Man says he's suing a hotel after getting an interview. Here's why

Michigan resident Dwight Jackson filed an employment discrimination lawsuit against the Shinola Hotel in Detroit, Michigan, alleging the hotel only offered him a job interview after he changed the name on his résumé, according to a copy of the lawsuit obtained by CNN.

    That happened to me. I have a foreign name , I kept on applying and got no response. Someone told me to change my name to some western name and then I sent the same resume twice with 2 different names and got a call back in response to the one with the western name. Racism is still there regardless of what any company says.

    @@Bobo-uh1bx That is true. But we all know there are employers who don't give a darn about your presentation or your skills and qualifications. They will solely base it off of your name and or appearance. I worked in HR at a doctor's office in Atlanta. These black ass doctors asked me upon scanning resumes, applications and conducting interviews that of someone came in with a name I couldn't pronounce or a made up name to put a red dot in the right hand corner of the the interview review form. They also instructed me that even if they had the skills if they didn't look a certain way or their names were names add a red dot as well. Only put a green dot of the opposite applicants. Well!!!! I did the total opposite and put in my two weeks notice. I hired 3 red dot people before I left. One in particular when asked verbally and on paper how did he hear about the position he clearly stated on both "my ole' lady". She was a patient.

    Maybe they weren't hiring at the time...too many confounding variables in this case. The accusation isn't supported by evidence. But it'll make the news cycle and when the truth is discovered the story will just go away like usual.

I also wonder if by trying so many times in the first place, if he didn't just have an upper hand knowledge of exactly what they were looking for by the time he succeeded in being hired. Like watching people take a forklift test before you do. If waiting till the end to take your turn, you've already seen the mistakes the others do and when it's your turn, you know what to do and what not to do to pass with flying colors. Yes, I'd like to know what changes he made besides just his name. I really think that's all that happened. Or he finally got lucky as we all do.

    I am a man of color and have been residing in Ireland for many years now and I have experience this sort of treatment quite often. One day, I had a meeting set up with an accounts manager in one prominent Irish bank. I was there and informed one of the customer services staff that I was there to see Mr So and so. While waiting in the main area to infront of an elevator, here comes the manager. As I stood there, he walked right past me, looking all around the place. When I called his name, he looked back, and I identified myself, told him who I was, and we went upstairs to his office. While we were chatting, he said he thought I was Scandinavian because of my name. Mind you, my name is nowhere close to a Scandinavian person, but in his mind, i think he saw my name and quickly put a face and race to the name. I felt sorry for him because it shows the kind of mindset he wears.

    I worked (in the South) with a biracial psychologist who had a very stereotypical white name. For some reason social security / disability forms sent the doctor’s first, middle and last name to the patient on their appointment form. When the patient arrived and saw the doctor he immediately said, “Oh no! I’m not seeing him. I have an appointment with a white doctor!” He then referenced the “white name”. The doctor asked him if he was supposed to change his middle name to Xavier to tip off racist patients to refuse their disability psych assessment with him. Imagine spending months or years applying for disability benefits and then flying your racist flag loud and proud to the psychologist who will be submitting a report used to determine if you get disability benefits. The patient even asked about seeing someone else in the office. After being told that the rest of us only had master’s degrees and that the black man was literally the only person with a doctorate who could do the assessment he went through with it.

I broke my left arm on purpose when i was a kid, (military brat) Actually it was a conspiracy between the elm tree, our neighbors and the fact their little block supporting wall, where I could grab a hand full of those dangling vines and run off into oblivion where that block supporting wall was placed proved one thing, that hand full of vines is going to give at some point, Point being it gave me a broken arm when i landed i don't know from how many feet in the air ! Anyways to make a short story a novel, The Fitzsimens (Denver) hospital technician who cast my arm up was the most caring gentleman ever, said stuff to bring smiles and ease to my battered self, Upon my return to have the full cast shortened, The "White guy replacement" was cutting into my skin at the wrist area, and then denied he was doing so, And after much back and forth, Sure enough I was bleeding where i told him that really doesn't feel like just heat from the little saw ! I remember thinking where is that other doctor, He was caring and funny and I know that would of never of happened if he was there! Regardless of the differences in our skin color ! My Osage Nation's Friend said it best years ago! He said; I'm prejudiced against prejudiced people!

    100%! When I applied with my full Hispanic name, I was never called even though I had a very good résumé with experience and education. Once I shorten my name to sound more androgynous and Anglo, I got calls immediately. So I’m a Hispanic woman and exactly what happened to him happened to me.     @@P.90.603 What do you mean? I never stick around at one place any longer than 3-4yrs, preferring to move around the united states whenever I feel like it. Don't have any possessions that I can't buy again somewhere else, so it works great for me. It's the same with jobs. I never know these people who hire me, we make great friends on occasion where many I still keep in contact with because they were nice to me (and didn't have to be), but they were good people. Now.. not all jobs have been that way. Some have had extremely cruel bosses/supervisors and guess what I do? I quit and find another job where it's not like that. They're all posted publicly, and are gained through NO connections of any sort - other than my natural outgoing personality and ability to convince people I'm the guy for the job and everyone is a loser. Then get a phone call or email, it says please come in for interview.. and sometimes it works, sometimes it doesn't. I don't think you've really given the "system" a chance to work FOR you if that's your impression of how things work. In some cases you're right, like being CEO of a company or a supervisor, etc. but to get a regular job that pays well? You should look better or vet the places you're applying to. For you? Me? Neither one of us needs "somebody in the system" to give us jobs. You just need to try harder and not give up before even starting. My name is "neutral". It could be any race at all looking at the words on paper. I don't seem to have the same issues this Dwight Jackson did. Think it's all in his head and now he's delusional or paranoid just because a few resumes didn't work, and applying again, knowing what they were looking for, he gave them what they wanted - with a name change he believes is the key LOL. Hasn't anybody heard of Dwight D Eisenhower? You know, that one guy who was our president? Now being totally fair, I have come across favoritism with no doubts, but you know what, screw places like that. You tell them to their faces that they're pieces of fee cease and move on, doing yourself a favor in the long run by finding something better instead of crying about how _unfair_ the world is.. when there's more jobs available right now than ever.     First of all, this whole point is ridiculous as I can't think of anyone who would assume that Dwight Eisenhower is black, maybe Andrew Jackson but they would have to be fairly ignorant to not know who Andrew Jackson was. Second, Bruce Leroy was literally the name some black characters gave another Black character in a movie. The kid was black and did martial arts. It was actually a black director paying homage to Bruce Lee.

    I have a muslim name, I used to get little to zero likes in social media comment sections. I changed it to my current fictional name and I have received 80k, 60k, 20k likes in comments within just a few days across multiple videos. When people really can't figure out my name, ethnicity, or religion, they really open up and talk normally. It's a reality I am living.

He’s not entitled to the job with either personality but he does warrant a chance to interview as Dwight and to make his case. If you support this sort of profiling, you are part of the problem.

    Some are asking why would someone sue the hotel and not just move on and try to get a different job. It's not just about the job. It's about standing up to something that has gone on for so long. And let's say that all the times they ignored his real name and actually called him back when all he did was change his name was a coincidence. But what if it wasn't? Even if it loses, that is one mark. Now, in the future, there will be a pattern people could look to if someone sues again for the same issue.

    It is difficult to prove by one person because the allegation is systemic. He says he was ignored by many hotels. To him it seems irregular and that there is systemic racism at work. However, his lawsuit alleges systemic racism against only one hotel. It will be hard to prove that because he didn't get a call back from that one hotel concerning his resume that he is a victim of discrimination. If his lawyer wants to attempt to show a pattern among all these hotels, why is he just suing just the one hotel? If he sued all of them, they would just shrug their shoulders and say they have no idea there is a problem.

    I Call B.S. on this whole scenario, First off, A Business that is customer oriented like a Hotel, does not accept applications over the internet or phone or even mailed in ! In person interviews are scheduled in bulk for several reasons, one is the GM or who ever ain't going to be having people come and go at their own whim, Those prospective employees are going to be scheduled at intervals according to the timeline figured in advance! The bottom line is appearance and skill set ! And the presentation of the prospective candidate, Do they profess an ability to remain calm under pressure, How do they talk, can they describe themselves without cussing or without to much flair in their voice, Businesses aren't looking for a rainbow flag, They are looking for an employee that will represent their products! And you ain't it Pal !

In college twenty some years ago a sociology professor had us track how long it took for us to be waited on in a jewelry store, a car dealership and the response when inquiring about apartments for rent (available or not). I’m sure you can guess which race was waited on the fastest and was always told about the vacant apartments. Twenty plus years later and it’s still the same kind of issue going on. Some people only change when it hits them in their wallets.

    A study based on the ethnicity of names on job applications took place in the UK and 24% of white British applicants received a call back from UK employers, while only 15% of ethnic minority applicants did. The experience, qualifications, citizenship status, was standardised, so the only differentiation was ethnicity. If there has been a similar study carried out in the US, that could also be proof they could use in court.

    yes, there is a well documented study which shows that the "racial sounding names" can have an adverse impact on getting call backs. However, that doesn't seem to be the case here. The first issue here is that "dwight jackson" is hardly racial. The second issue is that his second resume was sent several months later. The hotel industry has a high turn over rate. And you are more likely to get a job or a call back during the on-season rather than the off-season (such as in Jan). Yes, racism is real. But it is highly unlikely that this is what happened here.

    My feathers get all ruffled up every time I hear people say there is no such things as racism in this country. Or, that black people just don’t want to work. This stuff is learned behavior and will keep being passed on to the future if we stop calling people out on it when we see it.

    I'm a white guy named Alvin (named after a relative who was born in the 1920's) which is considered a "black" name. Job interviews have been very scarce over the years
