    I reallly Need help im trying to figure out if my grandfather possibly had a trustee.the property and land My grampa had they deeded the property to my dad who endedup getting scammed by the whole town basically .. but I believe my grampa owned the mineral rights! 2/3 was owned by oil companies so even tho it’s only 11 acres I still know My grampa was an Investor Theres NO WAY HE PASSED AWAY owing a mortgage ! Mineral rights has bothered me! I found a title My grampa had but I don’t understand any of this! PLEASE HELP ME!!

    What is a title to the property versus mortgage? Title insurance? The papers from when my dad sold the property say “ subject to exception mineral rights” my dad didn’t know anything so I know My grampa would have been smarter with his investment I just know!!

    I Found two different deeds . One was a landing strip in a rich area and one in Florida . But they disappeared . I need someone to help me and I got to get my family out of this mess

    We have a drain erosion problem in my neighborhood, a lady from the state heritage was telling me about land trust, would be a good way to raise money and some how take it off our taxes.

    Can land trusts be used as a way around the "due on sale clause" if you want to get your property protected (somewhat) by an LLC? I've heard that since you are transferring to a trust and not to an LLC, it does not trigger the clause.

    Hello Toby, Why some attorneys recommend on the deed to add the trust name first then trustee name and some recommend opposite? Like: BBB Trust, dated February 1, 2020, AAA, LLC, a Wyoming limited liability company, Trustee OR AAA, LLC, a Wyoming limited liability company, as Trustee of BBB Trust, dated February 1, 2020

    Trustee as trustee of the trust. It usually would be "John Smith, Trustee of the ABC Trust"

    Can you use a land trust to separate a bigger property. For example if I buy 100 acres can I then transfer that land into ten different land trust with 10 acres in each trust? Or when buying the land do I have to buy it in 10 acre lots with the different land trusts.

    Ok, but what if the rental property is already in my name? Can I set up a Land Trust and still receive the benefit of anonymity? I think the property records would show that I sold my rental to a land trust for nothing, or $1 and it would be an obvious paper trail leading back to me? Right now, we rent our wholly owned rental to friends, and we have landlords' insurance, but I do worry about future renters knowing our actual name and suing me for something.

    Question about the trust. Should the offers go in the name of the trust or the title. In other words do we never ever have our name tied to the property all the way back to initial offer or just at the closing table have it titled into the trusts name?

    The offers should be given in the name of the trust. You can purchase the property in your personal name and then transfer the deed/title to the trust. The key isn't that your name is never in the history of the property but that the current owner is the trust and not you personally.

    Can I put a townhome in a land trust and the beneficiary into an LLC while it's under a conventional loan? I know that moving the rental directly into an LLC while paying the loan it goes against the lender rules.

    You may be the perfect person to opine on the strategy of buying properties, and assuming "non-assumable" loans. In other words, not telling the bank, just buying the house, making the remaining payments on the lower interest mortgage, and knowing that the mortgage companies, as a rule, do not call the loans due. Is that a strategy you can believe? One guy says he's had 5 loans called among many hundreds of assumed loans. What say you?

    To name a land trust do we have to check with IRS or state or anywhere to make sure no one has that name? Is it enough to leave a copy with a lawyer? Thanks so much!

    No, since land trusts are not part of the public record no name search needs to be done, you can simply use whatever name you'd like. Our standard practice is to simply use the street address for the property that will be held in that trust. And you shouldn't need to leave a copy of the trust with anyone. You will simply have the trust created and then transfer the ownership of the property into the trust through the use of a deed, just like any other property transfer.

    Land trusts generally do not provide asset protection so to get asset protection we will generally link the land trust to an LLC by assigning the beneficial interest of the trust to the LLC.
