still a free country.

    I have heard some Real Estate people say that prices for these condo properties will drop 20% if this law goes into effect. For me, that is a confession. What these business people are confessing is that all of us that live on Maui are being priced out of the market by out of state entrepreneurs that have been driving up the prices as a business proposition. Of course the Real Estate Agents and Property Management Companies are perfectly happy to profit from this enterprise. The bottom line is that working people are priced out of the Maui real estate market because of this business enterprise. ......... People have done very well. A 20% price reduction will amount to approximately 2 years of appreciation, not the end of the world. These are properties that have been paying for themselves. ......... Maybe the Real Estate Agents will do their part and agree to work for zero commision to transition their clients into properties that are properly zoned for Tourism.

    Glad I got to live in Maui in my 20s in the 1990s. The island just isn't the same in so many ways. Heartbroken to say the least. Everything surrounding this fire seems like it's all on purpose. One smoking gun is the emergency proclamation before the fires. Everything is just too convenient and coincidental.
