Landlord arrested for attempting to evict tenants at gunpoint

A San Antonio resident who lost his job during the pandemic was in shock when he says his landlord broke into his residence in the middle of the night and attempted to evict his family at gunpoint.
A San Antonio family says they woke up late Friday night to a man in their home, wearing tactical gear and holding a gun. The victims said the man was their landlord trying to use force to evict them.
“At first I thought we were getting robbed,” Jesse Servin said. Then he realized someone had broken down the door.
“That's when I heard a scream, and my bedroom door was also kicked in,” he said. “He forced himself in with the rifle and bulletproof vest, and an LED flashlight so I couldn't see who it was until I heard his voice.”

    Half Star Films don’t ever become a landlord since you obviously don’t understand how it works. If you want to evict tenants, you have to go through the courts. Take it upon yourself and you will be charged and convicted. That landlord can end up going to prison for his stupid actions. You cannot break the law, even if you feel justified.

    @@robinsonharvey6186 nothing wrong with him evicting non paying tenants regardless of why they aren't paying, however, there's a reason we have a legal process that he has to follow. He made it now easy for them to sue him. Yes, there are very real penalties for self help evictions that, if I were them, it's a dog eat dog world. I'd be coming for him financially.

    No it doesn't end up like this. More likely the landlord lost in the court, carry a gun with him and harrase the tenant family. Either accidentally kill the kids or tenant accidentally kill the landlord. Then they all go down hill.

    The best way to get back at your landlord... My friends this works especially if you're in quarantine ( lots of Free time) of a higher chance to make financial debt for your landlord ... My buddy told me he would let the kitchen and bathroom sinks run water for hours fully blast ( landlord pays for water he said.. ) his girl once told my girl she uses baby wipes to do her ' Final wiping then flush them in toilet.** (Baby wipes aren't good for septic-or city sewage)** Sometimes my friend would fix the plunger so the water in toilet would constantly run sometimes overnight and couple days at times ... After a billing cycle goes through the financial burden seems to be a little higher and the landlord will send letters to all the tenants that's how you know it worked that's the best way to get back at your landlord

    @@PerryArt420 EVEN in Texas, the court Judge may have to reconsider and re-think this case. He lives next door. has a gun. showed up at an asshat hour. affected children. Even in Texas that's pushing your "Rights" to the edge. Landlord may be feeling heat from his bank and financials, but the court SHOULD have sent him for psychiatric evaluation before allowing him to post bond. Keep us Posted.

    Not domestic violence. That’s different. The landlord took law in his own hands which it’s illegal. If he wants them to leave. Call local courthouse for an appointment with judge on eviction request. And don’t put your hands on them and throwing them out. Landlord will be arrested and sued for damages.

    If the renters had not paid rent in a number of months - it really changes their renters legal situation. The owner has a mortgage to pay on the property. Most owners can not pay the mortgage when the renters do not pay month after month. How do you suggest the owner get the money to pay the mortgage? Maybe the owner should get a second full time job so these ppl can Live in the property for free? The owners only choices are 1) find tenants that can pay or 2) allow it to foreclose as quickly as possible to ruin his credit and the bank will make sure the house is empty. What if was the owners parents or grandparents home? The owner will loose his revenue because these squatters will not leave. Interesting that these renters don’t appear to have missed a single meal while NOT paying a single dime to the landlord. When kids were young at my home - the kids ate and I kept my girlish figure by NOT eating very much.

    I had to evict a tenant. He failed to understand that by not paying the rent he was forcing me to support him and his family. He actually said I was the reason for all the greed in the world. Never mind the 50k down payment on the mortgage or the 1400 monthly payment that he was forcing me to pay.

    @@kitten_582 why have grocery stores you can grow your own food no? why should someone sell clothes, you can make your own, no? why provide housing? because many wont do so for themselves or are unable due to poor credit low wage etc. housing services are usually half of buying a house and you dont have to pay for repairs upgrades or taxes or insurance. many landlords are thinking long term. to often the tanants abuse the system to get stuff for free.

    @BernieEinreb371 ... Unfortunately throughout America, Squatters even have rights in the eyes of the courts . If a Squatter pre plans a move in say a month before they do and puts a couple bills under their name to that address and can prove it, police can't do anything other than to inform the owners that they must go through the entire eviction process. It's not right and frankly a very messed up law but any Squatter can do this and move their things in the day before getting away with it. Out of my 8 years, I only dealt with squatters twice on my own properties but dealt with eviction cases for other property owners with these problems. I have a feeling with this pademic and residents realizing how difficult it will be to get another place after the second phase is being processed, It is my thoughts that we will be seeing a lot more of these cases arise.

But mortgage and other property bills just keep stacking while your tenants are not providing any income for you to pay those bills and best believe those fuckwits have their Netflix, Hulu, amazon prime, and other services up but paying their bills. yeah, that landlord did handle the situation like a complete moron but u can't be that ignorant and simply take the tenant's side...again going in the night and breaking doors and pointing children and their parents with a gun is a very fucked thing to do and extremely stupid but you have bilateral at times.....Also if I was them I would be looking for another place to live because clearly their agreement did not work out and being stubborn to move is just you putting your own children at risk

Because it’s bad for business to kick people out of their mortgage over something that is mostly temporary. Still looking at this issue and saying it’s the tenants fault because they also can’t pay is some really backwards logic. In case you haven’t realized, it’s not a poor families fault covid happening, none of your welfare queen myths perpetuated by people who celebrated the deaths of aids patients will change that. It’s the governments fault this happening. Not because they are delaying evictions but because they are refusing to help out struggling Americans in hard times.

    No, I'd sue for however much that house is worth. If I win, I'd then file a writ of garnishment for the seizure of the house as payment for the debt owed to me. 1 year rent is not enough for me to settle. I want a lump sum of cash or either that house.

    I hope they get a restraining order against the landlord! That way the landlord legally won't be allowed to discriminate&,harrass them again & due 2 the restraining order the landlord won't b able 2 reside in his house right next to them! He d have to move or would violate the restraining order against him & get arrested again! Cuz this crazy landlord is irrational & irate & proven that he's more then willing to threaten body harm & even death to a young family w 3 small kids! I mean, I'm a landlord & THATS NEVER OK!!! EVER! even if there wasn't already a national suspension on evictions, you still need to evict them! U have no right to randomly, in the middle of the dead of night, break & enter & hold at gun point a tenant, & 2do that in front of his wife& kids! You would still have to follow proper legal eviction procedures, &the laws written in the tenants favor, &usually an eviction notice (once filed properly, which takes a bit on its own) gives a 30 day notice to vacate at which point if the tenants are still at the residence & refuse to leave, you STILL have No Right to go and try to force them out. you then have to file more paperwork to now have the sheriff's come and evict (@which point the sheriff gives tenants 15min to grab & pack up as much as they can& that's it, then & only then can anyone be forcefully kicked out)! & the courts give families with a young children an extra 30 days to vacate the property. and since they have three very small young children the courts will alot then an extra 3 months before they have to vacate the property and then he still would have probably have to wait another month to ask the sheriff's to come and kick them out at which point the sheriff's will give you 15 minutes to grab your stuff and leave but never ever do you ever have a right to come and forcefully enter &@gun point force evict Any tenant/resident EVER!!! boh This guy is worthless w no heart or empathy!

    @Michele I would never be in that situation . 1) I wouldn't have had 3 kids I can't support 2) I put money into a savings for that very reason 3) I would find another job or means to bring in funds no matter what I had to do. Help is fine , but don't rely on others to float you through life

    In Texas 1854 Homestead law that you can have a gun to protect yourself like home invasion. But that crazy landlord was breaking law. We can’t shoot him just call police. If he shoots the family.     These are hard times especially if your were unfortunate and were out of a job. The landlord had already talked about payments with this man. So now he decides to go back on his word and evict the people on his own swat style? There are ways to go about situations like this. Its best to get the sheriffs office involved. Do things correctly and safely especially when there are children involved.

    People really need to STOP taking advantage of the system! Landlords need their rents to pay THEIR mortgages and other bills like water and property taxes. These are recurring costs, and what many in this comment section have NEVER paid. I left my apartment this month because I could no longer afford my rent. At this writing, I am without a home. But I would NEVER have sat in that apartment and felt entitled to free housing. Sure, it's better than being homeless. But no one OWES you anything.🤷🏾‍♀️

    That's easy for you to say if you don't have kids, which it sounds like you don't. It is very foolish for a parent to leave a home without having another safe place for their kids. The father is likely hoping for a job to come through so that he could begin making arrangements. It's not about feeling entitled to free rent but rather about what's in the best interest of those kids, and making the kids live on the streets by leaving before it's absolutely required is not smart or good parenting.

    There are laws right now that state you cannot evict a tenant during Covid19. Its an unfortunate time for everyone, including landlords. Now that being said, this landlord couldve taken legal action or consulted with a lawyer for recourse or loopholes. He was in tactical gear. Armed. Broke into a home in the middle of the night. Held the family at gunpoint. To evict them. Would you be ok if a stranger did that to you? Or a person known to you? Break into your home, point a weapon at you and your children sleeping in the next room? That landlord made this much worse, and now will pay a huge price for this violence.

    What he did was all kinds of wrong but shows how desperate and insane people get when they look at losing what may be their lives savings. If u were only 1 month behind and had made good faith efforts like it appears u did he should have tried working with you. The only thing I'm still not clear on is if u lost your job due to covid why u were not getting unemployment and why u could not get any rent assistance since it has been offered everywhere that I know of as long as u apply.

    jayne I applied took them long time to assist me, I am just now receiving help. I tried everything on helping him out. This past Thursday we went to court and the Judge dismissed it. But I am now moving to an Apartment safer place for my kids. But I do have a second lawyer & I am suing him. His gonna pay for pointing the riffle at my kids and my wife.

    Landlord definitely went way too far. Unfortunately though, the landlords are going to stop making loan payments and then there will be tons of building with a lot of squatters and no tax revenue for the city and things are going to rapidly plunge into chaos.

    Of course the Landlords are going to stop making payments. It's been 6 months of this crazy. It will be a full year soon. The problem is, the government only counted for renters to be in trouble in the pandemic. They did not consider the fact that what they were doing would hurt the landlords. They have bills too. Not all of them are billionaires/millionaires. Some of them are people with two homes, that were using the rent to help pay their bills. Now they are swimming in bills. I'm not saying this guy was right (he was pretty stupid). But the government is hurting the landlords right now. They have no way to pay their mortgage payments when people are squatting. They need to be considered as well. If you want to consider this crazy, help the landlords too. Give them some money, or stop their mortgage payments/taxes too.

Just not sure that is going to happen, but let's give it a try. There are two things that are happening, less landlords and private landlords are raising prices to cover the costs of the eviction moratoriums.

    It's one of those things where it's a lose lose situation. You don't have eviction protections in place, people get thrown out into the pandemic. If you put protections in place to keep people in these homes, how are other people who don't currently have a place to stay going to rent a place? This whole thing is a disaster and might honestly see the downfall of the country due to how mind mindbogglingly inept our government is. They prioritized giving money to mega corporations who don't need it over regular US citizens, and now things are going to spiral out of control.

    Depending local laws they squat on the property while the landlord is in jail. After 6 months he can claim it was abandoned and legally own it

    They charged him with Burglary? He cant burglarize a house he owns. That charge they KNOW will be dismissed. And the intended assualt charge is lame. He should have been charged with aggravated assualt and a kidnapping charge since he forced the man to move without his will at gunpoint. Seems to me like the officers didnt want to overly charge the landlord for whatever reason.

YES you can get charged with burglarizing your own house just like you can get charged with stealing your own car- ie if your car gets towed and you go to the tow yard where it’s being stored and you just strong arm your car back as in you just get in it and drive off they WILL call the police on you and that is a charge coming your way. If you don’t believe it ask Harvard professor Henry Gates. Luckily he’s a Harvard professor and as a result he got to drink a beer on the south lawn.

    The smart thing for any Landlord to do in this mess is work WITH there Tenents not AGAINST them. You can evict someone but if there is not anyone to move in then evicting them doesn't solve your problems. A payment plan and getting the back rent owed over a period of time is better than no money and an empty apartment.

    Sounds like the landlord was trying to work with the tenant and not stack late charges on. I don't condone the behavior of the landlord, but the government makes these mandates without worrying about how homeowners are going to pay THEIR mortgages. A lot of rental properties are mortgaged. People should do everything within their power to pay as much as they possibly can and not use the "system" to get out from under their obligations.

More than likely not poor but in debt like most landlords Taxes; insurance and Maybe mortgages maybe children to feed..👁 Most renters think that landlords are rich; they buy property as an investment so that they can feed their families instead of working on a job.. Some own their properties while some are slumlords and really they are probably getting there just reward but there are also people who are innocent.. These people are being forced by the government to house people for free while they’re debts still goes on they have light bills water bills credit card bills Car payment same as anybody else the renter also pays to how will they pay its recompense because wisdom is always justified of her children and what goes around comes around so the renters will receive their just rewards to by Karma. If that’s what you want to call it and this to Will be at the hands of your Local governments.. Eventually and I hope that this doesn’t happen they will be treated as outcasts/and could possibly be on the street and homeless.. instead of your government helping you they’re putting off the inevitable you cannot keep putting this off and the stimulus that they want to give will not cover the expenses For renters or landlords why because America is bankrupt and most American citizens are so blinded by a so-called pandemic that they can’t see the forest for the trees..     Antonio Delgado You don’t need an attorney to evict people you only need a process server that’s a couple hundred bucks.. and why would someone want landlords to be poor sounds like Hate.. Envy.. Most landlords are victims too and I’m looking on both sides of the fence.. but the final analysis the biggest victims are going to be the renters because they’re going to have a very difficult time paying for housing because of inflation and low wage jobs will not be able to pay for these apartments or homes so they all lie desolate empty.. shamefully; but there’s another catch to this inflation along with the housing crisis there is a big major food crisis shortages of food and other items but the biggest problem is the cost of food is going to skyrocket so it is going to be a very bad situation and a lot of renters will go through this do I buy food or do I have a roof over my head what is your choice that’s the question👁🌊

    I see both sides of this. When people don't makes their payment the landlord has to and that's not fair. The landlord is being cheated out of the money. On the other hand you have to follow the rules evict them, you can't evict by gunpoint. I noticed the tenants had stuff in their house. Back in my day my parents would sell their blood and our stuff to pay rent. People are spoiled nowadays and don't do that. Don't act entitled

    I feel bad for both parties.. However, It is pretty annoying when I hear that people are still out of work.. get a job doing whatever you can right now, even if you don't like it. Im willing to bet that even if the tenant was able to pay a portion of the rent each month during these times the landlord would have had a way different attitude. Younger people these days are fucking lazy, man... Whether or not the house they lived in was paid for or not, its still fucking expensive to maintain a house that you own.. If I was the landlord i'd be going crazy too depending how long these people haven't paid their rent. At some point the house will get taken by the govt. when property taxes aren't paid, and the utilities are just shut off... 🤷‍♂️

    we own our house your right owning a house is a money pit so you have to live somewhere, we just put on a new roof that was only 15 years old because the insurance company was going to cut us off if we did not replace it, we had this company for many years, another insurance company would of charged us way more as new customers good thing we had the money saved up for it, almost 8000 dollars for replacement. now we ill have to build it back up again. i will never be a landlord no matter what to many freeloaders out there who abuse the legal system that was really for real landlord tenant problems ont made up to get out of paying. i have been watching court tv shows and you look at teh judge and the tenant and say what? you believe her/him? when they are losing (the tanants) they come up with every trick in the book to postpone it, I swear they are reading the same book because the exact phrases come ouf their mouths, more and more tanants are mouthing the exact same wording. such dishonesty is why you cant have nice things or peace in this worldl

    Being a landlord in these trying times something like this would’ve never entered my mind. My fiancé and I own a small 3 bdrm house that we rent to a young responsible father who has run into hard times with the pandemic . He is one month behind but doing the best he can.
