Legalities of Explosives & How Tannerite is Legal

Ordnance Lab discusses the legalities of explosives in the US at the federal level.
As always, we are not attorneys and none of this is legal advice.     ​@@d3734 Yes, but also no. For example: ammonium nitrate and powered aluminum are not explosives on their own, but when combined they become Tannerite. You are allowed to manufacture Tannerite without a license as long as you aren't planning to store it prior to use. Because the NFA rules are goofy and arbitrary you can get away with goofy things that technically follow the rules. The Mossberg Shockwave is by all rights an SBS but somehow isn't technically a shotgun. The FightLite Raider "firearm" is basically an AR pistol that avoids the pistol classification by using the same raptor head grip as the Shockwave.

    I just ignore the feds. They love to make laws and regulations, but they have little ability to enforce them. A law without enforcement is the same as no law. When it comes to LO vs HO explosives, I have no interest in HO, so I’m not likely to draw attention to myself, because LO explosives are a waste of time and effort for bad guys wanting to destroy stuff. Flash, Thermite, Thermate, … they’re not a threat to anybody, except, perhaps the occasional dumbass who blows off his own hand from being stupid. No mass casualties. Move along.

    well if you think it over thermite can cut stuff down in demo, the same as a torch, or thermic lance, in a way one in the same, or thermite can be used to weld, rail, or make repaires to thick metal, though if you want to get down to it the oxy acet torch is hotter at 6200 degrees f and can do much more damage, but if you really want to start fires hit some scrap metal with one and let the oxygen lever fly and aim it to the side or use a iron powder torch thats a lightshow and a half if thats your perogitive, or the old dangerous stunt of filling a plastic bag with acetaline or gas and lighting it with a pole but its a really stupid thing to do acetlaine is very reactive so much so that if you put it under more then 15 psi it will violently decompose aka blow up, of course what you can get away with depends on the state, some you cant even have pepper spray let alone a gun, some well there is not much you cant as far as ammo goes, as long as not a destructive device or over 50 cal unless its a historical firearm, meaning black powder then that give you larger sizes within reason.

    There is a sport of blowing things up in some parts of Europe, where they blast oil drums into the air (I believe with gas) and see who can get the highest (like anvil chunking as mentioned). I've seen them do this at village fairs! I'm sure explosives could be substituted for extra height...

    Also, when it comes to black powder, you can have 50lbs of it under your baby's crib, as long as it's commercially manufactured. If you make your own from sulfur, KNO3, and charcoal in a ball mill, it has to be stored in a magazine.

    27 CFR, Sec 555, Subpart K They are very careful to refer to "commercially manufactured black powder intended for sporting purposes" everywhere they give relaxed storage rules.

    at last! nice to see another EOD type enjoying life. As a young tot and adult I was blessed with interests in all things that go boom and a father who was the Ordinance Officer at two of the largest ammunition depots in the world. Crane Ind. Seal Beach CA. The sheer joy of watching the destruction of tons of high & low explosives delivered by the iBOXCAR loads. Included were Hegehog barrage rockets, HE shells, tons of cordite, dept charges, torpedo warheads, 500 lb bombs. Munitions used in the 8"-16" guns of our WWII era battleships and heavy cruisers. etc. Life has been a blast to say the least. Good presentation.

    I enjoy your content. Especially from the side of the screen. When I was a little kid I watched a slightly older kid blow his hand apart with what I can only imagine was a m80. It put the fear into me at a young age and I don't mess with explosives. They intrigue me. But I have a healthy respect for them.

    technically no because the "materials" to make "dynamite" include nitroglycerin which is a regulated item. if your materials were not regulated ingredients, like ammonium nitrate + a fuel, then as long as they arent mixed together, you wouldnt be subject to federal regulation.

    @@josephstack149 Correct, certain explosives do require a license to create. Nitroglycerin is one of them and I'd rather someone not do that without a license for their safety. There are much better and easier to make explosives that don't detonate themselves because you thought too hard.

    @Eric Ferguson no, tannerite isn't an explosive officially for the same reason thermite isn't. Gunpowder though, while it has similar properties from a chemical perspective, gets treated as an explosive from a political perspective IF it's used commercially.

    Thanks algorithms, had no idea I was as interested in this as I am, last fooled around w/ explosives in elementary school with an M20 and it scared the hell out of me, got some good laughs and some excellent Knowledge from this video, recall watching a 60 Minutes episode from the 80s where they mentioned that Dynamite with legal in Indiana, I guess we've moved greatly on the availability of things, yet bump stocks banned, subscribed!

    My daughter served in the Army as an Ordnance Specialist. She was stationed in Germany, but spent time in Iraq and Afghanistan (and other places she can't tell anyone due to a confidential agreement she signed). One of her jobs was to destroy Russian military equipment left behind so the Taliban couldn't use it. After her Honorable discharge, she was hired by KBR and was stationed at Bagram airbase. She helped in clearing out minefields, collecting weapons and ammo caches found and taking it out into the desert and destroying them. After that was done she was transferred into logistics and sent out anything our troops called in for.

    Actually you can have hand grenades but you'll have to fill out the forms just like a machine gun or a suppressor and be approved by ATF FBI local sheriff. Plus pay $200 tax stamp and sterilize your grenade.

    Smoothbore sporting arms have a different set of regulations than rifled firearms. For instance barrel length requirements are different. Rifles can have a 16" barrel without being a SBR. A shotgun with a 16" barrel would be an SBS. Unless an opinion has changed at some point in time.

    You say “magazines” for explosive stuff. Can we get a tour of how you properly store explosives? I used to study chemistry and am looking into getting a hazmat endorsement for a commercial drivers license, so this interest me.

    Do you need a commercial reason for an FEL? Or can you just get it to legally blow shit up on your own land/buy the stuff to form 1 grenades/mines etc. Would rockets need additional permitting (I've heard some stuff about people saying the FAA may have issues?) Is the FEL thing for powders by address? E.g. you have a magazine on a seperate property but want to say reload at home, would you be able to? Could you say make some 20mm HE rounds with a

    For the rockets, you basically contact them and get a waiver for a certain altitude and radius from the launch site. (Cylinder shape) Don’t launch while planes are visible. A notice to airmen is issued, but I’m not sure by whom. However, small plane pilots seldom check and will fly over to look at interesting things like rocket launches. Start with a fairly low request like 4000 ft. If you find the right piece of land, you could get approved for 50,000 to 100,000 feet.

    Where you run into trouble is commerce and storage. You can manufacture explosives without a license, for example to remove trunks or damns from your property, but you still have to meet storage requirements. The only way to circumvent that is to not store it. When you need it, manufacture what you need and fully exend it on the range the same day. Make it ON SITE only after you know the weather won’t interfere with your range work, and then use it all.

    Thank You for sharing. Almost impossible to know how county applies the storage of firearm reloading primers and powder. One can know safety and separate storage of primers and powder. Along with fire resist cabinet and X distance from homes. But you ask three different people in fire department and may get six different answers. Rule one careful and exercise precision in use and storage.

    Combining the two components of binary explosives on government properties used to require a license to manufacture explosives. I used to do a lot of "recreational" blasting. In Arizona one only needed to be 18, not a felon, and sign for it. I was required to get a "permit to transport explosives" in the city of Phoenix. The local bomb squad gave it to me. I was also issued a permit to transport and use explosives in Multnomah County Oregon. I would show up in my Nissan Sentra and get 200 lbs. of stumping powder and leave with placards on all sides, detonators on floor in back, and the four 50# boxes of HE in the trunk. I couldn't believe they would pay me to remove stumps by blasting! I would have paid them, as I enjoyed it so. On the forms where it asked where I would store said powder and caps. I would write "to be used immediately." I never died or went to jail. Never even hurt myself or others! Let powder do the work. As a character in a movie said: "There are few problems in life that cannot be solved with a well placed charge of High Explosives."

    Isn’t it the “ATF&E”?, and I believe they classify black powder is as “flammable”, not an explosive, ie burns really fast, not going from a solid to a gas, skipping the burning phase like an explosive. I’m still trying to figure this stuff out.

    So I have been looking for black powder for my muzzle loading rifle. Is there anyone in the state of Oklahoma that can sell me a pound of 3F and a pound of 2F? Fewer gun and reloading stores are handling it because of the storage requirements specific for Black Powder.

    Gotta curious question for anyone who may know the answer? I live in a state where you can buy tanerite targets. I haven't bought any yet because my cousin bought some and was shooting it and got a visit from law enforcement. He was lucky the let him off with a warning but yeah he was informed that it was legal to have it in this state but shooting it was a no no here. Now the state beside us it's not an issue you can have all the fun you want with it. My question is if your not from that state can you still use the targets being from another state without getting into legal trouble? Might sound like a dumb question but it's one I don't know the answer to and I'm not afraid to ask for that knowledge. Don't want to buy the stuff and just have it collecting dust and waisting money on something I won't get to enjoy.

    So how do you go about getting your FEL? I'm well versed with demo from the army, but I would love to get out and work with it. Whether in mines, forestry, demoing buildings, etc. I've always wondered how people get into those types of jobs in the civilian world. Care to make a video on that someday soon?

    Go to the ATF website, choose the License you want for whatever it is you want to do, fill it out, and mail it with the appropriate $-$$$$ check amount to the listed address. They will crawl up your ass a bit, and probably ask more questions, then send you a piece of paper in the mail that says you're good with the FFL number for your business. Go buy your "BOOK" to keep track of E-V-E-R-Y-T-H-I-N-G you buy and sell for said business, and voila, you are an FFL dealer. You will need proper lockable storage as well, for some reason the ATF frowns upon this kinda SH!T disappearing without proper record keeping. Got mine in 1986...should have held onto it all these years.

    @@ntvtexan5015 I'm not talking about an FFL though. I would like to get my FEL. My explosive license. Maybe it's the same process but I would imagine they would have a slightly different process. I always wondered how demolition companies, logging companies, and mining companies accomplished getting ahold of stuff. It would be pretty cool to get it myself and then be able to be hired out from those type of companies. Especially mining. I'd love to would for a mining company as their demolitions expert.

    Tannerite still walks a fine line as the CPSC could easily ban it just as they ban many fireworks that are classified as 1.4g. They already ban pyrotechnic companies from selling dark aluminum with most oxidizers as they classify that as an explosive kit. Most people also probably don't realize that once they mix Tannerite they can no longer travel on public roads as that is now a DOT violation. These laws are convoluted, and that doesn't take into account local and state laws. Also, pyrotechnicians and rocket enthusiasts have serious issues with the ATF classifying items that deflagrate as explosives.

    quick question (and no worries if there isn't an answer...I can always just look it up): why are shotguns exempt from the over .50 cal rules when it can fire a slug that is .73 cal? just curious what the reasoning was. I assume its because of the limited range and that shotguns are sporting guns....but just thought I'd ask.

I had no idea! 👍 interestingly enough: in my county, the local police got told they are no longer allowed to used anything .50cal or bigger because it's military equipment......so, the cops lost their shotguns [which means, they lost a less than lethal tool, from what my police friends have explained to me]. I haven't read the full law myself, so take it with a grain of salt....either way, the police here have been struggling for awhile now.

    So according to atf I can go to my local hardware store pick up some rose bush duster and tree stump remover granules mix it with some charcoal put it in a card board tube and blow up my stove and that would be ok??

    I'm just a guy who is curious to see things go boom and I'm not sure if it is different feeling if you pull the trigger on said explosion but it probably does see as how I play video games and cant really get in to one with out some sort of feedback so I guess yeah but I just want to see one in person safely of course

    I'm cheap. Get the "big blast caps" and some threaded tire valve stems. Fill two liter bottle with 120 psi of compressed air, shoot with the cheapest and most silent bb gun. Then remind your neighbors how much their dogs bark when they complain about the noise. All bark, no bite. Use the hole in the cap for a tether so you don't lose your caps and valve stems for repeated use.

    ok, so you talk about being able to make explosives for personal use, but using black powder or smokeless powder is still a no no without a license. So if I Form 1 a pipe bomb to take out a beaver damn on my property, what kind of explosive can I use in it? All theoretical of course.

    1. That's a question for a real lawyer to answer. Though since you can make your own explosives, why not just make your own blackpowder for your theoretical pipebomb? 2. A pipebomb would be a terrible thing to try to takeout a beaver dam with. 1/2 the time it will turn into a rocket instead of detonating.

    I know it's 8 month late but were do fireworks end up in? Can u make one for yourself no license. commercial I think u would need a license.
